23 PKSDE shall be responsible to perform or cause to be PKSDE Tie-In Work and Obligations. F performed and shall be responsible for any andi all costs in relation to: A the survey, design, specification, engineering, procurement, construction of fiscal metering, Emergency Shutdown Valves (ESDVs). pig launcher and connecting pipeline from fiscal metering at Senipah Facility to Power Plant (Connecting Pipeline") wth all accessories, appurtenances and supporting equipment as described in Exhibit 1 subject to approval of TOTAL; the asset integrity of the above-mentioned facilties under Article 2.2 A including the maintenance and inspection during the term of this Agreement, the tie-in of the Connecting Pipeline to Buyer's Facilities outside Senipah Facility; the identification of, application for and the obtaining and maintaining of necessary permits, licenses, nghts of way, government approvals, and any third party consents with respect to performance of PKDSE under this Article the Pre-commissioning PKSDE Tie-In Work of the above-mentioned facilities under Atticle 22 A as well as Connecting Pipeline pre-commissioning which consists of cleaning; dewatering and optional swabbing; drying and flushing the pipeline; stabilization at the final dew point; and filing with nitrogen and inerting (when required) TOTAL shail, in accordance with the Standard of a TOTAL Tie-In Work and Obligations, Reasonable and Prudent Operator, be responsible to perform or cause to be performed and ‘shall be responsible for any and all costs in relation to: A B. the hot tap tie-in to existing 36° main gas pipeline; the design, specification, engineering (design, studies and review) of Tie-In Facilities as per TOTAL standards and specifications; the design, specification, engineering, procurement, construction of isolation valve, including Process Shut Down Valve (‘PSDV") and flange for metering skid with all accessories, appurtenances and supporting equipment as described in Exhibit 1; the asset integrity of the above-mentioned faciities under Article 2.3 A, B and C including the maintenance and inspection during the term of this Agreement, the personnel allocation to supervise the quality assurance and quality control of the material procured ty PKSDE and the production of the final document dossier and pre- commissioning dossier, in relation to the Tie-In Facilities: the identification of, application for and the obtaining and maintaining of necessary permits, licenses, rights of way, government approvals, and any third party consents with respect to performance of TOTAL under this Article 2.3; the Pre-commissioning of TOTAL Tie-In Work of the above-mentioned facilities under Atticles 2.3 A and G; the Commissioning in coordination with PKSDE; and in coordination with PKSDE, perform the baseline intelligent pigging after the commissioning as part of quality assurance of Buyer facilities.34 32 Costs under Articles 2.2 and 2.3, PKSDE shall be responsible for all costs and charges ‘associated with the activities as described in Article 2.2 and TOTAL shall subject to Articles 7.2 and 7.4 herein be responsible for all costs and charges associated with the activities as described in Articles 2.3 except Article 23 E ‘Other Costs. PKSDE shall be {uly responsible for any costs incurred due to activities outside the scope of TOTAL Tie-In Work and shail reimburse all actual costs and charges incurred by TOTAL in the event TOTAL is forced to cary out activities other than those governed by this Agreement but in the judgment of TOTAL as Reasonable and Prudent Operator are required to support the Tie-In Works including in emergency situation during the performance of the Tie-In Works which emergency situation will be notified immediately by TOTAL to PKSDE.
