THE BILL OF RIGHT

WHAT, WHY, & WHEN


In 1787 our founding fathers creating the
Constitution.
Originally the constitution did not include the
specific rights of the people of the United
States. So the Constitution allowed changes,
known as amendments, to be made to the
constitution.
In 1791 the Bill of Right was added to the
Constitution.
The Bill of Rights are the first 10
amendments of the constitution.

THE FIRST AMENDMENT


Freedom of speech. Freedom of the Press.
Freedom of Religion.

Congress shall make no law respecting an


establishment of religion, or prohibiting the free
exercise there of; or abridging the freedom of speech,
or of the press; or the right of the people peaceably to
assemble, and to petition the government for a redress
of grievances.
Today you are allowed to believe in the religion of our
choice. You are allowed to publish whatever you wish,
as long as you are willing to accept the consequences.
You are also permitted to protest as long as it is in a
public location and youre not breaking any laws.

THE SECOND AMENDMENT


Right to Bear Arms

A well regulated militia, being necessary to the


security of a free state, the right of the people to keep
and bear arms, shall not be infringed.
Militia= The army
This amendment allows citizens to own a handguns and
rifles. However many states do not allow ownership of
assault rifles.

THE THIRD AMENDMENT


Quartering

No soldier shall, in time of peace be quartered in any


house, without the consent of the owner, nor in time of
war, but in a manner to be prescribed by law.
This amendment was passed so that the government
cant use your personal property to house soldiers.

THE FOURTH AMENDMENT


Search and Seizure

The right of the people to be secure in their persons,

houses, papers, and effects, against unreasonable


searches and seizures, shall not be violated, and no
warrants shall issue, but upon probable cause,
supported by oath or affirmation, and particularly
describing the place to be searched, and the persons or
things to be seized.
This restricts the police from searching you or your
property without reason or probable cause. The only
way the police or government can search your property
is with a search warrant.

THE FIFTH AMENDMENT


Due Process, Double Jeopardy, Self-Incrimination

No person shall be held to answer for a capital, or otherwise


infamous crime, unless on a presentment or indictment of a
grand jury, except in cases arising in the land or naval forces, or
in the militia, when in actual service in time of war or public
danger; nor shall any person be subject for the same offense to
be twice put in jeopardy of life or limb; nor shall be compelled in
any criminal case to be a witness against himself, nor be
deprived of life, liberty, or property, without due process of law;
nor shall private property be taken for public use, without just
compensation.

Steps taken from arrest to trial must be fair. You cant be tried for
the same crime more than once after the court has reached a
verdict. You have the right to remain silent with the police or in
court.

THE SIXTH AMENDMENT


Right to a speedy trial, public trial, jury trial,
subpoena, and an attorney.

In all criminal prosecutions, the accused shall enjoy the right


to a speedy and public trial, by an impartial jury of the state
and district wherein the crime shall have been committed,
which district shall have been previously ascertained by law,
and to be informed of the nature and cause of the accusation;
to be confronted with the witnesses against him; to have
compulsory process for obtaining witnesses in his favor, and
to have the assistance of counsel for his defense.

THE SEVENTH AMENDMENT


Right to a jury trial in a civil case.

In suits at common law, where the value in


controversy shall exceed twenty dollars, the right of
trial by jury shall be preserved, and no fact tried by a
jury, shall be otherwise reexamined in any court of the
United States, than according to the rules of the
common law.
A civil case is when someone is being sued. This
amendment requires the right to a jury during a civil
trial.

THE EIGHT AMENDMENT


Cruel or Unusual Punishment

Excessive bail shall not be required, nor excessive


fines imposed, nor cruel and unusual punishments
inflicted.

Bail is the money that you pay to get out of jail while
you are awaiting your trial for a criminal charge. This
amendment also addresses that the punishment needs
to fit the crime you have committed .

THE NINTH AMENDMENT


Rights of the people

The enumeration in the Constitution, of certain rights,


shall not be construed to deny or disparage others
retained by the people.

This amendment means that is the rights were not


specifically spelled out in the constitution then those
rights belong to the people. For example, the
constitution says nothing about your internet service
provider. Therefore, the government cannot deny you
that choice.

THE TENTH AMENDMENT


Rights of the State

The powers not delegated to the United States by the


Constitution, nor prohibited by it to the states, are
reserved to the states respectively, or to the people.
This amendment means that if the rights were not
talked about in the constitution then those rights
belong to the state. For example, the Constitution is
silent about driving a car. It is up to each individual
state the age that a person can drive a car alone.
