WAIVER OF APPEARANCE
ACCUSED, to this Honorable Court most respectfully avers: THAT--The hearing of this case for presentation of evidence for accused is set on
______________________________.
In view thereof, accused waives her presence during the said date of
hearing and in subsequent hearings except when it is her turn to testify on her
own behalf, it being understood, however, that herein accused admits the
following stipulations and undertakes to comply with the following conditions set
forth in her bail, to wit:
1. Every time her name is mentioned in the course of the trial, she agrees
that said name pertains to her and that she will not dispute her identity
with such name;
2. To appear before this Court whenever so required by this Honorable
Court, and that in case of failure on her part to do so without
justification despite due notice, such failure shall be deemed an
express waiver of her right to be present on the date specified in the
notice, and trial may then proceed in absentia;
3. To surrender herself for the execution of the final judgment;
4. To desist and refrain from leaving the country without prior permission
from this Honorable Court; and
5. To notify this Honorable Court of any change in her present residence
which is at Brgy. Santan, Sta. Rita, Samar.
6. To strictly abide by the foregoing undertaking during the entire
proceedings of this case until its final termination.
