Kate Upton

Kate began working with Michael Reid in 2005. Kate previously was
working at Savill Galleries (Savill Galleries, 2015) however in 2004
was sexually harassed by the manger of the art gallery. Sexual
harassment is unlawful because of the Anti-Discrimination Act 1997
(NSW) and theSex Discrimination Act 1984 (Cwlth) (Chapman &
Malcolm, 2013), these acts cover a wide range of unwanted sexual
behaviour that makes the victim feel offended or humiliated. Kate
contacted the Australian Human Rights commission for advice with
what to do and issued a complaint. The police were called and after
further investigation the manager was charged with Sexual Assault
and 10 years in prison (Armstrong legal, n.d.).
In February, at the start of 2014 Kate fell pregnant to her husband
Jarrod. With her second child on the way Kate continued to paint for
her dealer, 7 hours a day 5 days a week. Having baby didnt restrict
Kates speed and quality of producing paintings and she was still
able to deliver a constant flow of paintings to her dealer. Kate faced
a challenge when half way through the year her 6-month contact
with Michael Reid didnt renew. Michael Reid emailed Kate saying
their contact would not be renewed because as the pregnancy
develops more, Kate wont be able to provide a steady flow of work
to her areas of the gallery.
Kate was outraged by this and knew she was being discriminated
against. This action of discrimination is in fact violation of the Fair
Work Act 2009 (Cth) and the Sex Discrimination Act 1984 (CwlTH)
(Chapman & Malcolm, 2013). Kate didnt want to spend time
reporting the issue, or money paying for a lawyer. Instead Kate went
through a Grievance procedure with the business and formally
recognised her issue with the discrimination that took place. After a
meeting with her dealer and having a negotiation (a method of
resolving disputes where the parties involved discuss the issues in
an attempt to reach a compromise) both parties came to a fair
conclusion and Kates was still able to sell her art through Michael
Reid.
