CITY ATTORNEY UPDATE

San Diego City Attorney Jan Goldsmith issued the following statement in response to
yesterdays opinion by the Fourth Appellate District Court of Appeal on the legality of
tiered water rates in the City of San Juan Capistrano:
The City Attorneys Office has been careful to guide the City so that San Diegos tiered water
rates are based on the real cost of providing service. That is consistent with the courts decision
in Capistrano Taxpayers Association v. City of San Juan Capistrano. San Diegos 2013 Cost of
Service Study indicates how the cost of water at each tier for single-family residential customers
is calculated on the actual cost of water and service.
