Dear Lieutenant Martel: ‘On March 22, 2015 you were involved in a single vehicle motor vehicle crash on Route 15 in Colchester, Vermont. During the investigation of the crash, the responding law enforcement officers suspected you were operating the motor vehicle while under the influence of intoxicating liquor. ‘You were arrested, cited in to court, and at your arraignment you pled guilty to driving under the influence of alcohol. ‘Your conduct on March 22, 2015 is a serious transgression that has brought public discredit to yourself and the Department. Itis in direct violation of South Burlington Police Department (Department) General Order (G.0.) AD-117.2.0 subsections (A) and (C), the Department Oath of Office (G.0. AD 105), the Department Law Enforcement Code of Conduct and the Department Law Enforcement Code of Ethics, Under G.O. AD-118, a range of discipline is available to the Department to respond to conduct by an officer that falls below the Department’s standards or is in violation of Department policies. Included among the disciplinary options is suspension for up to 30 days without pay. G.O. AD-118.4.0 C. Based upon your conduct and the above-cited violations of Department policies, I am advising you that you are suspended from duty, without pay, for 20 work days (160 hours), effective Monday, April 20, 2015. After your suspension, you will resume your departmental administrative duties.
