AFPM sues EPA over renewable fuels mandate

The American Fuel & Petrochemical Manufacturers filed a lawsuit today in the D.C. Circuit
Court of Appeals against EPA' s 2013 renewable fuel mandate, alleging the agency relied on data
unavailable for public comment.
The group is challenging EPA' s "use of methodology for setting cellulosic biofuel requirements
that is shrouded in secrecy and continues to overestimate the amount of cellulosic fuel that will
be produced and available for compliance,'' according to a press release.
AFPM is arguing that EPA is retroactively applying requirements.
It also petitioned EPA to waive the 2013 cellulosic biofuel requirement amid anticipation of the
agency's release of its 2014 requirements.
AFPM and other oil industry officials asked the White House Office of Management and Budget
on Sept. 26 to reduce 2014 volume mandates.
"While EPA missed the mark in finalizing the 2013 renewable fuel standards, we are pleased
that the Agency acknowledged the problems with the ethanol blendwall and are cautiously
optimistic that it will exercise its waiver authority in connection with the upcoming 2014
rulemaking to establish more feasible volumes of renewable fuels,'' AFPM General Counsel
Rich Moskowitz said in today's press release.
