BOARD RESOLUTION NO. _0G, Series of 2015
WHEREAS, Truck-for-Hire (TH) Service plays a vital role in the economic
stability of the country. This service is the primary mode of land transportation of
goods and merchandise within the archipelago. The public depends on the
prompt and efficient delivery of goods ane basic commodities necessary to daily
living. A delay or cessation of operation of TH Services entails untold
inconvenience to the public;
WHEREAS, pursuant to paragraph (k) of Executive Order No. 202, the
Board is implementing a policy regarding “Non-Confirmation Year” provision in
the Decisions approving applications for TH Services, to wit:

WHEREAS, the Board has "received numerous Motions for
Reconsideration on the issue of the Non-Confirmation Year (NCY);
WHEREAS, the Board is fully cognizant of the detrimental effects in the
nation's economy of any disruption in the regular operations of TH Services;
NOW, THEREFORE, the Board resolves, as it is hereby resolved, that the
Confirmation of the tuck units affected by the NCY may be allowed for justifiable
reason/s, provided @ Motion to Allow Confimation of Unit/s is filed and approved
by the Board.
RESOLVED FURTHER are the following:
1. For truck units with no year medel indicated in the Certificates of
Registration issued by the Land Transportation Office (LTO) shall only be
allowed confirmation provided a Cezification of Year Mode! duly issued by
the LTO is submitted consistent with the provisions of Joint Administrative
Order No. 2014-002; i2. The Information Systems Management Division and the Records Section
of the Regional Offices are directed to update the database indicating the
year model of the authorized units;
3. The Legal Division and the Regional Offices are directed to only accept
Certificates of Registration with the year model indicated therein;

. The Legal Division and the Regional Offices are directed to incorporate
the NCY provision in their recommended Decisions until the Department
of Transportation and Communications has fixed the mandatory age-limit
for TH Services; and,
5. The Executive Director, uoon recommendation by the Legal Division, is
hereby authorized to act for and in behalf of the Board any Motion relative
to this Resolution. The Regional Directors are likewise authorized to act
on said Motions for applications which had been filed in their respective
offices and approved by the Board, as well as Decisions approved by
them.
