AN ACT relating to a health facility patient's visitation rights.
Create a new section of KRS Chapter 216B to allow a patient of a health facility who
is 18 years of age or older to designate, in writing, an individual not legally related by
marriage or blood, who the patient wishes to have visitation rights; require the health
facility to note this designation in the patient's permanent medical records; provide that
the patient may rescind the designation at any time, in writing.
HB 118 – AMENDMENTS

AN ACT relating to a health facility patient's visitation rights.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

 SECTION 0. A NEW SECTION OF KRS CHAPTER 216B IS CREATED TO READ AS


FOLLOWS:

(1) Each and every patient of a health facility, as defined in KRS 216B.015, who is eighteen

(18) years of age or older and who does not have an appointed legal guardian may

designate upon admission, in writing, any individual not legally related by marriage or

blood to the patient, who the patient wishes to be considered as having visitation rights.

If a patient has an appointed legal guardian, the guardian may make the designation on

behalf of the patient.

(2) A health facility shall note this designation in the patient's permanent medical records.

(3) A designated individual shall have all visitation rights.

(4) The patient may rescind a designation at any time, in writing.
