JOMM ISA PROBABLE CAUSE CASE #: 15-19141 TO: FIRST APPEARANCE MAGISTRATE DEFENDANT: Deandre Najee Johnson CHARGES: Battery- Cause Bodily Harm SUMMARY OF OFFENSES AND PROBABLE CAUSE AFFIDAVIT: On Wednesday night, June 24, 2015 at approximately 11:30pm a disturbance occurred at Yiannis nightclub, part of Strip Entertainment Group, located at 320 Raven St. This establishment is in the city of Tallahassee, FL and near the FSU campus. An officer with the Tallahassee Police Department was at the business and reported the incident as a battery offense. The following information was obtained from video at the scene and during interviews with the victim and witnesses. The victim was in the nightclub waiting to order a drink at the bar, which was very crowded, When she got to the bar she felt someone pushing her from behind, aggressively. She turned to address the person pushing her, the defendant, who was now face to face with the victim at the bar. The victim raised her right arm to defend herself, The defendant grabbed her arm that was raised and began pushing her. The defendant maintained his grasp on her right arm. The victim raised her knee to the defendant's midsection in an attempt to shove him away. The defendant pulled her arm down as she was pushing him with her knee. The victim attempted to strike the defendant with her lef fist to release his grasp. The defendant countered by punching the victim on the left side of her face. The two then separated with the victim remaining at the bar and the defendant leaving the establishment with associates. One of the witnesses heard the victim yell “no” twice at the defendant prior to him punching her in the face. The victim’ account is consistent with video from the scene. The victim suffered bruising under her left eye, swelling to the left cheek and upper lip, and a small cut near the bridge of her nose. ‘The defendant was named by witnesses at the scene and his identity was confirmed by photograph. The victim does not know the defendant.
