2. The following attorneys were present:

3. A written stipulation (Local Rule 16.3(b)(3)) was filed.

4. After consultation with the parties and counsel, the Court determined that this case will

proceed on the STANDARD track.

5. The parties did not consent to the jurisdiction of the United States Magistrate Judge

pursuant to 28 U.S.C. § 636(c).

6. Rulings as to type and extent of discovery: RULE 26(a) DISCLOSURES TO BE

EXCHANGED BY FEBRUARY 28, 2007.

Where an objection is raised to an interrogatory, request for production of documents or

request for admissions, the parties serving and responding to the request shall attempt to resolve

their dispute within fourteen (14) days of the objections being serv ed upon the proponent. Failing

to resolve that dispute, either party shall certify the discovery dispute, pursuant to Local Rule 37.1,

within ten (10) days thereafter or the objection shall be deemed waived.

7. Discovery cut-off date: JULY 30, 2007

a. Plaintiff’s expert disclosures, with reports due: MAY 1, 2007

b. Defendant’s expert disclosures, with reports due: MAY 31, 2007

8. Without leave of Court, no discovery material shall be filed, except as necessary to support

dispositive motions.

9. Deadline for amending pleadings and adding parties: MAY 29, 2007

10. Deadline for filing dispositive motions on or before: AUGUST 20, 2007, THREE (3)

WEEKS FOR RESPONSE; TEN (10) DAYS FOR REPLY.

11. Date of telephone status hearing: MAY 21, 2007 AT 9:30 A.M.

12. Date of final pretrial conference: NOVEMBER 19, 2007 AT 9:30 A.M.

13. Trial date: DECEMBER 4, 2007 AT 9:00 A.M.
