examinedandnomaterialpublicprosecutionwitnessisleftfor
examinationandhencethereisnoapprehensionofinfluencing
anyofthem.Hehasfurthersubmittedthatafterthedismissal
ofthepreviousbailapplicationoftheapplicantvideorderdated

spentfurtherperiodofmorethensixmonthsincustodyandno
moreprosecutionwitnesshasbeenexamined.Hehasfurther

submitted that mobile phone call records relied upon by the
prosecution,contradict the caseoftheprosecution itself. He
hasfurthersubmittedthatitwasacaseofhonourkillingand
not murder, as alleged by the prosecution. He has further
submitted that some of the material public prosecution
witnesses in their cross examination, have contradicted their
earlierpartoftestimonyintheexaminationinchief. Hehas
furthersubmittedthattherearelargenumberofdiscrepancies
in the testimony of material prosecution witnesses and the
applicantislikelytobeacquittedandhencenopurposewould
beservedbykeepingtheapplicantincustodyanylongerand
thathemaybereleasedonbail.

Percontra,ld.Addl.PPforStatehasstronglyopposed

thebailapplicationoftheapplicantandhassubmittedthatall
thegroundsurgedbytheld.counselforapplicantonmerits,
havealreadybeenconsideredbythisCourtwhiledismissingthe
previous bail application of the applicant vide order dated
4.12.2014 and there is no change of circumstance. He has
furthersubmittedthattheargumentsofallegedcontradictionof
evidenceinmaterialpublicprosecutionwitnessesandtelephone
callrecords,relieduponbytheld.counselforapplicant,was
available with the applicant at the time of arguments on the
previousbailapplicationoftheapplicantandhencemerely

becausethesaidgroundswerenotformallyurged,itcannotbe
saidthatthisCourtdidnotconsiderthesame.Hehasfurther
submittedthatmeticulousexaminationofthetestimonyofthe
material public prosecution witnesses cannot be done in the
mannerattemptedbytheld.counselforapplicant,atthestage
ofdisposalofthisbailapplication.

Thereisforceintheargumentsofld.Addl.PPforState

thatthereisnochangeincircumstanceasfarasincriminating
material available against the applicant on record till date, is
concerned.Furtherafterdismissalofpreviousbailapplication
of the applicant vide order dated 4.12.2014, PW15 Const.
Bahadur Singh Negi was further examined in chief, cross
examined and discharged on 18.2.2015. Also PW Const.
Praveencouldnotbeservedsinceheispostedondeputationin
IndianEmbassyinPakistan.ThisCourthasalreadyconsidered
the material submissions of the ld. counsel for applicant on
meritsandhadalsoperusedtherecord,whiledismissingthe
previous bail application of the applicant vide order dated
4.12.2014. Merelybecausetheapplicanthasspentsomemore
time in custody and also because only one witness was
examinedafterthedismissalofpreviousbailapplicationofthe
applicant,itcannotbesaidthattheapplicantisentitledforbail
onthesaidground.TheCourthastoconsiderthetotalityof

facts and circumstances, gravity of offences and the
incriminating material available against the applicant.
Consideringthesame,Iamoftheconsideredopinionthatthis
is not a fit case to grant bail to the applicant at this stage.
