Section 3. Styrofoam Ban.

Effective ____________________, No food packager or any retail


establishment in the Municipality of ____________ shall sell or serve prepared food and no food
packager shall package bakery products, eggs, meats and other foods using polystyrene foam
containers. That the Municipality of ___________ shall not aquire, purchase or use in any
manner polystyrene foam food or beverage containers. That, the parties who contract with the
Municipality shall not use polystyrene containers at any facility or in any project that are funded
in whole or in part by the province. And lastly, that retailers may not offer polystyrene foam
products i.e., trays, cups, coolers and plates.

Section 4. Exemptions.
A. Seafoods and Raw Meats. The prohibition on retail sales shall not extend to selling raw
seafood and raw meat, for consumption on or off the premises. Cooked seafoods are not
exempted.

B. Automatic exemptions on prepackaged foods, and polystyrene coolers and ice


chests (not coming from source funded by province).
C. Other requests for exemptions may be made. This is when there is no suitable
alternative exist for a specific application and/or situations where no reasonably
feasible alternative exists to a specific and necessary prohibited container.
Section 5. Alternative Methods.

A. Compostable products include:

Paper or other plant fiber, such as from sugarcane, bamboo, or rice.

Soy potato, corn, or other plant starch based bio-plastics, such as PLA clear
plastic, that are compostable.

B. Recyclable products include:

Trays or aluminium foils and lids.

Section 6. Penalty. Any food packagers, establishments caught violating this ordinanace shalle
be imposed a penalty of an amount not excedding Three thousand Pesos (Php 3, 000.00) for
the first violation; Seven Thousand Thousand Pesos (Php 7, 000.00) for the second violation;
and Ten Thousand Pesos (Php 10, 000) for the third violation. After ample opportunities to
comply, any fines levied would go to Municipality, earmarked to supplement education and
outreach around polystyrene.
