Lay-off of an Industrial Establishment

The detailed procedure for lay-off of the industrial establishment:


1. An application in Form O-3 (in triplicate) (Form of application for
permission to lay-off, to continue the lay-off of workmen in an industrial
establishment to which provision of Chapter V-B of the Industrial Dispute
Act, 1947 (14 of 1947) is required to be sent to the Appropriate Government
for seeking permission for lay-off. The copy of the same application to be
served on the workmen concerned and a proof to the effect is also required to
be submitted along with the application.
2. Notice in Form O-1 (for commencement) should be displayed in the Notice
Board of the Site Office within 07 days, simultaneously endorsing copies of
the same to all the concerned authorities. Copies of Notice are to be served
either by hand or by registered post with acknowledgment due and receipts are
to be preserved.
3. The following benefits must be paid on the date preceding to the date of layoff to all the workers who will be completing continuous service of one (01)
year or more on the day immediately preceding the date of lay-off.
4. 50% of total of the Basic + Dearness Allowance
5. Notice of lay-off in Form O-1 must be served by personal service or by
registered post within 7 days of the date of lay-off to the following authorities:
