MANILA – Farmers and landowners from Norzagaray, Bulacan have decried the
delay in a plunder case accusing presidential candidate Manuel Villar Jr. of “technical
land grabbing.”
Filed in Sept. 26, 2008, the graft and plunder cases claim that lands owned by the
farmers “were mortgaged by Villar’s companies…using dubious titles,” the farmers
said in a statement issued Thursday.
However, the cases have not been acted upon despite repeated follow-ups, said the
same statement distributed during a Quezon City press conference organized by the
farmers.
Companies owned by Villar, the Nacionalista Party standard bearer, and his wife,
Cynthia, have engaged in “technical land grabbing,” Attorney Peter Anthony V.
Rafanan told GMANews.TV, referring to the case filed by Gina Jarvina and Valentino
L. Amador.
Rafanan, litigation manager of the PAV Rafanan & Associates Law Office, represents
more than 100 farmers, including the two plaintiffs.
Jarvina and Amador also filed “a pending criminal case for violation of Article 316
(other forms of swindling) of the Revised Penal Code against Mrs. Villar before the
Office of the City Prosecutor of San Jose Del Monte, Bulacan.”
An estimated 100 farmers claimed that “their lands were mortgaged by Villar’s
companies – Capitol Development Bank (now Optimum Development Bank) and
Manila Brickworks Inc. – to the Bangko Sentral ng Pilipinas (BSP)…for P1.5 billion
using dubious titles.”
“Villar’s companies, represented by his wife, Las Pi?as Rep. Cynthia Villar, in the
mortgage contracts with BSP, failed to pay the loans,” the statement said. “[The] BSP
foreclosed the mortgage and finally acquired the lands in a public auction. At the time
the loans were contracted, Senator Villar was the Speaker of the House of
Representatives.”
“The uncertainty of our life is a problem,” said Victoria Del Monte, one of the

People, indeed have short memories! They tend to forget incidents in the past which
may have grave implications on current issues they are facing! A case in point is the
matter between a group of farmers from Norzagaray, Bulacan who woke up one day
to find out that the 484 hectares of farmland the have occupied since the turn of the
century is being claimed by its new owners, the Central Bank of the Philippines! They
made one fatal mistake - they dealt with Manny Villar (now running for the highest
position of the land - God forbid) and his family owned Capitol Development bank
(now known as Optimum Development Bank)!
Ill-advised by politicians who had an axe to grind against Villar (who by then has
wrested the speakership of the House of Congress), the farmers and their lawyers filed
plunder cases against Villar - all of which were subsequently dismissed in his favor as
expected! (Ponder...ponder...How can the poor farmers win against a wily
businessman-turned-politician who knows how to use money and influence to nuy
himself favors everywhere?)
In retrospect, lets recall that this case was blown into the open by then congressman
and former Speaker of the House Joker Arroyo (amazingly one of his staunchest ally
and defender today) in a speech he delivered on August 17, 1998. Smarting from his
loss of the speakership of the house in June,1998 to Villar, Joker asked some
investigative journalist to dig deeper into information he received about an alleged
land-grabbing incident in the hilly town of Norzagaray in Bulacan, right beside the
foothills of the Sierra Madre. Joker charged the new speaker with ten instances of
graft and corruption among which was the case of the Norzagaray farmers and the 484
hectares of land they have been tilling since time immemorial which without their
knowledge and consent, Villar used as a collateral for a 1.6 billion loan with the
Central Bank.
Where is the spin and the rub here ?
To start with, the complaining farmers have occupied and tilled the 484 hectares of
land in question for ages now for which they were granted titles in 1960 after proving
continuous occupancy of what was then public domain.When a fire destroyed the
building which houses Norzagaray's Registry of Deeds in 2007 (suspicious ain't it?
...Happening as it is at the time Villar was sounding out his intention to run for
president!), the farmers had the surprise of their lives they filed for a reconstitution of
their titles with the Bulacan RTC after that. They found out that the Central Bank was
putting a claim of ownership to their land!
As it turned out, the 484 hectares occupied and tilled by the poor farmers was used as
collateral for a 1.6 billion loan made by Capitol Development Bank headed then by
Villar's wife Cynthia Villar in June, 2001. The loan was not paid on time and the
Central Bank claimed the properties in April, 2008 instead.
How can this be? Well, your guess is as good as mine!

 But wait, when the Central Bank went to file for the transfer of ownership of the now
contested land, they presented the titles surrendered to them by Capitol Development
Bank...and guess what!....the original certificate of titles were issued on July 25, 1944
- during the Japanese Occupation when clearly the civil government was non-existent
then. Under the Commonwealth Act 141, "the issuance of sales patent was illegal and
inoperative during the Japanese Occupation"! (Wily Manny, indeed!)
Today, the farmers are still contesting ownership of the land with the Bulacan RTC.
Unfortunately, the farmers and their lawyers were used as political pawns by Villar
enemies who saw a possibly bigger case than a simple land grabbing case which may
only pin down his wife Cynthia who was president of Capitol Development Bank.
They were urged to file a plunder case against Villar instead with a claim that Villar
used his influence to get approval for a one and half billion loan with the Central
Bank using the 484 Hectarea worth only a mere P290 million.
(A scandalous behest loan?...You bet! But I thought we put a stop to them after EDSA
1? Ask ERAP! All these transpired while he was president and Villar was the Speaker
of his choice and mandate!)
Through power and influence, Villar managed to have the plunder cases against him
dismissed. As for Senator Joker Arroyo, they are now staunch allies! ( Amazing what
money can do even to one who pledged "uubusin ko ang corrupt!) And for the
unsuspecting Norzagaray farmers, they still have to regain ownership of their land.
Unfortunately for them, they have been left alone to fend for themselves after being
used by the corrupt politicians who urged them to file the plunder cases.
As a side comment, allow me to add one more thing. I used to live in the Molino area
near the SM Molino Mall. Along the "Daang Hari" road overlooking SM is a huge
vacant lot whose ownership is being contested in court between 3 claimnants. I have
personally witnessed several violent confrontations arising from these conflicting
claims which have resulted with several lives lost. Guess who the third claimnant is?
(Need I still spell it out?)
You need not wonder anymore why Villar have to spend billions to contend for the
highest position in the land? With all these skeletons in Villar's closet, I wonder how
Dolphy can still afford to make claims of "walang bahid, walang malisya" in his
endorsement of Villar! Never mind Willy, he is just as wily as Villar. Besides, his
words will only have weight within the confines of his noon time show! (Oh, I almost
forgot that Dolphy is a comedianne!...and so is Willy!)

Alejandro Valverde Th Hacienda Luisita behest loan was approved in 1957 on the
condition that after 10 years, it will be distributed to the farmers. In 1967, Marcos was
in the midst of his second term. Early on, there's such thing as Land Tenancy Law the
predecessor of the land reform programs of D. Macapagal, Marcos, Cory and
Macapagal-Arroyo.

Matthew Trinidad "I was jolted from my seat when I read that Liberal Party
standard bearer Senator Benigno Aquino III said that his top priority, if elected, would
be to recover the stolen Marcos wealth. This was something that even Noynoy’s late
mother, President Cory Aquino failed to do when she installed a revolutionary
government after Edsa 1.
Recover the Marcos wealth? Give me a break. Much of the Marcos wealth was
plundered by Cory’s Kamaganak Inc.
My gulay, have we forgotten too soon that anomalous sale of the government prime
property at a corner of Union Square, San Francisco, California after the election of
Cory and before she assumed office? Many of those who went laughing all the way to
the bank are still very much around.
Have we also forgotten that when Marcos went into exile, the Cory Aquino elements
took from the Palace seven, I repeat seven, suitcases of Imelda’s jewelry to be
deposited in a doctor’s house in Dasmariñas Village, Makati? Only three suitcases
later on surfaced to be deposited to the central bank.
Reports had it that a Cory Aquino relative commuted between the Philippines and
Hong Kong to have those Imeldific jewelries reset by a Hong Kong Milton Hotel
jeweler.
Have we also forgotten that some 39 firms suspected to be owned by Kokoy
Romualdez were handed on a silver platter to the in-laws of Cory? One of these firms
was Erectors Inc., a steel fabrication business, founded by the late transportation and
communication Minister Totoy Dans. I was a director of this firm and until now I am
still wondering what happened to my investments.
Another firm, Amalgamated Motors, which had a license to import British vehicles
was among those taken over, and then used to import Simba armored vehicles for the
Armed Forces. Santa Banana, I can only guess how much money some people made
from that deal!

lobbying, agitating and creating strategies and scenarios to thwart/delay the claim of
the Philippine Government. . . even resulting to his success in picturing Marcos as 'do
no good' president.

independently background-analyses on the Hacienda Luisita saga that are worth-
reading.

Aquino’s campaign tack gets personal, calls Villar copycat
THE tone of presidential candidate Benigno Aquino III has switched from a campaign
promising hope to directly attacking his closest rival, with the Liberal Party standard-
bearer now accusing Manuel Villar Jr. of the Nacionalista Party of copying his
campaign strategy.
Aquino, who was in Cebu over the weekend, said the Villar camp had also resorted to
tying orange ribbons along the major thoroughfares, similar to Aquino’s yellow
ribbons, aside from imitating his campaign vows and advertising materials.
“Give him one month and even my hairstyle he will copy,” Aquino said in Pilipino
during a campaign sortie.
Aquino’s new attack mode nearly escaped the attention of the Manila-based media
were it not for a press statement released Monday by the Liberal Party media bureau
that began this way: “After seeing his ads and campaign materials imitated by the

 rival camp, [the] Liberal Party standard-bearer...predicts that Villar may soon imitate
even his hairstyle.”
“Still, [Aquino] will not be surprised if Villar comes out with a song similar to Tie a
Yellow Ribbon,” the Liberal statement said.
According to a political strategist, the Liberals, who have been unsettled by surveys
showing Villar is now in a statistical tie with Aquino, have taken a two-pronged
approach, pitching Aquino as the solution to the country’s woes, and attacking his
closest rival, Villar.
Former senator Sergio Osmena III is said to be the brainchild of the new Aquino
campaign strategy.
The Nacionalist camp was quick to answer Aquino’s hectoring.
“Noynoy [Aquino] is getting paranoid,” Cavite Rep. Jesus Crispin Remulla said.
“He should grow up. But we are not surprised that he is into trivial pursuits. He has
always been shallow anyway and does not talk about serious issues because he just
wants to dwell on trivial things and about the past. He should let go and move on.”
Even the son of the late strongman Ferdinand Marcos jumped into the fray, taking
exception to Aquino’s accusing President Arroyo of trying to copy the late President.
“Noynoy has a problem with the way he thinks. He cannot talk about serious issues
because he is confused, he does not know what he is doing and what to do in the
future,” Marcos said.
“He is obsessed about digging up the past. Our people want to know how to solve this
country’s problems, but Noynoy does not offer them the solution. That’s the
difference between Noynoy and Villar and that’s what makes Villar connect to the
people.
“What’s lacking in the Liberal camp is that their standard bearer has little
performance to prove that he can run this country better,” Marcos said.

No offense meant to ardent supporters of Noynoy, some of whom are my close
friends. Just a point of view of a non political observer.
NOY
In every election, the easiest choice to make is, who you would not vote for. This
year, it is profoundly difficult because for me the easiest identifiable candidate whom
I would not vote for, (aside from Erap of course, for who would vote for a convicted
plunderer) is a leading candidate, with the widest of margin in the survey, Noynoy.
He probably will be the next president and so, in my heart, I tried my best to consider
and reconsider my decision, yet I became more convinced that he is my best choice on
whom not to vote for. These are in my thoughts:
He is clean and honest
He really is unblemished, squeaky clean and immaculate.. . His record for nine years

speaks for himself. I am reminded of a friend of mine, a cocky but very articulate and
bright Solicitor General. At a certain time before he started winning his cases, his
critics had a heyday criticizing the way he handled his job. They said, he had a perfect
record of losing all cases. Thus, his record was clean and unblemished of victory.
Like this solicitor general, Noynoy has also no record of dishonesty simply because
he has no record of accomplishment at all. He was one of the prominent members of
the committee of silence. I goggled his name to find out if, except for his name, there
was anything he did that he should be proud of. I am sorry that I found nothing. It is
time he reveals what he had done in congress for nine years, plus two years in the
senate, to deserve the presidency. When he ran for Senate, he simply relied on his
family name and the endorsement of his mother. Being in the Senate with no
accomplishment will not hurt the nation except the wasted money paid to him as a
public servant. But to be president and not knowing what to do is probably as
disastrous as a corrupt president.
He comes from a good stock
A prominent columnist of the Inquirer believes that since hero’s blood runs in his
veins, he is a natural hero and would do nothing to shame the good name. The
prominent columnist also said that what we need is a good heart and correct values
and Noynoy fits to the T. Of course heritage is a plus factor but unfortunately, this is
no assurance that he too will be as upright as his parents.. We do not have to look far.
Look at his sister. She even gloated and flaunted her sexual indiscretions and gave
press interviews of her indecent acts, in spite of the fact that at that time, her dear
mother was very much alive. She fueled salacious gossip about her sexual escapades
that she grabbed the headlines for days of the local papers. Not only that. She proudly
proclaimed that she will have to do a wash over of sorts, on the personality of
Noynoy. To be fair, since Noynoy is not the sister’s keeper, he should publicly open
how he spent his several hundred million, probably billions of pesos, if cumulatively
taken together, of pork barrel. Joker and Lacson did not spend a single centavo on
their pork barrel allocations. Moreover, Noynoy has not been battle tested; we do not
know how he will react to temptation, simply because he has not been where the
action is. He can not honestly and truthfully say that he is goodness personified and
all others are evil just because he is the son of Cory. It is sheer arrogance and
hypocrisy to make such claim.
He comes unprepared
Before the death of former Pres Cory, nobody considered him of presidential caliber,
not even for vice president. His party mates knew of his capabilities and did not even
look at his direction when they then considered their standard bearer. Noynoy himself,
conscious of his own limitations, did not even dream of being one. When his mother
died and there was public mourning, all of a sudden, his party mates in spite of
knowing his limited capabilities, and taking advantage of public sentiments, pushed
him to be a candidate to the noble office of the presidency. This factual milieu clearly
shows that his popularity is solely and purely for sentimental reasons, the death of
Pres Cory. His supporters are praying to high heavens that the public sentiments on
his parents would not wane and that the public would not see through the real

Noynoy. Stripped of all sentimentality, there is nothing in his bio data that shows he is
capable of the challenges of the highest office of the land. His biodata is uninspiring,
to say the least. Aside from his public office due to his lineage, he was a sales person
of Mondragon Industries, and a member of the board of directors of a security agency
which the family owns. How in heavens name will he run the country? Pres Cory’s
landmark of achievement in her administration was her Land Reform program. Our
own 24 hectares of irrigated rice land in Kinamayan, Davao del Norte was subjected
to land reform and my Dad wanted to fight it out but I counseled him to surrender the
land as I explained to him that ultimately the entire country will benefit from this
pestering problem of unjust distribution of wealth. He understood the situation that
each of us had to make sacrifices for the common good. This is not a unique scenario
in Mindanao, then known as the Land of Promise . Little did we know that Pres Cory
distributed all other people’s landholdings except her own Hacienda Luisita. She
asked all of us to make sacrifices, except her own family. Her tenants protested and in
the ensuing protest several tenants were mowed down. The tenants were unarmed and
no casualties were suffered on the side of the soldiers trying to disperse the tenants.
Of course, Noynoy is not her mother’s keeper, nor do I intend to diminish her
mother’s role as our leader who toppled the dictatorship. But when Noynoy declared
his candidacy, he was asked point blank, what he planned to do with Hacienda
Luisita. He had no ready answer but promised to give a stand soon. Three months
passed and still no answer. Is he really prepared?
Trust
The argument goes, that since the people lost trust in the present leadership, Noynoy
comes as a white knight, enjoying the trust and confidence of the people. But why
should we trust Noynoy? Has he done something to deserve our trust?” Trust is
earned, deserved and not bestowed nor inherited. We are now bombarded with
propaganda about the goodness of Pres Cory, to the extent that Noynoy propagandists
even go to the limit of declaring her a saint, in the hope that people will also view
Noynoy as saint- like. The Liberal Party had even formulated its battle cry: “this (the
election) is a fight between good and evil”. My goodness, don’t you agree that a man
who pontificates that he represents goodness is really suspect of some loose screws
somewhere. Noynoy's handlers forgot the basic need of a responsible candidate-the
need to have an advocacy. It should be pointed out that Noynoy has no advocacy at all
in his public life. He won his senate seat solely upon his family name, like Loi
Ejercito, Pia Cayetano, Bong Revilla and the like. This is very important to those who
are very discerning. We do not know to what directions we will be going, with him as
a leader. It is fearsome to have a president who is not only unprepared and
unqualified, but also to be under the control of unknown advisers and heaven forbid,
under the tutelage of his movie star sister. It becomes more dreadful because his
popularity is seemingly sustained, thanks to the biased and twisted reporting of our
media and most especially of a very large TV network who all have their interests to
protect. The above mentioned points are correct. I am simply saying that Noynoy is
“Not Worth Voting for” because:

 1. He has no capability to govern
2. He relies solely on the name of his parents
3. He has no advocacy
4. He has no achievement on his own
5. He is pure creation of media
Sadly, only Noynoy has all these attributes among all presidential candidates.
