Amount) under Purchase Oder No.
With respect to above import of goods & provision of services in India, we hereby confirm that
Payments for Import of goods into India are not taxable in India
1. as the income does not accrue or arise in India and there is no business connection in
India in terms of Sec 9 of the Income Tax Act, 1961. Further we dont have a Permanent
Establishment in India. (Or)

In case where it is found that tax actually is deductible on the amount of remittance has not
been deducted, I/We undertake to pay the amount of tax as the case may be along with any
interest or penalties imposed within three days of raising demand by you and keep IRCON
INTERNATIONAL LIMITED fully indemnified against any action by Income Tax Department
for not deducting and depositing tax from the amount paid to us on account of supply of
(description of equipment).
We authorize you to deduct any amount payable by you to Income Tax Department on account
of non deduction of TDS from supply of goods referred above from the amount payable to us
under above mentioned purchase order or under any other contract with you.
We further permits you to encash any bank guarantee available with you either in above
mentioned purchase order or under any other contract, for the recovery of amount payable by
IRCON to Income Tax Department on account of non deduction of TDS from supply of goods
referred above if we fails to transfer funds to the credit of IRCON INTERNATIONAL LIMITED
within three days of raising demand by you.
I/we certify that the information given above is true & correct to the best of our knowledge &
belief and in the event of any false declaration; I/we undertake to indemnify IRCON
INTERNATIONAL LIMITED for any loss caused to them due to such false declaration.
