    Proceeding to review access to basic telecommunications services and other
    matters (NoC 2010-43)

    The Commission is in receipt of letters respectively dated 29 January 2010 and 1 February 2010
    from TELUS Communications Company (TELUS) and the Canadian Wireless
    Telecommunications Association (CWTA) requesting that the scope of NoC 2010-43 be
    modified. Specifically, TELUS and CWTA requested that the Commission:

    • review the forbearance framework for mobile wireless data services in a separate
    proceeding; and

    • limit the scope of any such review to the appropriateness of reapplying section 24 and
    subsection 27(2) of the Telecommunications Act only for the purpose of technologically
    neutral regulation related to Internet Traffic Management Practices.

    Bell Aliant Regional Communications, Limited Partnership, Bell Canada, NorthernTel Limited
    Partnership, Télébec société en commandite and Saskatchewan Telecommunications supported
    the requests made by TELUS and CWTA while the Public Interest Advocacy Centre and the
    Canadian Film and Television Production Association opposed the requests.

    After careful consideration of the submissions received, Commission staff is not persuaded that
    the scope of NoC 2010-43 should be modified as requested. Further, parties have the
    opportunity in their submissions on 12 April 2010 to comment on whether or not the mobile
    wireless data services forbearance framework should be modified and, if so, to what extent.
