The complainant is absent without any intimation.

In compliance with the directions given on the last date of hearing, the respondent has

submitted a duly sworn affidavit of Mrs. Kusum Bector, PIO/Punjab Public Service Commission, Patiala.
It has been stated in the affidavit that though all the information had been supplied to the complainant,
however, the information relating to marks awarded by each member of Interview Board could not be
supplied as the same is not available in the sealed envelope containing the interview record. It has further
been stated that the respondent has searched the above said record from the Strong Room. However,
award-sheet of each member is not available in the said envelope. The respondent also stated that after
an inquiry, action would be taken against the persons found responsible for disappearance of the award
sheets. As regards, the information relating to Shri Sushil Kumar and Shri Sarabjit Singh is concerned, it
has been pleaded that the original record was sent to the Government in the Department of Home Affairs
and Justice, where it is still pending.

ORDER
On the last date of hearing on 25.2.2011, none had appeared on behalf of
the complainant. The respondent had submitted that the information had been sent to
the complainant vide No.2385 dated 8.7.2010, a photocopy of which was placed on
record.

confirm, if he has received the information to his satisfaction.

ORDER
On the last date of hearing, the respondent had pleaded that the reply was sent
to the information-seeker stating that record pertaining to roll numbers mentioned in the order
dated 25.2.2011 had been destroyed. The respondent was, therefore, directed to place on
record a copy of rules relating to destructions of record and also a copy of the order passed by
the Competent Authority for destruction of record being sought by the information-seeker.

The respondent has placed on record letter No. P&G/2010/E-15/6487 dated

9.3.2011 received in this Commission vide diary No.4618 dated 18.3.2011 vide which it has
been confirmed by the PIO that the relevant record was destroyed in accordance with the Rules.
Copies of the office-notings indicating the orders of the competent authority to destroy the
record have also been placed on record.

Perusal of the enclosures with the letter dated 9.3.2011 shows that as per the

instruction for weeding out of record of PPSCs, answer sheets of candidates, clippings of
scripts, original paper-sets and list of secret roll number etc. are to be kept only for one year.

Since the complainant is absent, to enable him to file his rejoinder, the case is

adjourned to 6.4.2011 at 10.30 A.M. It is made clear that incase the complainant fails to avail of
this opportunity the case will be decided exparte.

that the Athletic Association is purely an amateur non-government body and that it does
not receive any assistance from the State Government. It has further been pleaded that
on every date of hearing in the State Information Commission, they have to spend
nearly Rs.2000/- per visit and compensation should be awarded to the respondent
Association for the harassment and financial loss caused by the complainant.

ORDER
On the last date of hearing on 1.3.2011, the information-seeker was absent. The
respondent had submitted that in response to her application for information dated 29.3.2010
addressed to the PIO of the University, reply was sent to the information-seeker vide
No.PTU/PIO/21388 dated 30.11.2010 and thereafter a further clarification was also given vide
No.RTI/PIO/22022 dated 14.12.2010. The respondent had also placed on record, copies of
these communications addressed to the information-seeker, on the last date of hearing on
1.3.2010.

However, on 1.3.2010, the case was adjourned to 18.3.2011 to enable the

appellant to confirm if he is satisfied with the information furnished to her. The appellant,
however, is again absent today without any intimation.

In view of the fact that the information has been furnished and the University has

been constantly responding to the appellant, who has chosen to be absent on two successive
dates without any intimation, despite of the fact that the due and adequate notice was given to
the appellant, the case is closed.

ORDER
The respondent submits that the present appellant had applied for information on
18.5.2010 and the desired Result Copy was sent to him on 7.6.2010. An appeal was filed
before the 1st Appellate Authority on 9.6.2010 pointing out certain deficiencies in the information.
The 1st Appellate Authority directed the PIO on 23.6.2010 to remove the deficiencies.

The PIO did not remove the deficiencies and the information-seeker moved the

State Information Commission and now the information has been furnished by the University
vide No.PTU/PIO/33 dated 17.3.2011 on all the nine issues raised by the information-seeker.
3.

The appellate seeks an adjournment to peruse the information now furnished

vide letter dated 17.3.2011. Time is allowed. To come up on 06.04.2011 at 10.30 A.M.
4.

The respondent is also called upon to explain the delay in furnishing of the

information.
