4 date of the enactment of this Act, the Secretary, in con5 sultation with the Secretary of Labor, shall issue regula6 tions that establish the necessary procedures for proc7 essing visa petitions for H2B nonimmigrants in accord8 ance with the provisions of this Act and the amendments
9 made by this Act. The Secretary shall have exclusive au10 thority, which may not be delegated outside the Depart11 ment of Homeland Security, to issue rules and final deter12 minations with respect to the visa program for H2B non13 immigrants.
