HUERTAS wwwhariford.gov Fire Chlef/Emergency ‘Management Director PEDRO E, SEGARRA MAYOR Investigation Summary Background: Captain Thomas Dalton (E16/D) alleges that while operating at 122 West Morningside Street (NFIRS report 15-0226056), on August 14, 2015, he was assaulted by Lieutenant Michael Patterson (E14/C). The following personnel who were on scenes submitted fire services regarding the alleged incident: Engine 16 - Captain Thomas Dalton, Pump Operator Domingo Delgado, Firefighter Stefan Napoleon and Firefighter Riqui Sanchez (E1/C) Ladder 4 ~ Lieutenant Michael Patterson (E14/C), Ladder Driver Daniel Flynn (L4/C), Firefighter Jason Barco and Firefighter Rafael Sanchez (L4/C) Fire Prevention - Lieutenant Martin Jones ‘The following personnel who responded hased on the request of Captain Dalton also submitted fire services: District 1 - Deputy Chief Clifton Cooper (D1/C) District 2 - Deputy Chief Peter Towey Response: Interviews were conducted on September 2", 3%, and 11". During this time all the aforementioned personnel were interviewed. Present for HFFA, IAFF Local 760, were President Vincent Fusco and Vice-President Rocco Fierravanti. Findings: ‘The following determinations were made: The interaction between Captain Dalton and Lieutenant Patterson lasted between thirty seconds and two minutes. Captain Dalton and Lieutenant Patterson were separated by six Inches to two feet at their closest. SEGARRA ‘MAYOR Captain Dalton asserts that Lieutenant Patterson “charged (him) in an extremely aggressive manner” which Lieutenant Patterson refutes. Interviews with personnel were inconclusive with Pump Operator Delgado and Ladder Driver Flynn describing Lieutenant Patterson’s approach as aggressive” while the balance of these interviewed did not see the Lieutenant's approach or did not describe it as ageressive. In his interview, Captain Dalton stated he showed Deputy Chief Towey the manner in which the Lieutenant charged him and the demonstration “startled” the Chief. Deputy Chief Towey did have a strong secollection of the “charge” being demonstrated and denies any demonstration started him. Captain Dalton asserts that Lieutenant Patterson made threatening statements towards him which Lieutenant Patterson refutes. No interviewed personnel heard any threats directed towards Captain Dalton, There was a finding that profanity had been used by Lieutenant Patterson which he did net dispute. Captain Dalton asserts that Lieutenant Patterson had to be physically restrained. There was a finding that Firefighters Jason Barco and Rafael Sanchez and later Pump Operator Delgado, all interceded and placed themselves between the Captain and Lieutenant. Captain Dalton asserts that, “Lieutenant Patterson repeatedly tried ‘throwing punches at me while restrained at a very close proximity, landing one blow in the center of my chest with his right hand.” During his interview, Captain Dalton stated Lieutenant Patterson contacted him with two fingers on his chest. Lieutenant Patterson denfes these accusations but reports he was pointing during the exchange with Captain Dalton. The witnesses were directly asked if Lieutenant Patterson struck, threw 2 punch, made a fist or otherwise physically contacted Captain Datton. All witnesses confirmed they did not see the Lleutenant contact the Captain in any manner. Firefighter Barco, the closest party to Lieutenant Patterson, stated, ‘If he (Patterson) hit Dalton he would have to go through me.” Ladder Driver Flynn stated he felt the Lieutenant “must have” made contact, but admitted he did not witness it, Ladder Driver Flynn Page 2 of 4 CITY OF HARTFORD HARTFORD FIRE DEPARTMENT 253 High Street Hartford, Connecticut 06103 Pe (B60) 757-4500 F: (860} 722-8205 CARLOS M, HUERTAS wnww.hartford.gov Fire Chief /Emergency ‘Management Director PEDRO E. SEGARRA MAYOR confirmed he was viewing the incident directly in line with Captain Dalton and Lieutenant paterson, the least optimal viewing angle. Captain Dalton alleges he informed Deputy Chief Towey that, “He (Patterson) put his fucking hands on me.” Deputy Chiefs Towey and Cooper oth state that during their conversations with Captain Datton he never stated he had been struck by Lieutenant Patterson. The Deputy Chiefs both stated that had Captain Dalton stated he had been struck by the Lieutenant, they would have reported the claim to interim Assistant Chief Brady immediately. Lieutenant Patterson asserts that Captain Dalton made disparaging comments regarding his leadership while personnel were inside the structure, Those members who operated in the structure report that Captain did make comments regarding the leadership on C tour. When asked to report what occurred in the structure, Captain Dalton did not mention making any comments regarding the leadership of € tour. Lieutenant Patterson reports he had been cleared by Fire Prevention Lieutenant Martin Jones. Lieutenant. Jones reported he had informed Lieutenant Patterson he was “all set.” Captain Dalton asserts that Lieutenant Patterson was not dismissed by himself. spcnenent, Puteemon sects that, Caples Selim Ba cociesey * member of his crew, Firefighter Julian Perez (E14/C), to make disparaging comments regarding the Lieutenant’s performance at @ July 2015 fire. Firefighter Perez substantiated the Lieutenant’s account reporting the Captain Dalton had been very assertive in his assumptions and had advised Firefighter Perez not to “sugarcoat” the fact the Lieutenant had “bailed out” on his crew during, the fire. When directly questioned regarding this matter, Captain Datton denied he made any comments to Firefighter Perez regarding the Lieutenant. Lieutenant Patterson asserted that Captain Dalton had confronted a member of his crew, Firefighter Edwin Carrillo (E14/C), who was working overtime ‘at Engine 16, D tour, during July 2015. Huertas Chief of Department Sir: | am writing you this correspondence to document a personnel conflict issue which occurred on Friday, August 14, 2015. District 2 (D/C Towey) made notification to me that Capt. Thomas Dalton £-16/D reported that he was involved in a heated exchange with Lt. Michael Patterson £14/C who was working OT on L-4 while at incident #15- 226-056 at 122 West Morningside street. We agreed to first go to E-16 quarters to get Capt. Dalton account of events then we would proceed to E-14 to get Lt. Patterson account of events. Then, we would make notification to Car 2 (Interim Assistant Chief Brady) with our findings. Capt. Dalton stated that L-4 tried to clear incident scene without being dismissed by him. He stated to Lt. Patterson that he was not dismissed. He stated that PO Delgado repeated to Lt. Patterson that he was not dismissed. Lt. Patterson exited apparatus and begin to address him with profanity laced language and was very aggressive. He was restrained from getting closer to him by L-4 crew members. Capt. Dalton stated that Lt. Patterson actions were a violation of the workplace violence policy. Capt. Dalton was asked if he would be able to work with Lt. Patterson if another assignment came in during tour. He stated that he would be able to. He would defend himself if the need arose. He was instructed to write a detailed Fire Service in regards to this incident and the other members on E-16 are required to do the same. Lt. Patterson stated that he spoke with FMO M. Jones upon his arrival and detailed what occurred on scene. Then, Lt. Patterson stated that he told his driver (LD Daniel Flynn) who was talking to Capt. Dalton that they were leaving. Capt. Dalton stated that Flynn did not have to go because L-4 was not dismissed. Lt. Patterson stated that he got out of his apparatus and confronted Capt. Dalton utilizing some foul language. He stated that his crew members got between him and Capt. Dalton. He returned to his apparatus and L-4 left the scene. He stated that Capt. Dalton was harassing him and that it went beyond this specific incident. Also, he was harassing his crew. Lt. Patterson stated that he had enough that why he confronted him. Lt. Patterson was asked if he would be able to work with Capt. Dalton if another assignment came in during tour. He stated that he would be able to. He was instructed to write a detailed Fire Service in regards to this incident and the other members on L-4 are required to do the same. Outside E-14 quarters, | made notification by phone to Car 2 with D/c Towey next to me. | explained to him that there was a verbal altercation between Capt. Dalton and Lt. Patterson ai an incident scene. I told him that D1 & D2 spoke with both parties involved and got their version of altercation. Then, | told Car 2 that | believed that both individuals would be able to finish tour without any further incident. He stated that all members on L-4 and E-16 are to write Fire Service in regards to what they observed. He would make contact with FMO Lt. Jones and tell him to do the same. Dalton (E16/D), Please see aitached, Respectfully submitted, Deputy Chief James McLoughlin District2 | Tour A DEPARTMENT OF FIRE SERVICE QUARTERS OF ENGINE XVI HARTFORD, CONNECTICUT sir, This isto inform the office of the Chief of the events that transpised at incident # 15-226-056, time 18:07, location 122 Momingside (West). Engine Company 16 arrived on scene to a reported structure fire, time: 18:10:57, secured water source (106 West Morningside), gave size up, took command, investigated, found food on stove with the accompanying harsh acrid smoke, 16 metered environment and started the process of horizontal ventilation. Dalton radioed Disteict 2 CLowey), what assets were needed to stabilize the situation. Engine 16 thermal imaged area and called for smoke ejectors from first arriving Ladder Company (Ladder 4). Smoke ejectors were deployed initially on floor 1 and then upon further investigation floor 2 (smoke ejectors were deployed on the interior by Firefighter Barco and Firefighter Sanchez). District 2 (Towey) cleared himself and the remainder ofthe assignment leaving Engine 16 and Ladder 4 (Engine 16 in command). Dalton, Barco and Sanchez coiled up power cord of floor 2 ejector outside of building surrounded by the remainder of personnel assigned to both apparatus. Lt, Patterson said to his Ladder Driver Flynn and crew “We're outta here” and I replied as the ranking officer atthe scene “you have not been released yet". Lt. Patterson climbed into the officer's seat of Ladder 4 and motioned to Ladder Drive: Flynn to get into the apparatus. I (Dalton) informed Lt. Patterson, then Ladder Driver Fiynn that they were not released yet due to the fact that | didn’t know what assistance the fie inspector Jones may have needed to complete his investigation at that time. Ladder Driver Flynn proceeded to secure the wheel chocks on the driver side of Ladder 4, Ladder Driver Flynn asked me (Dalton) after securing the wheel chocks “are we good to go" I replied “I will let you know when you're released”. Flynn jumped into the cab of Ladder 4, released the er brakes and started to roll away (Chave no direct knowledge of the conversation that took place inthe cab of Ladder 4 at that time). My position is now 25° to 30° from the street by the front door (A side) of the building (122 Morningside West). stated again “Ladder 4 you are not released, I'm going to put this in my report”. Ladder 4 came to an abrupt stop, Lt Patterson threw the cab door open and charged in an extremely aggressive manner toward me (Dalton), verbally exploded at me and I quote “Dalton you're @ punk ass bitch, you'll get what's coming to you, I'l make sure of it mother fucker! I'm going to fuck you up! Why you fuckin’ with me?” All the while pointing his fingers at me in a hostile and confrontational manner. I did not move or say anything to escalate the situation. (This event was witnessed by: PO Delgado, LD Flynn, Firefighter Napoleon, Firefighter Sanchez Engine I ot, Firefighter Barco, Firefighter Sanchez of Ladder 4 and numerous civilians.) Lt. Paterson had to be PHYSICALLY restrained bby members of his crew (Barco, Sanchez) all the while still making threats of bodily harm, against me and screaming extremely offensive comments et me. Lt. Patterson repeated tried throwing punches at me while restrained at a very close proximity, landing one blow in the center of my chest with his right hand. Thave no first hand knowledge of what Fire Inspector Jones was doing during the aforementioned ordeal. At this time Lt Patterson forcefully restrained and escorted back to the cab of Ladder 4 by the members of his erew. He again proceeded to exit the scene without being released by the person left in charge by district 2 (Towey), Capt. Dalton of Engine 16. I proceeded to radio District 2 thet I needed him back at the scene, he asked, “why is there more fire?" I said, "No, there is a personality conflict or problem” I don't remember exactly what I said. I then said I wll call ‘you in your office when return to quarters” Engine 16 cleared the scene at time stamp: 18:38:47. I clearly stated Engine 16 is 10-8 release Ladder 4, Engine 16 is clear 531. Lt. Patterson had clearly self discharged his company before being given permission by the ranking officer time stamp: 18:34:53, (Crews on seene: Engine 16: Dalton, Delgado, Napoleon, Sanchez Ladder 4: Patterson, Flynn, Sanchez, Barco FMO: Jones Back at quarters that same evening, I notified chief Towey what events had transpired. Chiefs ‘Towey end Cooper arived in my office at 19:07 hours and I explained to them in exacting detail ‘the events that had taken place at 122 Momingside West. They expressed a collective concem if Thad a problem finishing my tour of duty. Texplained to both Chiefs that [had an obligation to ‘my crew to finish my tour of duty and there would be no problem on my end if Lt. Patterson respected the boundaries of our working relationship as superior and subordinate. And more {importantly that he did not try to physically or verbally attack me again at another incident in full view of the public. In closing I take witnessed threats against my safety and life very seriously as Tknow the City of Hartford does as laid forth in the City of Hartford Policy Memorandum Workplace Violence Policy No. 007, dated October 23, 2013 (see attached). As a reasonable person I believe Li. Petterson has violated this policy in an extreme and profound manner. His intent was bodily harm towards me. ‘My concern is when an individual such as Lt. Patterson states “you'll get what’s coming to you, Til make sure of it mother fucker! I'm going to fuck you up!” what would any reasonable individual conclude noting Lt. Patterson had got on L~4 and was leaving the scene and I flagged him down and spoke to him at which time I did not ask what happened, the discussing was about airing the differences at a fire incident scene. Fire Service Subject: Personnel Incident at 122 West Morningsi fe St ine 226-058) Department of Fire Service Quarters of District 2 Hartford, CT August 14, 2015 Carlos M Huertas Chief of Department RE: Personnel incident at 122 West Morningside St (Ine 226-058) Dear Sir: On this date, at 1807 hours the assignment responded to a reported stove fire at 122 West Morningside St (Inc # 226- 056). £-16 arrived and reported a stove fire with slight extension to the cabinets. Fire was extinguished and E-16 and L- 4held for ventilation and to await FMIO. The remainder of the assignment was dismissed. Dist 2 returned to quarters. A short time later E-16 called Dist Two on the Fire Dispatch frequency. Capt Dalton stated that “He may need D-2 back out there.” When asking if he required the assignment out there or ust Dist 2, he stated that he would call on return to quarters regarding a personnel issue. At this point I contacted Dist 1 {D/C Cooper to advise that we may be ‘required to address a personnel issue and that | would contact Dist 1 when lhad mare information, Captain Dalton contacted me on the D-2 phone on his return to quarters. He stated that while still at 122 West Morningside St Lt Patterson had “thrown a fit and was hostile towards him.” | advised Capt Dalton that Dist 1 and Dist 2 would be heading 10 E-16 regarding the incident. Dist 1 was advised of the same, (On arrival at the quarters of Fngine 16, D/C Cooper and myself proceeded to the Engine 16 officer's room to discuss the incident with Capt Dalton. Capt Dalton stated that L-4 was operating at the incident at 122 West Morningside St. Capt Dalton stated that Firefighters working on L-4 set up a fan on floor one and He praceeded to floor 2to check for required ventilation. The second fan from L-4 was set up on floor 2. After venting was complete the fans were removed to the outside to get packed up. Capt Dalton stated that he advised FF R Sanchez who was colling the cord for the fan to censure that Ithad big loops. Around this time, Capt Dalton stated that It Patterson sald "We are out of here.” At tis point Capt Dalton stated that he told L/D Flynn that L-4 was not yet released and that L/D Flynn stated the same to Lt Patterson. Capt Dalton stated he then was heading back into the building and that P/O Delgado reiterated that L-4 was not released. At this point Capt Dalton stated that Lt Patterson “Charged out of the cab in an aggressive manner.” Capt Dalton stated that Lt. Patterson was charging toward him stating “ Your are nothing but a punk ass bitch, | am going to fuck you up.” Capt Dalton stated that the crew of L-4 hed to physically restrain him. At this point He stated that L-4 got ‘on the piece and left the scene “before being released’. At this point E-16 notified dispatch the I-4 was cleared and E- 16 cleared the scene. Capt Dalton reported that L-4 stopped beyond the scene and appeared to have a conversation with FMO LT Jones. Capt Dalton stated that he felt that this was a violation of the workplace violence policy and that he had been charged at in an aggressive manner. We advised Capt Dalton that we were going the meet with Lt Patterson at this time and that he would need to complete. fire service docurnenting the incident. We obtained assurances that Capt Dalton would be able to work the remainder of the shift without concern of future incident, raged atthe quarters of Ladder 4, 0/¢ Cooper and myself proceeded tothe Ladder 4 officers room to discus the ‘Roent with Ut. Huertas Chief of Department Sir, This fire service report is to give you my perspective of what happened on August 14" 2015 (Incident? 15- 0226056) between Lieutenant Paiterson end Captain Dalton, After the incident was under control and having put our equipment back onto the piece, I went over to the roof Position to remove my gear in anticipation of clearing the scene. While in the back of the cab T begin to hear smplified (but inaudible from my jump seat) conversation coming from up front by Lt Patterson. As the truck starts to pull away ftom the house, it abruptly stops and Lt Patterson hops out, makes a beeline towards Capt Dalton in an animated fashion. It’s at this time that Rafael Sanchez and myself exit the truck, run around to ‘Where the 2 officers were and begin to pull back Lt Patterson in hopes of de-escalating the situation. Lt Patterson was clearly agitated by what transpired between him and Captain Dalton as it seemed it wouldve ramped up had I not reminded him that we were on scene and in public. Lt Patterson then regained composure, centered the truck and we proceeded back to quarters. As previously stated I am unaware as to what was initially said between the 2 in order to cause this but this is my interpretation of the following events. L-4 reported to smoke in the Building. Throughout the incident Lt. M. Patterson was in the rear of the building. While L-4 was clearing all equipment from the scene and was ready to clear the scene Lt. M. Patterson was telling his crew members to lets go and clear the call. While I was in the back of the apparatus | heard the Lt. M. Patterson saying again “let’s go” out the front right window, | couldn’t see too who, but it appears it was directed to L/D D. Flynn. White L-4 was started to drive away with all member in the apparatus, I can see Cpt. T. Dalton saying something to Lt. M. Patterson but couldn’t hear what was said because of the engine of the apparatus was revving up. Lt. M. Patterson said to L/D Flynn to stop L-4 and at that moment | see Lt. M. Patterson walk towards Cpt. T. Dalton .Both Officers were exchanging word in front of the incident house driveway. At this time I got in Between both of them an proceeded to walk with Lt. M. I, PO Delgado was standing by the apparatus waiting for the FMO with my other crew members when I noticed ladder company 4 was preparing to leave when Captain Dalton said “You're not relieved yet” so they continued forward. Capt said “T'll put that in my report” when Lt Patterson said something inaudible and Captain Dalton said “Excuse me?” At that moment Lt Patterson charged out of the Ladder 4 towards the Captain in an aggressive manner yelling obscenities and the crew members from ladder 4 attempted to physically restrain Lt Patterson who broke from their grasp. AS RAFAEL WAS PREPPING THE EJECTOR, CAPTAIN DALTON CONTINUED TO IMPOSE HIS WILL ON HOW THE EQUIPMENT SHOULD BE STORED ON LADDER 4.1 TOLD RAFAEL TO DISREGARD WHAT DALTON WAS SAYING AND TO CONTINUE TO WRAP IT AS HE WAS TRAINED. AT THIS TIME FIRE MARSHAL, MARTIN JONES ARRIVED ON SCENE. I WALKED OVER TO HIM, AND EXPLAINED WHAT WE HAD ON ARRIVAL, WHAT WE DID, AND WHERE THE KITCHEN WAS LOCATED. MARTIN JONES TOLD ME WE WERE ALL SET. ‘THEREFORE, I PROCEEDED TO BOARD THE APPARATUS AND CLEAR THE SCENE. RAFAEL SANCHEZ AND BARCO WERE ALREADY ON THE APPARATUS. LADDER DRIVER, DAN FLYNN, WAS ON THE STREET TALKING TO THE CREW OF ENGINE 16. 1 TOLD FLYNN “LET’S GO.” CAPTAIN DALTON ASKED FLYNN TO SHOW HIM SOMETHING ON HIS CELL PHONE, AND STATED, “I HAVEN'T DISMISSED YOU YET.” I TOLD FLYNN FOR A SECOND ‘TIME TO GET ON THE APPARATUS, AND HE COMPLIED. AS WE WERE PULLING OFF, CAPTAIN DALTON BEGAN TALKING. I TOLD FLYNN TO STOP, AND I GOT OFF TO APPROACH HIM AND WE EXCHANGED HARSH WORDS, BECAUSE OF PRIOR HARRASSING INTERACTIONS STARTED BY CAPTAIN DALTON. AT THAT TIME BARCO AND RAFAEL SANCHEZ STEPPED IN BETWEEN US. BARCO, RAFAEL AND I WENT BACK TO THE APPARATUS TO. RETURN TO THE STATION. AS ABIT OF BACKGROUND INFORMATION: CAPTAIN DALTON HASTOLD SEVERAL PEOPLE THROUGHOUT THE DEPARTMENT, THAT ON JULY 25, 2015 [ BAILED OUT OF A STRUCTURE FIRE LEAVING MY CREW BEHIND BECAUSE I PANICKED. FIRSTLY, THAT ALLEGATION IS FALSE. SECONDLY, A RUMOR SUCH AS THAT HAS THE POTENTIAL TO CREATE AN ENVIRONMENT OF MISTRUST AND HOSTILITY IN A GROUP THAT RELIES ON TEAMWORK TO EFFECTIVELY ENSURE THE SAFETY OF THE PUBLIC, AND THE SAFETY OF THE FIREFIGTHERS.THIS WAS NOT ‘THE FIRST TIME THAT I HAD RECEIVED INFORMATION THAT DALTON HAD BEEN SPREADING FALSE INFORMATION ABOUT ME AND MY SKILLS AS A FIREFIGHTER. AFTER HAVING RECEIVED THE INFORMATION ABOUT DALTON SPREADING THIS LASTRUMOR, I MADE IT A POINT TO REFRAIN FROM INTERRACTING WITH HIM WHILE AT THE SCENE. UNFORTUNATELY, DALTON’S QUESTIONING OF MY CREW, AND INSULTING MY LEADERSIIP, MADE IT IMPOSSIBLE FOR ME TO NOT HAVE ANY TYPE OF INTERACTION WITH HIM. DALTON HAS HARRASSED MYSELF, AND SEVERAL MEMBERS OF THE DEPARTMENT ON NUMEROUS OCCASIONS. HIS TACTICS HAVE GONE BEYOND VERBAL, AND ESCALATED TO BECOMING PHYSICAL AT TIMES. THE INCIDENTS OF HIS DISRUPTIVE BEHAVIOR HAVE CONTINUED DESPITE EFFORTS TO CORRECT IT. HIS BEHAVIOR HAS MADE IT DIFFICULT FOR C TOUR CREW MEMBERS TO WORK AT ENGINE 16. [HAVE CONSISTENTLY DEALT WITH WHAT I PERCEIVE TO BE HARRASSMENT FROM THOMAS DALTON SINCE THE INCEPTION OF MY CAREER WITH THE DEPARTMENT. I HAVE MADE IT A POINT TO NOT INTERACT WITH DALTON OUTSIDE OF WHAT WAS NECESSARY FOR THE SCOPE OF WORK.
