Section 14141 Dear Section Chi Ihave been retained by the father of Darrius Stewart, Henry Williams, to assist him in obtaining justice for the violation of his son’s civil rights on July 17, 2015 when he was shot twice by Officer Connor Schilling of the Memphis Police Department while ‘unarmed and posing no threat to the officer’s life. Please accept this letter as my client's official complaint against Officer Schilling and the City of Memphis, Tennessee for violations of 18 U.S.C. Section 242 and 42 U.S.C. Section 14141, respectively. On July 17, 2015 during the evening hours Darrius Stewart was a back seat passenger in a vehicle stopped by Officer Schilling for a non-working headlight. Darrius was not a suspect at the time of the initial stop but the officer asked for Mr. Stewart's ID. Mr. Stewart did not have his ID on him so the officer placed Mr. Stewart in the backseat of his patrol car, without handcuffs, while he ran a check on Stewart’s name which allegedly showed two outstanding, out of state warrants. Schilling alleges that he went to arrest Mr. Stewart and place him in handcuffs and that Stewart became combative and he shot him twice. There are several eyewitnesses to the scuffle and the shooting and witnesses say Mr. Stewart was on his knees and had surrendered before the officer shot him twice. Nevertheless it was announced last week by the local prosecutor that the grand jury failed to indict Officer Schilling for voluntary manslaughter as she had recommended, As for the City of Memphis and its police department, please investigate both for engaging in a pattem or practice of depriving persons of their constitutionally protected tights by utilizing excessive force, discriminatory harassment, racial profiling, making false arrests, and unlawful stops, searches, and seizures. There have been over 24 suspicious killings of civilians by officers of the Memphis Police Department since 2009 and not one officer has been indicted for killing unarmed, largely black young men. 306 Branscome Drive # PO.
