NOTICE OF PUBLIC HEARING OF PROPOSED LOCAL LAW No.

Legal Notice is hereby given, that at a Town Board Meeting to beheld on Novemb
er 16,
2015, at 7:00 pm, at the Town of Monroe Arts and Civic Center, 34 Millpon
d Parkway, Monroe,
NY 10950, 3rd floor, the Town Board of the Town of Monroe will consider
a proposal entitled
"Local Law No. 3 of 2015, A local law amending Chapter 8 of the Town Code of
the Town of
Monroe." The text of the proposed law is as follows:
Be it Enacted by the Town Board of the Town of Monroe as follows:
Chapter 8, of the Town Code of the Town of Monroe, State of New York is hereby
amended by
inserting the following new Article VI entitled "Police Constables" into Chapter 8
and adding the

Article VI
8-27 OFFICE ESTABLISHED
There is hereby established the Department of Public Safety for the Town of Monroe

8-28 APPOINTMENT
The Department of Pubiic Safety of the Town of Monroe shall be managed by a
Captain who
shall be appointed by a resolution of the Town Board and who shall serve at the
pleasure of the
Town Board. The Captain shall be a Peace Officer as that term is defined under New
York State
Pena] Law 2.10 (1) and shall have the power and authority to appoint Police
Constables as
members of the Department of Public Safety of the Town of Monroe. The Captain and
Police
Constables shall serve without compensation unless and to the extent authorized by
express
resolution of the Town Board.
8-29 QUALIFICATIONS
A Police Constable shall possess the following qualifications:
A. Sha11 be a citizen of the United States.
B. Shall be over the age of 21 years old.
C. Shall be of good moral character
8-30 PEACE OFFICER STATUS
Any Police Constable appointed under the authority of this chapter shall be a "Peace
Officer" as
that term is defined in Criminal Procedure Law 210 (1) and shall bedeemed apart-tim
e
employee unless the Town Board, by resolution, specifically provides otherwise.
8-31 POWERS AND DUTIES

Police Constables appointed under the authority of this chapter shall have the authority of Peace
Officers as defined in the Criminal Procedure Law and shall provide security at the Town Court,
Town Buildings and at Official Town meetings, and shall provide security at such other events
and places in the Town of Monroe as deemed appropriate by the Captain and the Town
Supervisor.
8-32 SUPERVISION OF POLICE CONSTABLES
Police Constables shall be under the direction and supervision of the Captain of the Department
of Public Safety for the Town of Monroe unless otherwise resolved by the Town Board.
8-33 USE OF WEAFONS

Police Constables may use and possess only such weapons as are permitted to be used and
possessed by Peace Officers pursuant to the laws of the State of New York and such weapons
may be used only as permitted by the laws of the State of New York. The Captain may
promulgate such rules and regulations as Che Captain deems appropriate in regulating the
possession and use of weapons.
8-34 WHEN EFFECTIVE; CONTINUATION OF PREVIOUSLY APPOINTED
CONSTABLES
This chapter shall take effect immediately upon the filing of certified copies thereof with the
Office of the Secretary of State in accordance with the Municipal Home Rule Law and this
chapter sha11 not affect any Constables as defined in Article III of this chapter and who shall
continue to have the powers and duties pertaining to their civil functions as defined in Article III,
herein. This chapter relates only to Police Constables and nothing contained herein shall be
deemed to grant any additional powers or duties to a Constable defined in Article III of this
chapter.
