ANALYST'S NOTE: House Bill 017 deals with a new type of


vehicle called an "autocycle." This bill would define such a
vehicle as "a three (3) wheeled motorcycle on which the driver
and passengers ride in a completely enclosed, tandem seating
area that is equipped with air bag protection, a roll cage, safety
belts for each occupant and antilock brakes and that is designed
to be controlled with a steering wheel and pedals." "a motor
vehicle designed to travel on not more than three (3) wheels in contact with the ground that has a
steering wheel and seating that does not require the operator to straddle or sit astride."
The definition used in the amended version of this bill is broader and allows the bill to apply not only to
an Elio (pictured above) but also to other vehicles which may not have the exact same features. An even
broader definition would be preferable. It is also a bit odd that an autocycle must be "completely
enclosed" in order to allow for minors not to be required to wear helmets as cars do not have the same
requirements. Convertibles are not "completely enclosed," yet helmets are not required.

Point No. 3 Does it give government any new, additional, or expanded power to prohibit, restrict, or
regulate activities in the free market? Conversely, does it eliminate or reduce government intervention in
the market?
ANALYSIS: House Bill 017 creates Section 49-2448, Idaho Code, and modifies other sections to
clarify that an autocycle will be registered and titled as a motorcycle, but that it will not require
a motorcycle endorsement to drive. A standard driver's license will be sufficient. This prevents
prospective drivers from having to undergo additional training or incurring additional costs to
drive the car-like autocycle. The bill also clarifies that the existing motorcycle helmet
requirements for minors contained in Idaho code will not apply to completely enclosed
autocycles. (+1)
