    Collateral estoppel, or issue preclusion, bars re-litigation of an issue if (1) the issue is identical to one in a prior action, (2) the issue was actually litigated previously, and (3) the issue was necessarily decided in the prior action by a final judgment. For collateral estoppel to apply, the party against whom estoppel is asserted must have been a party or in privity with a party in the prior action and must have had a full and fair opportunity to litigate the issue. When assessing whether to apply collateral estoppel, courts will examine factors such as availability of joinder, jurisdiction, notice, the ability to request a jury trial, and the presence of missing evidence
