To the Planning Commission:
In response to the rejection of our application, #$D8675309, I would like to kindly ask for your
reconsideration. I understand your skepticism considering the scope of our project, however, the
logistics and profitability from JAV Enterprises existing investments illustrates that our
proposed restaurant and nightclub would be an invaluable asset to the community. Therefore, I
would like to address your concerns from an optimistic viewpoint:
JAV Enterprises currently owns three successful restaurants and nightclubs in Orange County.
Our existing establishments gross profit exceeds $5MM annually. As a result, our aggregate tax
liability significantly helps the city, while the aesthetic appeal of our investments beautifies the
area while creating tourism. The zoning of our existing entities, along with our proposed
establishment, is in an area where nightlife is effervescent. Having these establishments in a
central perimeter localizes patrons to an area that is already managed by police enforcement. The
fact that remediation presence is sufficient confirms that no additional tax dollars would be spent
to regulate our new establishment.
In response to your concern about alcohol licensing, I would like to inform you that we have a
trustworthy reputation with Californias Alcohol Beverage Control Department. We hold many
alcohol licenses and have never violated our businesses privileges. Upon your request, I would
be more than happy to set up a conference call between you and I and our longstanding contact at
the ABC.
Regarding traffic, our proposed establishments operating hours are from 9pm 2am; similar to
existing local nightlife hospitality businesses. Being the most desolate time to conduct business,
these hours pose no threat to Orange County citizens. Also, with the advancement of technology,

times have changed and one cannot disagree that the more recent and available transportation
applications via smartphones have revolutionized the responsibility of individuals consuming
alcohol in a nightlife environment for the better. As research shows, DUI rates have dramatically
decreased due to the increased consequences and availability to affordable, safe rides. These
studies prove that reckless and excessive driving has dissimilated traffic due to the awareness
that driving under the influence is both costly and unnecessary.
With that said, on behalf of JAV Enterprises, I would greatly appreciate your optimism regarding
the analysis of our careful and creative perspective. Our vision was derived from a good place in
all of our hearts. With your reconsideration and ultimate approval, Orange County can
implement our vision to synergize the city, its local and visiting people to make the community a
more beautiful and profitable place.
It would be in the citys best interest and ours to make sure that this project is presented in its
