MOTION

I HEREBY MOVE that the Council ADOPT the following recommendations of the City
Attorney in order to effect settlement in the case entitled Bruce Lisker v. City of Los Angeles,
United States District Court Case No. CV09-09374 ODW (AJWx) (this matter involves a lawsuit
alleging a wrongful conviction), SUBJECT TO THE APPROVAL OF THE MAYOR:

1. AUTHORIZE the City Attorney to pay a total of $7,600,000 in settlement of the above-
entitled matter from the City Attorney Fund No. 100, Department 59, Account 009780
Liability Payouts.

2. AUTHORIZE the City Attorney to draw a demand thereon and made payable to: Nasatir,
Hirsch, Podberesky & Khero Client Trust Account. (Should Plaintiff request payment of
some portion of the settlement amount into a single premium deferred annuity instead of
to the Client Trust Account, he should be allowed to do so, and such annuity payment
will be made payable to BHG Structured Settlements, Inc.)

3. AUTHORIZE the City Attorney, or designee, to prepare Controller instructions for any
necessary technical adjustments, subject to the approval of the City Administrative
Officer; and, AUTHORIZE the Controller to implement the instructions.
