ANALYST'S NOTE: House Bill 372 creates regulation of auxiliary containers. This law would require that
any regulation or taxation of auxiliary containers be done by the legislature, not by individual political
subdivisions of the state.
An "auxiliary container" is defined as a reusable bag, disposable bags, boxes, cups and bottles which are
made of cloth, paper, plastic, extruded polystyrene or similar materials that are designed for one-time use
or for transporting merchandise or food from food and retail facilities.

Point No. 1 Does it create, expand, or enlarge any agency, board, program, function, or activity of
government? Conversely, does it eliminate or curtail the size or scope of government?
ANALYSIS: House Bill 372 eliminates the ability of local individual political subdivision of the state
from imposing regulations and taxes on local private sector operators. (+1)
