Presidents Rule imposed in Arunachal Pradesh
A political crisis erupted in Arunachal Pradesh after 21
out of 47 ruling Congress legislators in the 60-member
house rebelled along with 11 BJP and 2 independent
legislators and extended support to Kalikho Pul to form
new government. Arunachal Pradesh Governor Jyoti
Prasad Rajkhowa also had advanced the date of the
convening of the assembly session in order to check the
majority of ruling government in the assembly. The
state assembly failed to comply with the provisions of
Article 174 (sessions of the state legislature,
prorogation and dissolution) of the Constitution. As per
the provisions of Article 174, the session of state
assembly was to be held by 21st January 2016, six
months after the last sitting. But the state assembly
failed to comply with this provision which may lead to
constitutional
breakdown.
So
the
governor
recommended Presidents Rule in Arunachal Pradesh
under Article 356 (1) of the Constitution.
Rajesh Tacho, chief whip of the Congress Legislature
Party in the Arunachal Pradesh Assembly had
challenged in the Supreme Court the imposition of
Presidents rule alleging that Article 356 had been
misused by the Centre and the Governor to topple the
democratically elected Congress government. The
petition wanted the Centre and the Governor to
furnish records of the events culminating in the
proclamation of Presidents rule. The Supreme Court
ordered the Arunachal Pradesh Governor to respond
why he recommended Presidents rule. However, the
Supreme Court recalled the order within a few days
saying it made a mistake by not realising that
Governors have complete immunity and are not
answerable to courts for acts done in their official
capacity as per article 361(1) of the Constitution.
