DUTY TO UPHOLD
CONSTITUTION
While the duty to uphold the Constitution and
obey the law is an obligation imposed on every
citizen, a lawyer assumes responsibilities well
beyond the basic requirements of good
citizenship. As a servant of the law, a lawyer
should moreover make himself an example for
others to emulate. Being a lawyer, he is
supposed to be a model in the community in so
far as respect for the law is concerned.

His responsibilities are


greater than those of a
private citizen. He is looked
up in the community.

DUTY NOT TO ENGAGE IN


U N L AW F U L C O N D U C T
This duty demands that he shall not engage in a
unlawful, dishonest, immoral or deceitful conduct.
An unlawful conduct is an act or omission against
the law. A dishonest act is an act of lying or cheating.
An immoral or deceitful conduct is one that involves
moral turpitude including acts done contrary to
justice, modesty or good morals, or to any vileness,
baseness or depravity in the private and social duties
that a man owes to his fellowman and society,
contrary to the accepted rule of right and duty
between man and man. A lawyer who engages in
unlawful, dishonest, immoral or deceitful conduct
may be held administratively liable.

DUTY NOT TO COUNSEL ILLEGAL


ACTIVITIES

He must not subvert the law by counselling or


assisting in activities which are defiance of the
law
He should not promote an organization known
to be violating the law nor assist it in a scheme
which he knows is dishonest. Nor should he
allow his services to be engaged by an
organization whose members are violating the
law, to defend them when they get caught.

Useful function of a lawyer is not


only to conduct litigation but to
avoid it where possible, by
advising settlement or
withholding suit
