Facts: FlorenceandrespondentPhilippT.Sin(hereafterPhilipp),aPortugesecitizen,
weremarried. FlorencefiledwiththeRegionalTrialCourt,Branch158,PasigCity,a
complaintfordeclarationofnullityofmarriageagainstPhilipp. Trialensuedandthe
partiespresentedtheirrespectivedocumentaryandtestimonialevidence.Throughoutthe
trial in the lower court, the State did not participate in the proceedings.While the
Fiscalfiledwiththetrialcourtamanifestation,statingthathefoundnocollusionbetween
theparties,hedidnotactivelyparticipatetherein.Otherthanenteringhisappearanceat
certainhearingsofthecase,nothingmorewasheardfromhim.Neitherdidthepresiding
Judgetakeanysteptoencouragethefiscaltocontributetotheproceedings.
