On September 16, 2015 | was contacted by Chief Pat Gallegos and was assigned to
conduct an internal Affairs Investigation. Chief Gallegos presented me with several documents
and written supervisor statements that indicate Officer Larry Garrison may have been
untruthful when interviewed by his supervisor and falsified information on a document used to
track statistic and overtime pay from funds provided through Region V Narcotics Task Force. it
Should be noted that this task force is commonly referred as “Metro” and for the purpose of
this investigation | will refer to it by that name,
INVESTIGATORS CREDITIALS: | [Detective Charlie Smart] am a New Mexico certified law
enforment officer and have been for approximate 25 years, | successfully completed the 400
hour basic academy in Santa Fe, NM. Since that time | have accrued several hundred advanced
training hours covering the full scope of investigations, These include felony, misdemeanor and
administrative investigations. | am currently assigned as a Detective with this agency and have
been since December 16, 2013.
DUTIES OF INVESTIGATOR: | will conduct this investigation in a fair and impartial manner
Pursuant to all City and Departmental procedures and in adherence to the Peace Officer's
Employer-Employee Relations Act (29-14-1 NMSA 1978).
DOCUMENT REVIEW: Contained in the packet Chief Gallegos gave was a written statement
from Sgt. Chris Valdez dated September 10, 2025. In that Sgt. Valdez states that he wes
contacted by Lt. David Meeks who advised that Officer Larry Garrison had submitted a Metro
Stat Sheet that had questionable information on it as it did not match with what he told Agent
Seth Carruth previously. According to this report Agent Carruth stated that Officer Garrison's
“Metro” stat sheet showed that he worked on September 7, 2015 at 1930 hours to 2300 hours.
The “Metro” sheet showed (6) vehicle stops, zero arrest and four citations, Agent Carruth said
that he briefed Officer Garrison and Officer Villanueva and advised that both officers needed to
be productive and write a citation for every stop while looking for narcotics, Agent Carruth said
that he was contacted by phone by Officer Garrison at 2235 hours and told him he was not
feeling well and was going home. Agent Carruth said that Officer Garrison told him he made @
couple of traffic stops and wrote one ticket. Officer Garrison said he would turn in his [stat
sheet} on the following day. Once reviewed by Agent Carruth he noted that he claimed (6)
traffic stops and had wrote (4) citations. it was Agent Carruths request to have that information
verified,
Accordingly Sgt. Valdez spoke with Officer Garrison about the matter He reminded Officer
Garrison that the stat sheet he turned in showed that he had (6) traffic stops and issued

(A)citations, Officer Garrison was asked why he showed (6) traffic stops and the Officers Daily
Cad Log shows only (4) transmissions for the whole night. Officer Garrison stated that he had
four traffic stops and assisted Agent Carruth on (2) stops for a total of (6) stops. Officer Garrison
was asked why he shows (4) citations and only wrote (1) citation and he stated that he had got
confused in the morning of September 10 and mistakenly wrote (4) on the number on the
‘number of citations thinking those were his self-initiated stops, He told Sgt. Valdez that there
was such a delay in filling out the stat sheet due to his schedule. Sgt. Valdez asked Officer
Garrison why he showed (6) traffic stops and his Officer Daily Cad Log Report shows he had only
(4) transmissions for the whole night. Officer Garrison again told Sgt. Valdez he had (4) stops
and assisted Agent Carruth with (2) vehicle stops making a total of (6) stops. When asked
Officer Garrison said that while filling out the stat sheet he got confused those with his self-
Initiated stops.
Set Valdez report indicated that he did review the Daily Log Report and it showed that
Officer Garrison had (4) transmissions through dispatch. It showed (3) traffic stops and the
other was 10-8 in service. Sgt. Valdez CAD Logs by Officer and found that Officer Garrison has
(3) call outs, but he was Primary on (1) and assisting on the other (2). He again spoke with
Officer Garrison and advised him of his finding, Sgt. Valdez asked Officer Garrison where the
other traffic stops where and he replied he didn’t know. Sgt. Valdez advised him that he had
reviewed his “body cam” and it only showed audio of one traffic stop. Officer Garrison said that
he did not activate his body camera on every stop because he forgot due to it being in @ pouch
and not where he normally wears it. Officer Garrison continued to say there was (4) traffic
stops total. When asked if called out every stop and he said that he calls out every stop. Set.
Valdez asked if he could recall the times of the other (3) stops and he said no. Officer Garrison
said that he had (1) stop after leaving the station and it was in the “Stripes” parking lot.
[Chicago and Lime] That individual was given a verbal warning, Set. Valdez asked if he could
recall the other traffic stops and he advised he calls out alll of his traffic stops. When Officer
Garrison was asked, he advised that his in car camera was not working.
Sat Valdez made contact with Dispatcher Karol Garley and asked if she was able to
retrieve radio traffic recordings and she said that Keith Wattenbarger was the only one that
could do that. He also inquired if there were times that they don’t put officer's traffic stops
into the CAD and she advised sometimes if they are busy.
At the end of this report submitted by Sgt. Valdez he could not render a disposition until
such time he could obtain the audio recording from dispatch for this time frame, He also states
that Officer Garrison turned in (1) citation but had four stops issuing three verbal warnings
Officer Garrison is adamant that all (4) traffic stops were called out with dispatch.

Ina follow up report submitted by Sgt. Valdez after receiving the audio recording of the
time frame in question his findings were that the audio information did not match what was
told to him by Officer Garrison. In this report Sgt.Valdez listed all of Officer Garrison’s
transmission that evening. Based on all his findings Sgt. Valdez believes that Officer Garrison
was untruthful about the traffic stops he made and the information he submitted on the Metro
Stat Sheet. In addition he believes that Officer Garrison also violated two policies and
Procedures under the Digital Video and Audio Recording Policy SOP#216.00 and Code of Ethics
101.02.
On Thursday September 17, 2015 at 0640 hours | conducted an audio interview with
Sgt. Valdez. At that time | advised him of the purpose of the interview. During the interview
Set. Valdez presented the same information that he provided in his written report mentioned
above. | did request that he provide me with a copy of his video interview that he had when he
discussed this matter with Officer Garrison. Sgt. Valdez did provide that the next day. Refer to
my audio recording for complete details of this interview, as well as, the video recording of Sgt.
Valdez’s inquiry with Officer Garrison.
On Thursday September 17, 2015 at 0840 hours ! conducted an audio interview with Lt.
Meeks. At that time | asked what his involment was in this matter. Lt. Meeks said that Sgt.
Valdez had submitted a report a supervisor investigation report with the allegations that Officer
Garrison was not being truthful on a Metro Stat Form, Lt Meeks sald that he had been
Previously made aware that Officer Garrison had possibly falsified information on this form
when Agent Seth Carruth and/or Sgt Nate Hyde were reviewing the form. Apparently on the
night of this overtime operation Officer Garrison had told Agent Carruth he was not feeling well
and was going home. He advised that he had made a couple of stops and wrote (1) citation.
When the stat form was submitted a few days later the discrepancies appeared. Lt. Meeks
explained to me how these operations were conducted and that it was mandatory to do a
briefing and submit the stat sheet, Lt Meeks said that he did assign Set. Valdez the investigation
and once completed sent it up the chain of command. Refer to attached audio for complete
details of this interview.
On Thursday September 17,2014 at 0920 hours | conducted an audio interview with Set.
Nate Hyde. At that time | advised him of the purpose of the interview and asked him to explain
his involvement and the procedures of the Metro Unit, Sgt. Hyde explained to me that the
Region V Narcotic Task force is funded by grant money. This money is to provide overtime
opportunity’s with the sole purpose for operation for street enforcement with the focus on
narcotics and criminal activity. He said that among his other duties he is in charge of the
narcotics agent assigned to Metro from this agency and monitors and approves such as planned

Portales. NM.Operations, documents submitted prior to them being forwarded to the Metro administrator,
Set. Hyde said that it is mandated by him that all planned operations have a briefing prior to the
start. He advised me that the officers were required to attend the briefing. When asked he said
that itis not mandatory to write citation on every traffle stop but at a minimum they are
encouraged to write a written warning. He said that it was mandatory to complete the Metro
Stat Sheet as it has to be submitted at the end of each operation, Sgt. Hyde advised that Agent
Carruth briefed him the next day after above mentioned operation and told him that Officer
Garrison had not worked the entire time block. He said that Officer Garrison had told him that,
he had made a couple of stops and written (1) citation. According to Sgt. Hyde he had to send
email message to Officer Garrison's ‘supervisor and remind him to turn his stat sheet in, Officer
Garrison subsequently turned it in and upon review, Agent Carruth had noticed that he claimed
(6) traffic stops and had wrote (4) citations, Agent Carruth asked that this information be
verified. Sgt Hyde said that he checked the radio logs and it appeared that Officer Garrison had
traffic for going 10-8 and (2) traffic stops. He said that he checked to see what tickets had been
turned in for the date in question and found none turned in for Officer Garrison. Sgt. Hyde said
based on his findings he advised Lt. Williams and Chief Gallegos.
On September 22, 2015 at 0845 hours I conducted an audio interview with Officer Larry
Garrison, Prior to starting the interview | read him his “Statement of Rights” pursuant to
“Garrity’. At that time Officer Garrison acknowledged his understanding and signed and dated
the form 09/22/15 at 0851. When asked if he had received his target notification he said that
he did but didn’t understand what the allegations where at that time I read to him the content
of Section 802 and 803. [Refer to attached document for details] Officer Garrison said that
when he read the first one he thought it meant falsifying certifications to gain employment.
When asked, Officer Garrison acknowledge that he had recently signed up for this assignment
and explained that the assignment was for high volume of traffic stops, citations on each stop
looking for drug activity. He went on to explain how it worked in Curry County where he was
Previously employed. | did advise him that had no bearing in this matter but I did let him
continue. On this particular operation he said that he really wasn't into it because he spends @
lot of time away from home at night. He said that he went to a pre op briefing at 1930 hours
which was facilitated by Agent Carruth. In the briefing they were advised to focus on high
volume traffic stops and citations for the purpose of looking for drugs. Officer Garrison said that
after briefing he tried to get motivated but couldn’t. He said that about 2300 hours he said he
contacted Agent Carruth and told him he wasn't into this and didn’t feel well so he was going
home. Officer Garrison said that Agent Carruth asked how many citations that he got and he
told him that he had one citation, Agent Carruth told him okay and to fill out his stat sheet.
Officer Garrison said that he had already planned to come out the next day so he was just going

to do his stat sheet then. He said that on that next day he decided not to work as planned. He
advised that on Wednesday morning he received an e-mail from Sgt. Hyde requesting his stat
sheet. He said that when he went in for shift that night he forgot about doing the stat sheet and
it was Thursday morning at the end of his shift he realized he had not turned in the stat sheet.
He sald that he turned around and came back to the office for the purpose of doing the stat
sheet. He said he really wasn’t paying attention because he was tired. He went on to explain
why he was so tired stating that he had not gotten any sleep that day for several reason. He did
advise me that he and his wife were having some problems and wes attending counseling. He
said that they had argued throughout the day. | asked Officer Garrison to go back to the night
of the operation and describe to me his activities. He said as he remembered his first stop was
at Lime and Chicago on a red vehicle. He stopped this vehicle for making an illegal U Turn in
front of him. He said that it was an older couple and he subsequently released them with a
verbal warning. He said that he remembers that he responded to a call for an assist by Agent
Carruth, According to his recollection it was at Hibbett Sports Store. He advised he just stood by
while Agent Carruth did a vehicle search. He said he recalled a “one head lighter” but could not
remember where the stop was made. He said that he remembered another assist for Agent
Carruth on Ivy Street. The only other stop he can recall is the one he wrote the citation for and
it was at Boston and Lime. When asked how many traffic stops he made that night he advised
me could recall three. | asked if he called out every traffic stop he made and he told me "No”
and explain sometimes when there is a lot of radio traffic or if he knows he is not going to write
2 citation he might not call out on the radio. He said that he knows that is not good and he does
ot train is rookies that way. When asked if he called out all of these stop he sald he knows he
didn’t on the one he described at Lime and Chicago. He said he was pretty sure he called out
the one that he wrote the citation on. He said that he could not recall if he called out the other.
He said that he believed that each time he was out with Agent Carruth he did call out with him,
At that time I showed him the Metro Stat sheet and pointed out that he had logged (6) vehicle
stops. He said that he explain to Sgt. Valdez that he counted the (2) assist as stops in that total.
Officer Garrison said that on the day he filled out the stat sheet he could not remember how
many stops he had made and guessed it to be (4). He said he knows that one of the things that
came into question was that he entered (4) citation issued. He said he doesn’t know why he
Put (4) citation. Officer Garrison said that he has gone back numerous times to remember why
he put that number in but could not come up with an answer. He again stated that he was
exhausted, He said that if Agent Carruth had of called him he would have told him he only
wrote the one citation. | asked him to think back today how many traffic stops he made that
night and he said he did at least (4) stops. He said that since put under |. A. he has tried to go
back and recall all the stops but he can’t because he gets stops made from previous shifts
mixed in, He said that he can’t explain why he put a (4) where he should have put a (1). He said

that he did not do it to confuse anybody and said he guessed he was confused. He said that he
knows that this could be tracked because if you write a citation it’s going to be in records, |
asked him if he knew what the purpose of the stat sheet was he told me he did not know. | ask
him that there should be video on all his traffic stops and he said that his body cam was not
used every time due to the fact he was carrying it a different spot than he normally carries so
he would forget to turn it on as well as turn it off. When asked how many videos he did have
for that day he stated that all he had was (1). He said that he did not know which stop it was
for as he did not open it to view.
He said there were a couple of times that he thought it was activated but it wasn’t.
Officer Garrison said that he was awere of the policy about recording contacts and has read and
understands it. Officer Garrison said that there may be times for different reasons he might not
turn it on. He gave an example of getting out of your unit in a hurry and forgetting to do it. He
said he turns it on if he realizes that has happened as it is better to get some than none et all.
!asked Officer Garrison if he just panic because of the lack of productivity that night and
wrote the stat sheet to cover himself. He was adamant that he did not and maintains that he
just can’t remember all of his stops or there locations.
On September 29, 2015 at approximately 0930 hours | conducted an audio interview
with Agent Seth Carruth in reference to this matter. It should be noted that Agent Carruth had
been out of town for training and returned this morning. | asked Agent Carruth about the
Operation in question and he did advise that Officer Garrison was present, He said that he
briefed that the operation was for narcotics interdiction and it was expected of them to have
high volume of stops and at minimal a written warning citation on each one. When asked Agent
Carruth told me that approximately 2230 Officer Garrison called and said that he was going
home and that he had a couple of stops and (1) citation. He said it was a few days later that he
received Officer Garrisons stat sheet and that is when he noted that Officer Garrison wrote
down did not match what he had been told on the night of the operation. He told me that when
he asked for the verification. Refer to Agent Carruth letter sent via his chain of command.
FINDINGS: After reviewing all documents and video recordings and audio recordings | submit
that Officer Garrison is in violation of the following policies that he is aware of.

Section 2. Improper Conduct Offenses:
00. Untruthfulness in an Official Proceeding: That on September 10, 2015 Officer Garrison told
Sgt. Valdez that on the night in question he had made (4) stops and wrote one warning citation.

In Set. Valde2’s inquiry he pulled and reviewed radio logs that showed that Officer Garrison was
primary on (1) stop only and showed him as assisting officer on (2) stops. According to Sgt
Valdez , Officer Garrison continued to maintain that he made (4) stops and that he calls out on
all of his stops. In my review of the radio log both audio and written it appears that Officer
Garrison called out on only one stop at Chicago and Boston and (2) assist with Agent Carruth.
PP. Falsification of Official Document(s): During my interview with Officer Garrison he
repeatedly maintained that he could not remember all of his stops or the locations. He also
stated that he did not call out on all of his stops; again contradicting what he had previously
told Sgt. Valdez. He said that he must have just got in a hurry or confused when he filled out the
stat sheet and doesn’t know why he wrote that he had (4) citations. He said that he was
exhausted during that time and that may be the reasoning. Based on my training and
experience as a law enforcement officer | find that it is not logical to not have the ability to
recall all traffic stops and their location that occurred in such a short period of time. | feel that
due to the fact that Officer Garrison was aware that these stat sheet would be up for review by
Chief Gallegos he was untruthful and provided false information on an official document that is
subject not only by supervisor review, but audit from the grant provider(s).
Section 3: Insubordination Offenses
D: Compliance With

As Agent Carruth was in charge of above mentioned operation and did mandate certain
objectives and documentation Officer Garrison failed to comply by not making traffic stops
and/or at 2 minimum write a written warning for stops he claims to have done.
SOP# 216.1 Section D Personal will use issued audio/video recorders to document all calls for
service, traffic stops and citizen contacts
SOP# 101.2 Code of Ethics: Subsequently finding Officer Garrison being untruthful in a
supervisory investigation and providing false information on an official document would place
him in violation of this Policy.
Refer to attached documents and audio and video for complete details of interviews in
this matter. This will be submitted to Chief Gallegos for disposition.

Subject: Notification of Intemal Affairs Investigation
Det. Smart,
This letter is to request that you start an intemal investigation into Officer Larry Garrison
in which he lied to a supervisor(s) and falsified an official document, which may have to be
reported to defense attorneys under Brady and Giglio. Police officers are often witnesses in
criminal proceedings, and the principles in Brady and Giglio mandate that facts (such as any
indication of having written false reports in the past) bearing on an officer’s veracity and
credibility must also be disclosed.
Violations may include the following policies, but are not limited to the following:
* Section 802-Fraud- No person shall willfully or corruptly make any false
statement, certificate, mark, rating, or report in regard to any test, certification of
appointment, or in any manner commit any fiaud in connection with employment
with the City,
* Section 803-Concealment of Fact- No employees shall conceal facts ot
information related to any inquiry or investigation by a supervisor, department
head, or the City Manager. Failure to provide known information or facts may
result in disciplinary action including dismissal

On September 16, 2015 I received two emails from Lieutenant David Meeks in reference
fo @ memo that was sent to him by Sergeant Chris Valdez. Sgt. Valdez advised that he had
spoken to Officer Larry Garrison in reference to a Region V Street Enforcement Operations Stat
sheet that Officer Garrison tumed in had questionable information on the sheet, During the
course of Sgt. Valdez speaking with Officer Garrison, Sgt, Valdez feels that Officer Garrison
lied to Sgt. Valdez and put false information on the stat sheet

transmissions from the evening in question.

Hello,
This letter is in reference to a recent Region V Street Enforcement Operation that occurred in
the Portales area on September 7", 2018. Prior to the operation | requested Officer Garrison and Officer
Villanueva to meet with me in the conference room for an operations briefing at 1930. Both officers
were present for the briefing, Both officers were advised that they need to be productive and the focus
of the operation is narcotics. | advised them to perform interdiction stops and if they did not see
anything they should be looking for, to write the citation and move on to the next stop. Both officers
were told to write citations on each stop. They were advised that the stat sheets for the operation will
be filed out upon completion of the operation and to turn them into me. | also told them that the stat
sheets for the operation would be up for review by Chief Gallegos. During the operation | received a call
from Officer Garrison at 2235 hrs, He advised me that he was not feeling well and that he was going to
0 home. He told me that he had made a couple of stops and wrote one citation and said that he would
turn in hs stat sheet the next day, Officer Garrison had assisted me on two of my traffic stops during
consensual searches of the vehicles.
On September 9", 2015! had not recelved a stat sheet for the operation from Officer Garrison. |
Provided this information to you on that date at which point he was emailed in reference to the sheet, |
received a stat sheet from Officer Garrison In the Investigations basket on September 10", 2015.)

information be verified from the night of the operation,

Re: Supervisory Investigation on Metro Statistic Sheet
On Thursday September 10, 2025 |, Sergeant Valdez with the Portales Police Department was contacted
by Lieutenant Meeks reference to Officer Larry Garrison Region V Street Enforcement Operations Stat
Sheet having questionable information which didn’t match up to what Officer Garrison told Agent Seth
Carruth, This investigation will follow requirements as set forth in Chapter 29-Article 14, NMSA 1978
Peace Officer's Employer-Employee Relations.
‘Agent Carruth sent a letter attached to this report requesting the information on Officer Garrison Metro
sheet to be verified from the night of September 7, 2015. Agent Carruth stated Officer Garrison Metro
‘Sheet shows that Officer Garrison worked on September 7, 2015 at 1930 hours to 2300 hours. The
Metro sheet showed six vehicle stops, zero number of arrests and four number of citations. Agent
Carruth stated he met with Officer Garrison and Officer Villanueva to discuss operation briefings and
advised both Officers they needed to be productive and write a citation for every stop while looking for
hrarcotics. Agent Carruth stated at 2235 hours Officer Garrison contacted him by phone and stated he
was not feeling well and that he was headed home. Agent Carruth stated Officer Garrison told him he
‘made @ couple of traffic stops and wrote one citation. Officer Garrison advised he would turn in his stat
sheet the next following day. Agent Carruth noticed he claimed he had made six traffic stops and wrote
four citations and wanted the information verified,
On September 10, 2045 at approximately 2158 hours |, Sergeant Valdez spoke with Officer Garrison
reference to his Region V Street Enforcement Operations Stat Sheet. | explained to Officer Garrison that
his stat showed he stopped 6 vehicles and wrote four citations for September 7, 2015 operation. | asked
Officer Garrison why he showed six stops when his Officer Dally Cad Log Report shows he only had four
transmissions of traffic for the whole night. Officer Garrison stated he had four stops and assisted Agent
Carruth with two vehicle stops and counted those two stops making his total six vehicle stops.
| asked Officer Garrison that he claims he had four stops but only wrote one citation and he stated he
got confused early in the morning of September 10, 2015 before he was about to go home and
mistakenly wrote four on the number of citation thinking those were his self-nitiated stops not citation.
| asked Officer Garrison why this paper work wasn’t filled out the day of the operation and why the
tickets weren't turned in and he stated he went home early at 2300 hours because he wasn't feeling
well. Officer Garrison advised Agent Carruth that he would take care of the paper work the next day
due to he was working overtime on Tuesday September 8, 2015. Officer Garrison stated Monday he
didn’t want to work but he made an obligation to Officer Villanueva and knew they had to have two

Officers and didn’t know Agent Carruth would be working. Officer Garrison stated he worked couple of
hours and contacted Agent Carruth and advised he wasn’t feeling well and was going home. Officer
Garrison stated he was going to work Tuesday Operation and heard Officer Taylor would be working so
he opted out coming in so the paper work never got filled out.
Officer Garrison stated on Wednesday he received a email from Sergeant Hyde stating that he needed
to get the Metro paperwork complete and Officer Garrison stated he emailed Sergeant Hyde back and
advised he would take care of it Wednesday night when he goes in for shift. | asked Officer Garrison
why the ticket wasn’t put in with the paper work and he advised the ticket was in his visor and slipped
his mind and due to being busy with calls and reports he only remembered to fill out the Metro sheet
when he was already headed home. Officer Garrison continued to say while filing out the Metro Sheet
he confused the number of citation with the number of stops. | asked Officer Garrison why he showed
four stops but only had one citation. Officer Garrison stated he had no excuses and wasn't motivated
and did his traffic stops and gave verbal warnings,
| reviewed the Daily Log Report from Lieutenant Meeks and it showed Officer Garrison had four
transmissions through Dispatch and three of them were traffic stops and the other transmission was 10-
8 in service. 1 went into the CAD Call Logs by Officer due to Daily Log not having primary Officer or
location of the stop, My findings on the CAD Call Logs are that it shows Officer Garrison has three call
outs with Dispatch but he Is only primary on one stop and assisting the other two. The two assisting call
outs were with Agent Carruth. | spoked with Officer Garrison and advised him of my findings and asked
him where the other traffic stops are and he advised he didn’t know. | advised Officer Garrison |
reviewed his body camera and it only showed audio of one traffic stop. Officer Garrison stated he didn't
activate his body camera on every stop because he forgot due to it being in a pouch on his vest because
he didn’t have a clip. Officer Garrison continue to say there was four traffic stops total and | asked if he
called out every stop and he advised yes he calls out every stop. | asked Officer Garrison if he could
recall the times of the other three stops and he advised no. Officer Garrison stated he had one stop
after he left the station at the Stripes parking lot for making an illegal U-turn and it was with a red car
located on Chicago and Lime, Officer Garrison stated he gave that vehicle a verbal warning. | asked
Officer Garrison if he could recall the other traffic stops and he advised no but advised he calls out all his
traffic stops. | advised Officer Garrison | would be pulling radio traffic from Dispatch and if he called out
the stops it should be on the recordings, | asked Officer Garrison if his in car camera was working to
show the three other stops and he advised no it wasn’t.
!went and spoke with Dispatcher Karol Garley and asked if she was able to retrieve radio traffic
recordings and she advised no only Keith Wattenbarger had access to the recordings. At this time |
don’t have the radio traffic recordings to see if Officer Garrison called out the other three traffic stops. |
asked Dispatcher Garley if there are times that they don’t put in the Officers traffic stops into CAD and
she advised yes when they are super busy and sometimes miss it.
At this time this investigating Officer cannot make a rendering disposition due to needing Dispatch radio
traffic recordings. The CAD Call Logs show that Officer Garrison only conducted one traffic stop and

assisted Agent Carruth on two stops. Officer Garrison only had one citation to turn in but advised he
had four traffic stops total with three verbal warnings and one written warning. Officer Garrison is
adamant that he had four traffic stops and called each stop out with Dispatch. Officer Garrison stated
he mistakenly filled out the Region V Metro paper wrong on accident. Officer Garrison only provided
‘two video body cam recordings and rio in car camera recording and stated he forgot to active his body
cam on the traffic stops. Under Policy in the section Digital Video & Audio Recording Policy SOP# 216.00
subsections | and Ill Officer Garrison was in violation of the SOP and this infraction constitutes the first
time he has violated this section of the SOP.

+ STATEMENT OF PURPOSE
tt will be the policy of this Department for all sworn personnel to video and/or audio record every citizen
Contact while on duty. The preferred method of recording is video however, it is understood that there
may be circumstances that prohibit the video recording on all contacts.
The Department will make an appropriate supply of digital audio/video recorders available for employee
use
. RULES AND PROCEDURES
A. Such issued equipment will be noted on the individual's property card maintained by the Property
and Supply Officer.
8, Personnel issued recording equipment are responsible for Its maintenance.
C. All uniformed sworn personnel will be required to carry the Issued recorder(s) while on duty. The
Issued video recorder shall be the primary method of recording and audio only as a secondary.
0. Personnel will use issued audio/video recorders to document all calls for service, traffic stops and
citizen contacts.
E. Recordings will only be made in connection with official law enforcement business, or when an Officer
believes that the recording may be used in an administrative investigation.
F- although Police Officers are not required to announce to a citizen that their conversation is being
recorded, personnel will truthfully respond if asked by the citizen whether or not the conversation is
being recorded

G. All recordings related to an arrest must be tagged into evidence and willbe listed on the report as
being tagged.
H, Digital audio/video recordings of confessions or other incidents that could be considered evidence
will be handled accordingly.
|. The recording will be tagged into evidence in accordance with proper evidence procedures.
J. Dying dectarations will be recorded.
K. Downloads will be conducted daily and saved in the officers folder in the “v” server.

Re: Follow up Officer Larry Garrison Dispatch Radio Call Logs
I received the call logs from Dispatch on the night of September 7, 2015 from 1930 hours
to 2330 hours and reviewed them. After reviewing the call logs its apparent Officer Garrison
‘was untruthful about his radio traffic and four stops he made the night of September 7, 2015.
Radio transmission shows the following:
414 - 10-8 special assignment
414 - 1" stop at Chicago and Boston at 2058 hours
414 — Went 10-8 from 1* stop at 2108 hours
407 — Request assistance from 414 at 2128 hours
414 & 407 10-89 check at 2139 hours
407 & 414 went 10-8 from stop at 2141 hours
414 requested to 10-87 with 421 at 2212 hours
Two radio transmissions where 414 went out to assist 407 on vehicle search unknown time
414 — Went 10-7 10-42 at 2247 hours
Theses radio transmission logs shows that Officer Garrison was untruthful about his stops
and makes me to believe he was untruthful about his Region V Street Enforcement Operations
Stat Sheet. Officer Garrison stated numerous times he had four trafiics stops and the call outs of
the stops would be on the Dispatch recordings. Officer Garrison stated he conducted a traffic
stop on a red car immediately after going 10-8 from briefing in the Stripes parking lot and there
‘was no radio traffic of that stop. Officer Garrison has not been spoken with after receiving
theses radio traffic logs showing there was not four stops,
The disposition of this investigation is that the questioning of Officer Garrison
truthfulness about the traffic stops and the paper work on Region V Street Enforcement
Operations Stat Sheet are sustained to prove the allegation, Not only was the complaint
sustained Officer Garrison also showed he violated two policies & procedures following under
Digital Video & Audio Recording Policy SOP# 216,00 and Code of Ethics 101.02 being
untruthful about the stops. Officer Garrison displayed unethical conduct with this overtime
opportunity and investigation,
I will leave the disciplinary recommendation up to Chief Gallegos and Lieutenant Meeks
following the Department policy from this investigation.

| want to start by saying I'm sorry for causing this whole situation.
| made a mistake a human error on a form | had never filled out before and did so in
haste three days later after working a graveyard shift with no rest the day prior to shift. 1
did fill out the stat sheet I'm accused of falsifying | could not recall everything from the
night of the operation
On the night of the operation Monday 07,2015 | was feeling sick and went home early
and ealled Agent Carruth to inform him ! was going home early because | was feeling
sick. | advised Agent Carruth | had written one citation and that | would complete the
stat sheet the following night when | was scheduled to work another operation. | did not
work that operation because again | was still not feeling well. | received an e-mail on
Wednesday 09 , 2015 from Sgt Hyde that | needed to turn in my stat sheet. I was
scheduled regular shift that night, | worked my regular duty shift and as | was pulling
into my street on Thursday moming after working a full graveyard shift | realized | had
forgot to complete the stat sheet and drove back to the police department and filled out
the stat sheet in haste. While filling out the stat sheet | could recall two assists with
Agent Carruth and three traffic stops but thought | had conducted four stops, But could
not recall for sure.
| was later advised by Sgt Valdez that I had an incorrect number of citations listed on
my stat sheet and @ complaint had been lodged against me by Agent Carruth. I had
mistakenly put four citations when | had only issued one citation. When questioned by
Sgt Valdez | could honestly not recall each and every traffic stop from the night of the
operation. Prior of being contacted by Sgt Valdez about the discrepancy and complaint
| was not contact by Agent Carruth and afford the chance to correct my mistake.
During my interview with Det. Smart | was asked point blank if | had lied on my stat
sheet to make myself look good. My Answer is NO | have worked numerous saturation
patrols where | did not issue the required amount of citations and have never falsified
any form in my whole career for any reason.
| have worked for the Portales Police Department since March of 2008, | moved my
family here and have stayed with this department through many changes good and bad
even being offered positions with other agencies | stayed because | want to be part of
the positive change to this department. | have always been truthful with the my dealings
even if it meant possible discipline or trouble for me. | have never been counseled or
reprimanded for untruthfulness. | am guilty of filling out a form in haste and not paying
attention to detail. BUT | DID NOT DO THIS WITH MALICE OR TO MAKE MYSELF
LOOK GOOD.I do know that a polioy is in affect requires us to either audio or video record each
contact. On the night of the operation | was dressed in tactical goar which is a tactical
vest with pouches and | have a body camera that is set up for a button up shirt and
Could not attach to the camera to the outside of the vest. | took the camera out of the
base and placed in a closed pouch in the tactical vest which made in hard to remember
to activate when making contact. The reason | have the camera on my uniform with the
button attachment is so that | can remember to activate the camera when exiting my
unit. On the night of the operation and with the camera in a pouch | forgot to activate it,
even leaving it running when | did sala itand ae realgra when | heard it beep v

| record all contacts and oll a all videos into the appropriate files at the end of each
shift. | have never been questioned, counseled or reminded to elther record contacts or
download my recordings. | have always recorded contacts even prior to having body
cameras | carried audio even before it was policy to record contacts.
As far as calling out with each traffle stop. | admit on occasion epically it dispatch is
busy or not responding | will conduct stops without calling out. | understand the
dangers and officer safety issues about not calling out but this has been done
occasionally by me and other officers.
| am accused to lying and claiming of violation of policy in order to cover up
discrepancies on the stat sheet. | WOULD NOT LIE TO COVER UP A LIE | HAVE
BEEN TRUTHFUL, | MADE A CLERICAL ERROR WHICH I FEEL COULD HAVE
BEEN CORRECTED HAD | BEEN AFFORDED THE CHANCE PRIOR TO FILING A
COMPLAINT.
We have all made clerical errors and given the opportunity to correct those mistakes
without being thrown into an investigation
| ASK FOR COMPASSION AND UNDERSTANDING THAT | DID NOT DO
THIS WITH MALICE OR CONTEMPT.
| have worked hard for this department even when sick as it reflects on the
amount of unused sick leave | have. | am always willing to work extra shifts
for coverage and have never refused when called to assist even on out of
town transports on my days off. | take exceptional care of my issued
equipment and work hard as it is reflected in my officer's evaluations. | was
recently awarded Officer of the quarter showing | work just as hard as
officers half my age and some weren't even born when I started in Law
Enforcement. | complete all reports before the end of each shift which arerarely returned for correction. | have always completed assigns given in a
timely manner. | never have to be reminded to turn in reports. | ask that
my history with this department mg dedication to this department and this
city be taken into consideration when making a decision of my further
employment.
| started my Law Enforcement career in 1989 with the Curry County
Sheriff's Office as a Reserve Deputy and graduated the New Mexico Police
Academy in April of 1994. In my career | have never been accused of
being untruthful. MY HOPE IS TO CONTINUE HERE AT THE
PORTALES POLICE DEPARTMENT.
' have been dealing with some personal relationship issues and minor
health issues and a constant lack of sleep since the shift change.
1! AM NOT ASKING TO WALK AWAY FROM THIS UNSCATHED
! DON'T FEEL | DESERVE TERMINAITON AND UNDERSTAND
THAT | HAVE ADMITTED TO VIOLATING TWO POLICIES. |
ASK THAT | BE ISSUED A LETTER OF REPRIMAND FOR THE
POLICY VIOLATIONS WHICH WILL PREVENT ME FROM
TESTING FOR PROMOTION. BUT | BEG PUT ME BACK TO
WORK. | LOVE MY JOB WITH THE PORTALES POLICE, |
LOVE MY COMMUNITY AND MY DEPARTMENT AND JUST
WANT TO GET BACK TO WORK.
