ORDER ON MOTION TO DISMISS ORE TENUS

This matter came on before the Court for a preliminary hearing on March 3, 2016 and
prior to the hearing, Defendant motioned the court, ore tenus, for a dismissal of the affidavits
filed against him and for discharge from custody. Having heard the argument and/or testimony
from the parties, the Court found it necessary to continue the matter before making a final ruling.
At such, at this point, no decision regarding dismissal of the charges or the discharge of
Defendant has been made.
Because of the raucous and unprofessional behavior by Mr. Smith, District Attorney, this
matter was continued and is presently reset for preliminary hearing on Thursday, March 17, 2016
at 3:30P.M.
