Collective Bargaining and Unions

Complete the following questions using the Collective Bargaining Agreement from the school
district you are observing. Please cite the page number you located each answer.
1. What school district did you research? Provide the exact web address or link to the
collective bargaining agreement.

2. What is a collective bargaining agreement? What people/groups of people are involved in
the collective bargaining process?
A collective bargaining agreement is a legally binding contract for a specified
period of time between a company or organization and its union represented
employees. It sets rules and limits and defines conditions of employment such as
wages, working hours, overtime, holidays, vacations and benefits as well as the
process for dispute resolution.
3. What are the teachers contracted hours and days (hours/days teachers have to be in the
school building)?
The contracted hours for teachers pre-k through 5th grade are 10 minutes before
the start of school and 10 minutes after the end of school. (10, 11)
4. How much planning a preparation time do teachers in this district get each week (this
may be different at each grade level)? Is any of the time designated for certain activities
(i.e. common grade level plan time, data discussions, etc.)

Each teacher Pre-K-5 will get 25-50 minutes each day for preparation/ break time.

5. What is the current evaluation process for teachers?


The evaluation process with this district has 2 parts: supervision and evaluation.
All formal ovservations of the teaching and learning performance of a teacher will
be conducted openly and with full knowledge of the teacher. All information
regarding the performance of a teacher will be dated, signed and forwarded to the
district office within 15 days of the writing of the document. The administration
will develop a remediation plan for tenured teachers receiving an unsatisfactory
rating. Every tenured teacher will participate in the evaluation phase at least once
every 2 years. (19-20)
6. What does the document say about class size? Is there a limit? What happens if that limit
is exceeded?
Class size is not to exceed 29. If class size exceeds 29 students in each subject, the
board will enact 1 of 2 options; either teachers will be compensated at 1/145th of
the teachers base salary for every student over the limit or assign a classroom
assistant during the time when that subject is taught. (6)
7. What type of mentoring program or training do new teachers go through?
All new hires are required to attend district orientation. I wasnt able to find
anything regarding a mentoring program or new training. (7)

8. Are teachers allotted sick and personal days? If so, how many?

9. What is a grievance and how is the process carried out?


A grievance is any claim by the BEA or a teacher that there has been a violation,
misinterpretation or misapplication of the terms of the contract. (25)
o Step 1: An employee and the principal/immediate supervisor will attempt
to resolve a problem through free and informal communications
o Step 2: If not resolved the employee must present the grievance in writing
within 15 days after the occurrence of the event of the grievance. It must
be presented to the principal who will arrange a meeting within 10 days.
The BEAs rep, principal and the grievant will be present for the meeting.
The principal will provide the grievant with a written answer along with
the reasons the answer was based on within 10 days
o Step 3: If still not resolved, the aggrieved will file a copy of the grievance
with the superintendent within 5 days of the principals written decision.
Within ten 10 days after such written grievance is filed, the aggrieved, the
BEA rep, the principal and the Superintendent or the Superintendents
designee, will meet to resolve the grievance. The Superintendent, or the
Superintendents designee, will file an answer within 10 days of the third
level grievance meeting and communicate it in writing to the teacher and
the principal. (25-26)
10. How are teachers compensated in this district? Please provide the salary of a first year
teacher that holds a Bachelors degree for the 2014-2015 school year? What is the salary
of a teacher with a Masters degree and 15 years experience for the 2014-2015 school
year? Based on the number of days per year required and hours per day required calculate
the hourly rate for both scenarios. Take the number of days multiplied by hours worked
(i.e. 180 days X 7 hours a day = 1,260 hours). Divide the salary by the total hours (i.e.
$48,000 / 1,260 = $38.10/hour). (28)
