to the CPR:
What does it all mean?

What do we mean by CE Marking?


CE marking is a method of identifying those products that
comply with a harmonised European Standard or have a
European Technical Approval.
With effect from 1st July 2013, under
the new Construction Products
Regulation (CPR), virtually all
construction products must carry
the CE mark before they can legally
be sold in Europe.
There are various exceptions. Many new
or innovative products, for instance, fall
outside the scope of current European
Standards/Technical Approvals and
therefore cannot be CE marked.
Where it is applied, CE marking makes it
easy for specifiers, distributors and end
users across Europe to see immediately
that a product has a standard technical
specification and, as the information
and layout is standardised too, it helps
simplify comparisons between products
manufactured in different countries,
encouraging trade.

The CE mark is applied either directly


to a product, its packaging or to its
accompanying documentation.
CE marking, however, does not replace
local Building Regulations. Users in
the UK still need to ensure that a
product complies with any local market
requirements. For example, in addition
to declaring performance in tension
and compression to the European
Standard EN 845 Part 1, cavity wall ties
in England and Wales should also meet
the acoustic requirements of Approved
Document E: Resistance to the passage
of sound.

Europenne, meaning European Conformity.

How does CE Marking work?


CE marking is not new it has been compulsory for a wide
range of everyday products for many years for instance,
toys, machinery and electrical items.
Under the new Construction Products
Regulation, it is mandatory to apply the
mark to a construction product covered
by a harmonised European Standard
or when it conforms to a European
Technical Assessment that has been
issued for it.
To qualify for a CE mark, manufacturers
must undertake several tasks. These
are specific to each product type and
are given in the Standard.
Tasks include:
Testing of each product type
Ensuring the necessary factory
production controls are in place
to guarantee consistency
Publishing a signed Declaration of
Performance (DoP) for each product
Issuing the CE mark with the
product, accompanied by any
essential additional information
In some cases, the tasks must be
undertaken by an approved external
body, rather than the manufacturer.

The Declaration of Performance, also


referred to as an EC Declaration of
Conformity by many current European
Standards, must be readily available
and translated into the language of
the country in which the product is
supplied. A hard copy must be
available on request.
Once the DoP has been completed,
and the CE mark applied, the
manufacturer has a legal responsibility
to ensure the product continues to
conform to the Standard.
Failure to CE mark a product
where required, or to ensure ongoing
conformity, leaves a manufacturer open
to legal action. Products concerned can
be removed from sale by enforcement
agencies e.g. Trading Standards in
the UK.

What Ancon has done to


ensure CE Marking compliance
As a leading manufacturer of steel construction products, with
established sales throughout Europe, Ancon has been working
with CE Marking legislation for many years. In fact, it has been
mandatory in many of our key European markets for some time.
To prepare for its adoption in the UK
and Ireland, where we sell a slightly
different portfolio of products, we
successfully carried out extensive
independent product testing, passed
external audits of our manufacturing
facilities, published the necessary
collection of Declarations (DoPs)
and have applied the CE mark to
all affected Ancon products.

Employees from across the business,


in purchasing, production, engineering,
marketing and sales, worked together
to meet the CE marking deadline, and
have ensured all necessary working
practices, procedures and skills are
in place to achieve and maintain
compliance with all aspects of the
Construction Products Regulations.
Since 1st July 2013, all Ancon
products have carried a CE mark
where required.

Your CE Marking
questions answered
Q: I am a distributor, does CE Marking affect me?
A: You need to be sure that all of the construction products you sell meet

the requirements of the CPR and carry the CE mark where appropriate.
You also need to ensure products are accompanied by the correct
documentation and that relevant additional information is supplied
when requested.

Ancon distributors can be confident that all of our products meet the CPR
requirements and are CE marked where appropriate. You can download
any Declaration of Performance (DoP) and other relevant information from
www.ancon.co.uk/CE.

Q: I am a distributor, what about old stock which does not carry


a CE mark?

A:

Only construction products manufactured after 1st July 2013 are affected.
Stock supplied before this date is unaffected.

Q: I am a contractor, CE Marking doesnt affect me, does it?


A: You need to be satisfied that the products you use meet the requirements
of the CPR, as well as meeting the performance criteria for the project
involved. The project engineers specification should take all this into
account. You should also be aware that if you modify a CE marked
product in any way that may affect the DoP, you effectively become
the manufacturer. You must therefore carry out any necessary testing,
draw up your own Declaration of Performance and ensure continuing
compliance with the Regulation.

All Ancon products are CE marked where required and we offer free
technical support on product suitability. Our DoPs are available from
www.ancon.co.uk/CE. Some Ancon products can be modified on site
to our instructions, without affecting the validity of the CE mark e.g.
AnconOptima masonry support.

Q: I am an engineer, do I need to make any changes


to how I specify products?

A: Product specifications should be amended to include CE marked items

only, where the product is covered by a harmonised European Standard


e.g. masonry support systems, windposts, wall ties and bed joint
reinforcement. A list of harmonised standards is available from NANDO
http://ec.europa.eu/enterprise/newapproach/nando/

By specifying Ancon, engineers are guaranteed CE marked products,


backed by Eurocode designs. Ancon provides technical advice and
specification assistance.

Q: What about Ancon products that are not currently


covered by a harmonised European standard (hEN)
or ETA can I still specify, sell or use them?

A:

Yes, this is completely acceptable.

Ancon holds a number of voluntary, third party approvals for its products
(see page 10). These have similar or sometimes even greater compliance
requirements than CE marking.

We are continuing to monitor the position with regards to new European


Standards, and will publish any changes at www.ancon.co.uk.

carry a voluntary mark from a recognised third party to provide
