CASE STUDY#1
A enters into a contract with B, who is 16 years of age. A
is fully aware of the fact that B has not attained the age of
majority. Later on B commits a fraud & breach the
contract. Has A any right of action against B for his
wrongful act?
Fact of the Case:
By keeping in mind the one of the essential element of contract

X asks Y to commit murder of Z for an amount of
Rs.50000/-. Y murders Z and then asks X to fulfill his
commitment of payment but X denies doing so. Can Y file
a case against X in the court & can court compel him to
complete his contract or can court punish him for the
breach of contract?
Fact of the Case:
A contract is one who has the legal enforceability and this kind of
dealing
is
not
considered
as
contract
as
Contract
need
Lawful
consideration that is for bidden by law and doesnt involve any injury to
the third party. So Y cant case a file against X because this type of contract
doesnt have any legal authority to take lawful action.
Judgment:
We cannot use the word Contract in this scenario because contract needs
lawful consideration and legal enforceability which do not exist in this scenario.
We cannot harm anyone in the behalf of any payment or job done and for the
negligence of this dealing the party is not allowed to drag other party to the court
because our law is not giving permission for this kind of actions.
