    Irom Sharmila was acquitted of attempted suicide charges from 2006 when she began a hunger strike demanding the repeal of the Armed Forces Special Powers Act (AFSPA) in Manipur. AFSPA grants special powers to armed forces in disturbed areas, including immunity from prosecution. It was enacted in 1958 for areas in northeast India and later extended to Jammu and Kashmir in 1990. While some parts of Manipur had the Act withdrawn in 2004 against the central government's wishes, a state or central government can declare an area disturbed, a decision that cannot be challenged in court.

    AfteranareacomesundertheambitofAFSPA,anycommissionedofficer,warrantofficer,non
    commissionedofficeroranotherpersonofequivalentrankcanuseforceforavarietyofreasons
    whilestillbeingimmunetotheprosecution.
    Ambit:
    Theactwaspassedon11September1958bytheparliamentofIndiatoprovidespeciallegal
    securitytothearmedforcescarryingoutoperationsinthetroubledareasofArunachal
    Pradesh,Assam,Meghalaya,Manipur,Mizoram,Nagaland,Tripura(sevensisters).
    In1990theactwasextendedtothestateofJammuandKashmirtoconfronttherising
    insurgencyinthearea.
    InManipur,despiteoppositionfromtheCentralgovernment,stategovernmentwithdrewthe
    ActinsomepartsinAug,2004.
    ThegovernmentcandeclareAFSPAinthefollowingconditions:
    Whenthelocaladministrationfailstodealwithlocalissuesandthepoliceprovesinefficientto
    copewiththem.
    Whenthescaleofunrestorinstabilityinthestateistoolargeforthepolicetohandle.
    However,thedecisionofthegovernmenttodeclareaparticularareadisturbedcannotbe
    challengedinacourtoflaw.
