Furniture’ 12014-15 dated 21.08.2014. Rate Contract shall be exclusively Operated by MSSIDC As per Annexure “C”. Steel Furniture with Spray Paint ‘Whole of Maharashtra 100% Rate Contract is to be Exclusively operated by MSSIDC through the individual Rate Contract holder unit as per terms and conditions of the Rate Contract. From 21.08.2014 to 30.06.2015 ‘As per Annexure “A” ‘As per Annexure “B” Page 6 of 118 A) o E) F Oassinc Rates : The rates shall remain fixed & firm during the currency of the contract and inclusive of free delivery of stores at consignee stores / site anywhere in Maharashtra, Value Added Tax (MVAT), Excise Duty, Transit Insurance, Loading and Unloading Charges, Stacking of Goods at consignee’s stores / site, inspection charges excluding octroi charges, LBT and local levies. c 1B) u Octroi charges, LBT Charges and local levies at actual shall be reimbursed by the consignees who are not entitled to issue Octroi Exemption Certificate and ‘exemption, LBT exemption and exemption from local levies. Distribution of the Order: Orders shall be distributed as per the guidelines given by the Store Purchase Committee. Pre Dispatch Inspection : No goods shall be delivered unless the same are inspected and approved and released by the inspection Authority i.e. Govt. Engineering Colleges / Govt. Polytechnic or any other inspecting agency nominated by MSSIDC Ltd. the Inspection charges shall be borne by the RC Holder Unit. Inspection Procedure: Rigid inspection of stores shall be carried out by the Inspecting Agency at the Rate Contract holders’ Factory premises strictly in accordance with the specification and drawings of the items covered under Rate Contract. inspecting Authority shall ensure that the items are strictly as per drawings and specification of each items, without which the stores should not be approved. ‘Stamping and Releasing : (On final acceptance of the stores, the inspection authorities shall stamp the goods clearly by means of steel or rubber stamp. The position where inspection seal is stamped on the furniture item shall be indicated in the inspection report by the inspection authority. Furniture items shall be considered valid for release only after they are stamped and inspection-cum- releage note is issued accordingly. The format of Inspection Report is as per Annexure - E. Page 7 of 118 6) H) » J) q Oabsinc Ider mn Steel Furniture shall be embossed at front side, at lower position of pariel, but in no case embossing shall be done at under side of the top or bottom of the product. The embossing shall include =~ MSSIDC/. L (Financial year of supply) Manufacturers name ) i.e Steel Furniture supplied by M/s. YYY in the month of March 2014 shall be embossed as follows : “ MSSIDC/2013-14/Mis. YYY Le. 2) Stee! Furniture supplied by YYY in the month of Juty, 2013 shall be embossed as follows : ‘MSSIDC/2013-14/Mis. YYY. The product delivered without marking on the product as above, will not considered as delivered and payment will not be made. Delivery of stores: Steel Furniture shall be delivered to the consignee only after i's inspection and approval. The date of offer of stores for inspection made by the contractor shall be taken as the date of delivery of material for the purpose of considering delivery period provided inspection call letter is sent at least 10 days in advance of the expiry of the delivery period and acknowledgement is obtained. The delivery of stores will be completed within 18 days from the date of inspection call letter. Delivery period : Delivery period will depend upon the magnitude of the ordered quantity & shall be decided mutually. However, the indenter shall therefore, indicate the delivery period, giving minimum, period of 30 days for small order upto Rs. 50,000/- and maximum period of 90 days for high value orders. The tenderer shall ensure that the delivery of stores is completed within this period. nt Terms: ‘The Consigneefindenter is required to release 90% payment of the stores within 10 days from the date of receipt of stores and balance 10% within 20 days thereafter. Payment: As per the Section 16 of the Micro, Small & Medium Enterprise Development Act, 2006, “Where any supplier supplies any goods or renders any services to any buyer, the buyer shall make payment therefore on or before the date agreed upon between him and the supplier in writing or, where there is no agreement in this behalf, before the appointed day. Provided that in no case the period agreed upon between the supplier and the buyer in yrriting shall Page 8 of 118 kK) uy Oxussinc exceed forty-five days from the date of acceptance or the day of deemed acceptance. ‘As such under no circumstances, the Govt. consignee shall not delay the payment due to MSSIDC beyond 45 days or earlier as agreed to while placing the order. MSSIDC being a nodal agency nominated by the Govt. of Maharashira to operate the Rate Contract vide its GR dated 02/01/1992, it may please be noted that the indenter / consignee who are the ultimate beneficiary and actual consumer of the stores shall only be solely responsible for the interest on delayed payment beyond the stipulated 45 days or earlier as agreed to as referred to above.- The consignor unit shall not raise any interest claim on the Corporation Q7 ot Ce Stores covered in this Rate Contract shall be procured only from MSSIDC as per the terms & conditions of the Rate Contract and no direct purchase of the same shall be made outside this contract. Placement of Orders by the Consignee / Indentor : a) Indenters / Consignees are requested to ensure that orders for the above mentioned stores are placed only with MSSIDC in accordance with terms & conditions of this Rate Contract and the above mentioned stores should not be procured delivery by inviting tenders, While placing the orders, consignees / Indenters should ensure that requisite funds are available with them and they should confirm about the same in writing. b) Indenters / Consignees are requested to place the orders with the Divisional /Branch Offices of the MSSIDC Ltd. at the address mentioned in Annexure ‘D” In case of any problem / difficulty, Indenters / Consignees are advised to refer the matter to the concerned Divisional Managers, MSSIDC who shall ensure early action in the matter. In addition to the above, this Rate Contract is also Governed by General Terms & Conditions mentioned hereinafter. Page 9 of 118 1) 3 4) Oassipic & Conditions of t ‘The Rate Contract is to be exclusively operated by MSSIDC through the Rate Contract Holder. Delivery of Stores: a. The’stores ordered under the Rate Contract should be dispatched by the Rate Contract holder to the indenter / consignee as stipulated in the Rate schedule only afer its due inspection and approval by the nominated inspection agency or consignee representative as the case may be. Copy of the inspection report should be furnished to the consignee / indenter along with the stores. b. Date of offer of stores for inspection made by the Rate Contract holder in writing shall be taken as date of delivery of material for the purpose of considering delivery period subject to the conditions that ’) Inspection call letter is sent along with inspection fee and acknowledgement obtained thereon; (fee not required for consignee inspection). ii) Delivery of the stores is completed within 15 days from the date of inspection . Quality Assurance : The Rate Contract holier has guaranteed to supply the best quality of stores as specified in the contract and also undertaken to replace / repair defective stores at his risk and cost within period of three months. MSSIDC Divisional Office shall ensure compliance of the same. Monitoring of the Stores : MSSIDC shall maintain proper record of the orders received and executed and factual position should be furnished to concemed indenter / consignee every quarter. Delivery Performance : a) If the Rate Contract holder fails to supply the stores within the delivery schedule further orders shall not be placed with him till such time pending orders are serviced. b) The Rate Contract holder shall also make himself liable for getting himself disqualified for further orders if he falls to adhere to the quality as welll as delivery schedule, and orders in hand shall be cancelled at contractor's risk and cost. Page 10 of 118 8) 7 8) 9 Oassipc Recovery of Dues : Whenever any claim arises for the payment by reason of default by the RC Holder, MSSIDC shall be entitled to recover such amount by appropriating (in whole or part) any amount retained by MSSIDC on behaff of the RC Holder and / or any amount due to the RC Holder from any of the Govt. / Semi Govt. consignee on any account whatsoever. If such appropriated sum is no sufficient to cover the full amount recoverable / due from the RC Holder, Rate Contract Holder shall on demand pay to the MSSIDC the balance amount due. Fall Clause : It is condition of the contract that all through the currency of the rate contract with MSSIDC, the Rate at which rate contract holder would supply the stores to any customer shatl not be lower than the rate contract rate and in case the stores are supplied by the rate contract holder at lower rate ( lower than the Rate Contract rate), all subsequent supplies made to MSSIDC under the Rate Contract will be deemed to have been made at such lower price charged by the RC Holder fo others and he shall be paid accordingly at such lower price. it shall be mandatory on the part of Rate Contract holder to promptly furnish such information in writing to MSSIDC and obtain acknowledgement thereof. Falling which it shall be deemed to be breach of Rate Contract and RC Holder shall make himself jiable for the action as may be deemed necessary including debarment from the existing contract and participation in future Rate Contracts for such period as may be decided by MSSIDC. Applicable as per tender condition. Liquidated Damages : In case the RC Holder fails to delivery the stores of any consignment thereof, within the contracted period of delivery or in case the stores are found not in accordance with the prescribed specifications and / ot approved sample, the MSSIDG shall exercise its discretionary power either — To recover ‘from the Rate Contract holder as liquidated damages sum equivalent to 14% of the price of the undelivered stores at the stipulated rate for each week or part thereof during which the delivery of such stores may be delayed subject fo a maximum limit in the case of any order not exceeding Rs.1 lakh in value of 10% and the case of an order exceeding Rs. 1 lakh in value of 5% of the stipulated price of the stores so ‘ undelivered’. The MSSIDC shall be entitled to deduct / recover the amount of liquidated damages from current bill payable to the Rate Contract holder or any other amount due and payable to him against this or any other contract from MSSIDC or from any of the Govt. / Semi Govt. consignee. Page 11 of 118 10) 41) 12) 13) Oassipic OR To cancel the contract and to purchase elsewhere on Rate Contract Holder's account the stores so undelivered at the risk and cost of the Rate Contract holder, in addition to this, to take any other action as may be deemed necessary including blacklisting of the Rate Contract Holder, forfeiture of Security Deposit, etc. lic -ontract : The Rate Contract is valid for the period indicated in the schedule and same is extendable for a maximum period of two months. The Rate contract shall be operated within first extended period at the rate of this rate contrat or at the rate of new rate contract to be finilised for the year 2015-16, which is lower. The other terms conditions of the contract remain same. ‘Supply of Stores : The indenter / consignee shall place the order only with MSSIDC. Consignee ! Indenter shall not place any order directly with Rate Contract holder and stores shall be supplied to the consignee / indenter by MSSIDC through Rate Contract holder. Acceptance of Order: ‘On awarding the Rate Contract, the Contractor is required to supply the stores only through MSSIDC LTD. The Contractor afso confirms and agrees that he will neither undertake nor supply directly the tendered stores to any of the indenting deptts. The Contractor further undertakes and confirms that he will not quote lower rates to any of the Central of State Govt. / Semi Govt. organization, undertakings, etc. than the rates of Rate Contract accepted by the Contractor. Despite this commitment and undertaking, if it is observed and noticed that without the prior knowledge and approval of the corporation, the Contractor has quoted the lower rates for the supply of stores, then the Contractor is liable for penal action as the Corporation may deem it fit and necessary, including cancellation of the contractor's Marketing Assistance Scheme. Hol Gi Z ‘As specified in the tender, it is a specific condition of the contract that the Rate Contract Holder shall posses the necessary plant and machinery of the requisite capacity and testing equipment facilities for manufacture and testing of the entire quantity of goods as specified Rate Contract Holder shall manufacture the same himself in the factory for executing of the orders under this contract. Page 12 of 118 44} 15) 18) 7 18) Oassinc Jsguance of Octroi,LBT, Local Levies Exemption Certificate : Consignees / indenters are requested to issue Octroi, LBT, Local Levies Exemption Certificate wherever applicable separately bill-wise to MSSIDC on receipt of intimation regarding distribution of the orders from MSSIDC. -Drawal of Stores : Drawal of Quantity of stores against this Rate Contract is not guaranteed not binding on MSSIDC. ‘Security Deposit : Tenders accepting the Letter of intent and signing the agreement with MSSIDC are awarded the contract subject to the condition that such tenderers shall pay requisite security deposit immediately after awarding the contract failing which such Rate Contract Holders will not be considered for placement of orders. Contrac x While MSSIDG and consignees are governed by the terms of this contract, Rate Contract Holders are bound by the tender terms, conditions stipulated in the Letter of Intent, terms of agreement signed with MSSIDC as also terms of this contract. Eligibility : Names of the tenderer units indicated in the enclosed Annexure- C is only an indicative list of eligible tenderer units participated in the tender. Such tenderer unit shall be deemed to be eligible Rate Contract holder only after it fulfills terms and conditions of the tender / contract. No tenderer unit is, therefore, deemed to be a Rate Contract holder unit merely by virtue of its name appearing in the Annexure attached to this Rate Contract. The clearance around the door between the door flanges and side top and bottom flanges, shall not be more than 1.25 mm. 10.Left Door This shall be similarly constructed as the right door and hinged to the left side of the cabinet. 11, Pedestal ‘The two pedestals shall be made from mild steel sheet not less than 1.00 mm thick and shalt be properly stiffened. The Pedestal shall not project out of the cabinet and shall be 425 _+- 5mm in height. 72. Hinges ‘The hinges shall be either plain butt type made from mild steel not fess than 1.6 mm thick or double folded fabricated from mild steel sheet not less than 1.25mm thick. The hinges shall be. secured to the mild steel hing bracket not less than 2.5 mm thick on one side and shall be secured to the door on the other side of the fulcrum.The number of hinges per door leaf shall be not less than two for small size and not less than three for jarge size. 13. Color 4) Stoving Enamel Spray Paint All dents, burrs and sharp edges shall be removed from the various components. The components shall be individually pickled, scrubbed and rinsed to remove grease, rust, scale or any other foreign element. The finish shall be smooth and uniform with hard tough filling of enamel strongly adhering to the surface. The finish shall be free from all visible defects and shall not chip when tapped lightly with dull pointed instrument. All components shall be finished in silver gray / T.A. gray / olive green / any color as per choice of the consignee. Shall be applied/painted and baked upto 80 to 120 centigrades. The overall dimension should not vary by more than + - 5 mm. 2) Epoxy Polyester Powder Coated All the metal parts should be coated with “epoxy polyester powder of silver gray or “T. A.” grey or any other shade with as per choice of consignee. Coated layar should be minimum 50 microns. All metal parts should be thoroughly in house pretreated by. individual hot deep tank process, including degreasing, pickling, . give coating conforming to IS 3618 — 1966 class C. The treated material should be then coated with epoxy polyester powder minimum §0 micron thickness (+ / - 0.5%) and oven backed at 180 to 200 centigrade. All these process must be done in-house only. VERTICAL SUPPORTS : The two vertical supports of the Bunker Bed shall be made out of 38 mm dia tubular pipe of 1.6 mm wall thickness.
