Incorporating Mezzanines in 3 Story Limit


The existing three- (3) story limit will remain for all buildings Special exception relief from the
thirty-five foot (35 ft.) height limitation will be available provided that certain conditions are
met. ( 400.23) The definition of "mezzanine" will also be amended to provide that in an R-4
Zone District a mezzanine will be considered a story in determining the maximum number of
permitted stories within a principal structure, but not for an accessory building (pg 2)
Mezzanine- a floor space y,pthin a story between its floor and the fioor or roof next above It
and having an area of not more than one-third (1/3) of the area of the floor immediately below
Except in an R -4 Zone District, a mezzanine shall not be considered a story in determining the
maximum number of permitted stones. In an R -4 Zone District, a mezzanine shall be
considered a story in determining the maximum number of permitted stones within a principal
structure but shall not be considered a story in determining the maximum number of permitted
stories within an accessory budding (pg 12)
400.23 In an R-4 Zone District, a building or other structure may be erected to a height not

exceeding forty feet ( 40ft.) If approved by the Board of Zoning Adjustment as a special
exception, under 3104, subject to the following conditions, except that if the building is being
converted to an apartment house, special exception relief from the thirty-five foot (35ft) height
limitation is only available pursuant to 336 or 337 as applicable. (pg 18)
