Building Design - Per our counter meeting last week, the new buildign design addresses your concerns
regarding the blank facade and lack of pedestrian retail activity on 15th street. A copy of the drawings are
attached for reference
CEQA scope - Lamphier and Gregory has sent the proposed CEQA scope for review
CUP Exemption Letter - Our land use attorney has sent a letter to you for review by the city attorney outlining
why we believe the density bonus law would exempt us from the CUP process.

This form must be submitted with all Planning and Zoning applications for projects defined as Regulated Projects by Provision C.3 of the
Municipal Regional Stormwater Permit issued under the National Pollutant Discharge Elimination System (NPDES). Regulated Projects are:
Projects that create or replace 10,000 square feet or more of new or existing impervious surface area; and
Since December 1, 2011, the following projects that create or replace 5,000 square feet or more of new or impervious surface area:
o Auto servicing, auto repair, and gas stations;
o Restaurants (full service, limited service, and fast-food); and
o Uncovered parking lots (including stand-alone parking lots, parking lots serving an activity, and uncovered portions of parking structures
unless drainage from the uncovered portion of the parking structure is connected to the sanitary sewer system).

LID treatment measures are rainwater harvesting, infiltration, evapotranspiration, and biotreatment (which are further discussed on
page 6). Non-LID treatment measures include high flowrate tree well filters and mechanical vault-type media filters. Non-LID
treatment measures are only allowed for Special Projects as defined by Provision C.3. This section of the form will determine if the

water evaporating into the air directly or through plants. Biotreatment is stormwater treatment to remove pollutants using biological processes.

HYDROMODIFICATION SUSCEPTIBILITY MAP
Map Instructions
Use the map on the following pages to determine if the project is located in a susceptible area. The map is
divided into three areas:
High Susceptibility Area (Light Grey) This area generally consists of steep slopes. Applicable projects
in this area are required to incorporate hydromodification management measures.
Potential Susceptibility Area (White) This area is located between the hills and the tidal zone of San
Francisco Bay. This area may be susceptible to hydromodification depending upon the nature of the
drainage system. Applicable projects in this area are required to incorporate hydromodification
management measures unless project stormwater runoff will flow through fully hardened, engineered
channels from the project site to the tidal zone. If stormwater runoff from the project site will flow
through a natural creek or stream (shown as a thick black line on the map), hydromodification
management measures are required.
Tidal Influence / Depositional Area (Dark Grey) This area is located in the tidal zone of San Francisco
Bay. Creeks in this area are generally tidally influenced or primarily depositional. Projects in this area are
exempt from hydromodification management measures.

per dwelling unit, with 69.8% to be located on the uppermost roof. The
remainder of the open space (30.2%) would be provided on the podium
roof. The concession would result in identifiable, financially sufficient,
and actual cost reductions.
To be able to provide the code required open space while also providing
all the required building systems (elevators, stair, mechanical, etc.), the
project would have to construct cantilevered balconies. The minimum
usable balcony area is around 35 SF (5-0 x 7-0) and each balcony is
private open space so it is equivalent to 70 SF of group open space.
[17.126.020] To meet code, the project would need to provide roughly
41 balconies at a unit cost of $22,500 each and a total project cost of
$922,500. A concession to reduce the open space requirement from 75
SF per dwelling unit to 50SF per dwelling unit would result in an
"identifiable, financially sufficient and actual cost reduction of
$922,500.
Development Standard Waiver Request 1: Height
As noted above, in addition to one concession or incentive, state and local
law requires the city to waive development standards that would
physically preclude the construction of the building with the density
bonus. The applicants first request is for a waiver from the 85-0
maximum building height limit applicable to the lot at 359 15th Street to a
maximum building height of 292-0. (There is no height limit
applicable to the lot at 1433 Webster.) If the height waiver is not granted,
the project would be physically precluded from building the additional 30
units allowed from the 20% density bonus.
If the maximum building height over 359 15th Street is not waived, the
residential tower at 1433 Webster Street (where there is no height limit)
would need to be increased 25% in height to accommodate the 30
additional units. In a traditional building, the concrete or steel structural
system could be upsized to handle the increased structural loading from a
taller building. However, to keep the costs down and the units therefore
more affordable, this project is proposed to be assembled out of factory
built modules and does not have a traditional site built concrete or steel
super structure. The structural system for the modules are load bearing
walls constructed out of cold form metal framing, which has a lower
structural capacity than a steel or concrete frame. The additional 25%

height would impose a load beyond the capacity of cold form metal
framing bearing walls on the modules.
Development Standard Waiver Request 2: Loading Dock
The proposed project is requesting a waiver from the development standard
requiring 2 loading bays and proposes to provide a single loading bay on
the ground floor. The ground floor of the tower contains multiple essential
building functions that require immediate adjacency to the street level. The
ground floor retail occupies 100% of the 15th street frontage and 25% of the
Webster Street frontage in order to satisfy the City of Oakland planning
design guidelines for the
CBD-P zoning. The building lobby, leasing office, exit stair, driveway and
main electrical room would require 65% of the street frontage. All of these
program elements are essential to the operation of the building and have
minimum dimensions to function properly. The remaining 10% of street
frontage can accommodate a single loading space. If a second loading
space is required, the retail space is the one element that can be reduced
without affecting overall building performance, but would require
relocation of the main electrical to the 15th Street front which would result
in additional nonconformity with the planning design guidelines.
