Powell, pursuant to MCR 6.125, and in support of her Motions states: 1. Defendant is currently charged with one count of Open Murder; One count of Home Invasion 2" Degree; One count of Conspiracy to Commit Dead Bodies— Disinterment & Mutilation; One count of Concealing the Death of an Individual; One county of Lying to a Police Officer—Violent Crime Investigation; and One count of Accessory after the fact to a felony. 2. Defendant has an alleged prior mental health history including but not limited to a ‘voluntary admission to a psychiatric unit in Indiana from April 18""-22", 2016 at St. Mary Medical Center in Hobart, Indiana and St. Catherine Hospital in East Chicago, Indiana which are both under the auspices of Hobart, Indiana Community Healthcare System,3. Upon information and belief Defendant has had suicidal ideations, has written her family goodbye letters, and has threatened to commit suicide while incarcerated as well as threatened bodily harm against any persons whom she may have contact with while incarcerated. Defendant has furthermore made shanks out of her glasses while incarcerated in the Graves County, Kentucky jail, 4, Defendant furthermore has claimed a level of participation in the death of Chris Regan that the People believe amount to First Degree Murder and is currently being investigated in Lake County, Illinois for the death of her husband Jason Cochran. In addition, defendant has claimed responsibility for the death of other individuals which would, if true, make her a serial Killer. 5. Cochran was appointed a public defender conceming her extradition proceedings, but waived his services while incarcerated on our warrant in Graves County, Kentucky. 6. Based on Defendants alleged psychiatric history, the contents of the current police report, Defendants recent alleged suicidal and homicidal ideations and the recent waiver of counsel, the Prosecution believes Defendant’s ability at the time of the alleged offense in this case to appreciate the nature or quality or the wrongfulness of her actions or to conform her conduct to the requirements of the law needs to be assessed as well as her competency to stand trial.
