General conditions of sale
Le presenti condizioni generali di vendita annullano e sostituiscono le precedenti. Verranno

applicate a tutte le ordinazioni pervenuteci dopo la data di emissione del presente listino.
Saranno valide anche per tutti gli affari futuri, anche se non viene fatto specifico riferimento a
queste condizioni di vendita. Potranno essere soggette a cambiamento senza alcun preavviso, e
si intendono integralmente accettate con il conferimento dellordine.
The general conditions of sale contained herewith cancel all previous ones. They will be applied
to all orders received after the date of issue of this price list. They will also be considered
valid for all future deals, even if no specific reference is made to them. They may be subject
to change without previous notice and are intended to be integrally accepted with the order
confirmation.
1.
PREZZI: I prezzi del presente listino si intendono IVA esclusa, e potranno subire aumenti,
qualora, nel periodo intercorrente tra la nostra offerta o accettazione di un ordine, e la
consegna , si verifichino rincari delle materie prime, della manodopera, dei trasporti, dei
premi di assicurazione, etc.
1.
PRICES: The prices contained in this price list do not include VAT and may be subject to
increase if, during the period between our quotation or the acceptance of an order and
delivery, there are increases in price of raw materials, labour costs, transport, insurance
fees, etc.
2.
ORDINI: Gli ordini conferiti a nostri Agenti o Rappresentanti o direttamente inviati dai
committenti, sono definitivi solo quando regolarmente accettati con nostra conferma
dordine, che, in mancanza di un immediato riscontro, si riterr confermata in ogni sua
parte.
2.
ORDERS: The orders given to our agents or Representatives or sent directly to us by

the buyers are final only when duly accepted by our confirmation order, which we will
regard as being confirmed in all its parts in the absence of an immediate reply on your
part.
3.
DIRITTI FISSI: Gli ordini di importo netto inferiore a 130 , saranno gravati di un Diritto
fisso di 10 .
3.
FIXED RIGHTS: The orders amounting to a net cost lower than 130 will be increased by
a Fixed right of 10 .
4.
PAGAMENTI: Per ordini di importo netto inferiore a 500 il termine di pagamento sar
sempre e comunque a 60 gg fine mese data fattura
4.
PAYMENTS: For orders amounting to a net cost lower than 500 , the payment terms will, in
any case, always be 60 days from the end of the month in which the invoice was issued.
5.
CONFEZIONI: Per sveltire i tempi di consegna e facilitare al cliente lo stoccaggio dei

nostri prodotti, nostra facolt ricondurre le quantit ordinate a multipli delle confezioni
standard (indicate nelle relative colonne sui nostri listini).
5.
PACKAGES: In order to quicken delivery and facilitate the customers storage of our
products, we can provide the ordered quantities in multiples of the standard packages,
indicated in the respective columns in our price list.
6.
RESA: La merce intesa franco nostro magazzino di Francofonte.
6.
PROVISION: The goods are intended ex warehouse from our premises of Francofonte.
7.
PRESCRIZIONI: Il committente deve informare la nostra sede sullesistenza di prescrizioni

legali o di altra natura esistenti al luogo di destinazione, inerenti lesecuzione della
fornitura, e il rispetto delle norme di sicurezza e/o di omologazione.
7.
PRESCRIPTIONS: The buyer must inform our offices if there are any legal prescriptions
or any other kind of limitations at the place of destination concerning the fulfilment of the
supply and compliance with safety and/or type-approval regulations.
8.
SPEDIZIONI: Salvo accordi diversi, le spedizioni vengono effettuate in Porto Assegnato

a mezzo corriere, o col mezzo da noi ritenuto pi conveniente. La merce viaggia a rischio
e pericolo del Committente. Leventuale copertura assicurativa contro qualsiasi tipo di
danno, se richiesta, a carico del compratore.
8.
CONSIGNMENT: Unless otherwise agreed on, delivery will be carried out Carriage
Forward by courier or with the means we deem to be the most convenient. The goods
travel at the risk of the buyer. Insurance coverage against any kind of damage, if requested,
is charged to the buyer.
9.
IMBALLI: Normalmente gratis. Imballi particolari, se richiesti, verranno addebitati al

costo.

PACKAGING: Normally free. If particular packing is required, it will be added to the

cost.
10.
TERMINI DI CONSEGNA: I termini di consegna non sono vincolanti ma semplicemente

indicativi ed approssimativi. In ogni caso i termini di consegna iniziano a decorrere
solo dal momento successivo alla effettiva conclusione del contratto di vendita. Essi
potranno comunque subire degli slittamenti a causa di guasti e/o imprevisti agli impianti,
indisponibilit di materie prime e/o di qualunque altro evento non prevedibile e non
governabile dalla Plast Project. E facolt del venditore evadere lordine in pi riprese.
10.
DELIVERY TERMS: Delivery terms are not binding but simply indicative and approximate.
In any case, the delivery terms are effective only from the moment following the actual
conclusion of the sale contract. Nevertheless, delivery terms may be subject to review due
to breakdowns and/or unforeseen delays at the factory and/or lack of the supply of the raw
materials and/or any other event that cannot be foreseen or controlled by Plast Project.
The seller has the right to fill the order in multiple supplies.
11.
SALDI: Gli eventuali saldi degli ordini saranno spediti appena disponibili, salvo diverse
disposizioni da parte del committente.
11.
PENDING PARTS OF ORDERS: Pending parts of orders will be delivered as soon as they
are available, unless otherwise instructed by the buyer.
12.
PAGAMENTI: I pagamenti debbono essere fatti a nostro domicilio. Laccettazione di

cambiali o nostra tratta non costituiscono deroga al luogo e/o ai termini del pagamento.
Trascorsi i termini di scadenza stabiliti per le condizioni di pagamento decorreranno gli
interessi bancari, secondo il tasso ufficiale di sconto maggiorato del 4%, oltre al rimborso
delle ulteriori maggiori spese. Per le forniture allestero i pagamenti debbono essere
effettuati mediante apertura di credito irrevocabile.
12.
PAYMENT CONDITIONS: All payments must be made to our offices. The acceptance of
bills of exchange or our draft do not constitute an exception to the place and/or terms of
payment. After expiry of the payment deadlines, bank interests will be applied, according
to the official minimum lending rate plus 4%, together with the refund of all extra expenses.
For supplies abroad, payments must be made through the opening of an irrevocable letter
of credit.
13.
RISERVA DI PROPRIETA: La merce fornita rimane propriet di Plast Project S.r.l. fino a
che il committente abbia adempito al completo pagamento di essa. In caso di alienazione
da parte del committente di merce sotto riserva di propriet, egli cede fin da subito e fino
al pagamento totale del dovuto alla Plast Project S.r.l. tutti i diritti che gli risultassero da
detta vendita, compresi tutti i diritti accessori, garanzie e riserve di propriet.
13.
RESERVE OF PROPERTY: The goods we provide will remain property of Plast Project
S.r.l. until the buyer has paid in full. If the buyer sells the goods covered by reserve of
property, he immediately, and up to payment in full of what is owed to Plast Project S.r.l.,
yields all the rights reserved from the sale, including all the additional rights, guarantees
and reserves of property.
14.
CARATTERISTICHE TECNICHE: I documenti tecnici quali illustrazioni, disegni,

descrizioni, figure, indicazioni sulle propriet fisiche, dimensioni o peso, cos come
riferimenti a delle norme, hanno titolo puramente indicativo e non sono vincolanti. La Plast
Project S.r.l. si riserva il diritto, anche senza preavviso, quando opportuno, di effettuare
modifiche ai prodotti, ai fini del loro miglioramento tecnico.
14.
TECHNICAL CHARACTERISTICS: All technical documents, such as illustrations,

drawings, descriptions, information regarding the physical characteristics, dimensions or
weight, as well as all references to regulations, are just an indication and are not binding.
Plast Project S.r.l. has the right to make changes to the products, if necessary, even without
prior notice, in order to improve them technically.
15.
RECLAMI: Eventuali reclami concernenti la quantit e/o lo stato generale della merce
dovranno pervenire entro 15 giorni dalla data di ricevimento o consegna di essa, tramite
raccomandata r.r. o fax, trascorsi i quali decadr ogni diritto. Anche in caso di reclamo
validamente proposto, lacquirente tenuto a pagare limporto alla scadenza della
fattura. Prima di aver effettuato tale pagamento egli non pu proporre, neppure in via di
eccezione tutte le azioni che potessero competergli nei confronti della Plast Project. La
comunicazione di difetti di altro tipo dovr invece essere fatta entro i rispettivi limiti dei
termini di garanzia prestabiliti.
15.
COMPLAINTS: All complaints concerning the quality and/or the general conditions of the
goods must reach us within 15 days from the date of receipt or consignment of the goods,
by express post with acknowledgement of receipt or by fax; after this term, every right
will expire. Even in the case of a valid proposed claim, the buyer shall pay the amount
stated on the invoice on the date of expiry. Actions against Plast Project cannot be brought
forward before having paid in full, even in exceptional cases. Instead, reports of other
types of defects shall be made within the respective limits of the pre-established warranty
conditions.
16.
RESI: Non si accettano resi di merce se non da noi autorizzati, che dovranno pervenirci in
porto franco. I materiali resi verranno accettati solo se in ottime condizioni, e negli imballi
originali.
16.
RETURNS: No return of goods is accepted if not authorised by us and will, in any case,
be carriage free. All returned materials will be accepted only if in good condition and in the
original packing.
17.
GARANZIA: Il nostro materiale si intende garantito per i guasti dovuti a difetti di

fabbricazione a noi imputabili.
La garanzia decade qualora:
Sia trascorso pi di un anno dalla consegna della merce.
La merce sia stata modificata o manomessa.
Sono esclusi dalla garanzia danni dovuti ad usura naturale, immagazzinamento o

manutenzione non adeguati, utilizzo al di fuori delle condizioni di esercizio da noi indicate.

WARRANTY: Our material is guaranteed against faults due to manufacturing defects that
are our responsibility.
The warranty is void if:
More than one year has passed since the consignment of the goods.
The material has been in any case modified or tampered with.
All damage due to natural wear, inadequate storage or maintenance, use beyond
the conditions we have indicated is not covered by the warranty.
La nostra garanzia si limita alla sostituzione dei prodotti difettosi o alla loro riparazione
nella nostra sede, con lesclusione di indennizzi o riconoscimenti di ogni tipo per danni
arrecati a persone o cose, in dipendenza delluso della merce da noi fornita, per cause
imputabili a difetto di costruzione e/o di materiali impiegati, per vizi occulti, per utilizzo
improprio.

FORO COMPETENTE: Per ogni eventuale controversia o contestazione, competente in

via esclusiva il Foro di Siracusa.
Nessuna altra condizione di vendita sar ritenuta valida se non da noi espressamente
autorizzata.

Our warranty is limited to the replacement of defective products or their repair at our
premises, with the exclusion of any kind of compensation or recognition of harm
caused to people or things due to the use of goods we have supplied, for reasons due to
manufacturing defects and/or to the materials used, for hidden defects and for improper
use.

JURISDICTION: All controversies or disputes fall under the exclusive jurisdiction of the
court of Siracusa, Italy.
No other condition will be considered valid if not expressly authorised by us.
