 Supreme Court steps in and decides whether a case is constitutional or not
 First implemented in Marbury v. Madison case in 1803, reveals the power of the Supreme
Court
 2 schools of thought in how to interpret the constitution
 Contstructionalist
 school of thought where those who believe in a more literal interpretation of the
Constitution
 act with judicial restraint
 jurisprudence of original intent- what the founders actually intended
 Activist
 act with judicial activism
 “we interpret this document in the best way we can, and try to interpret the framers views
from the time, but we must think of what the words of the text mean in our time”
 The genius of the Constitution doesn’t have the static meaning from a time that is long
gone, but it deals with current needs
