ALCON,

I regret to inform you, but we are going to have to postpone the pre-con meeting as the contractor has
failed to validate the requested information from the comments that were generated by each of our
respective reviewers and the teleconference transpiring Thursday of last week.

During the review process, many parts of the Plans and Specifications (P/S) omitted critical elements
necessary to allow our USACE and M Baker Engineers to effectively evaluate the intended designs
presented by Tetra Tech. These included, omitting information pertaining to hydraulic studies, welding
design/data, geotechnical information, improperly edited information, and other discrepancies. Some of
the omissions were more significant than others, but would NOT allow us to issue for clearance for
construction and ensure that the fence would meet the operational needs of the CBP.

As such, I have prepared a Serial Letter (signed by the Contracting Officer) instructing the contractor to
develop a remediation plan to position ourselves to get the project back on schedule, within the
contract completion date. The remediation plan will outline the details, milestones and
personnel/resources required to commence construction at the earliest practical moment. The
contractor shall have until Thursday of next week to develop a detailed plan outlining the requirements.

In addition, we had originally planned to conduct a pre-con meeting for I-1A on the 16th of January.
However, in light of the comments that were generated during the review of J1/J3, the design package
will obviously contain identical or many similar problems. Therefore, we'll postpone this meeting until
our reviewers have adequate information to determine that they have complied with the contract
requirements and it'll meet the operational needs of the CBP.

I apologize for the delay and will keep you advised regarding the changes to the project(s).
