DEFINATIONS

• An establishment to which provision of act have been
declared under Sec. 2(1)
6. MISCARRIAGE
Expulsion of the content of a pregnant uterus at any period prior
to 26th week of pregnancy.
7. WAGES
Remuneration paid or payable to a woman.
8. WOMAN
Woman employed by an Organization
PROHIBITION OF EMPLOYMENT
• Employment of women prohibited during certain periods
(Section 4)

Employer prohibited from employing any woman
6 weeks immediately after delivery

If pregnant woman makes a request to work, she shall not
be given a work of following nature
• Work of arduous nature
• Involving long hours of standing.
MATERNITY BENEFITS
Payment to a woman at the rate of average daily wage for
period of her actual absence.

CONDITIONS FOR PAYMENT OF MATERNITY BENEFITS


• Worked for at least 80 days in the Establishment [SEC.5(2)]
• Maternity Benefit for a maximum period of 12 weeks
[SEC.5(3)]
• Death

• Notice to claim for maternity benefit (SEC.6)
Any woman in an establishment and entitled to maternity
benefit may give notice to her employer stating her maternity
benefit.
• Mode of Payment [SEC. 6(5)]
Amount of maternity benefit should be paid in advance.
• Payment of Maternity Benefit in case of death of woman
(SEC 7)
If woman dies before receiving the maternity benefit, the
employer should pay the amount to the person nominated by
the woman.
• Forfeiture of Maternity Benefit (SEC 18)
If a woman works in any establishment after she has been
permitted by her employer to absent herself under Sec 6
She shall forfeit her claim of maternity benefit.
• Dismissal during absence of pregnancy (SEC. 12)
Unlawful for employer to dismiss her on account of
pregnancy.
• No deduction of wages in certain cases (SEC 13)
• Medical bonus (SEC. 8)
