‘On October 15, 2010, the following incidents occured in the vicinity of 1940 9° Street]
NW, Washington, D:
At approximately 2:30 am. the Metropolitan Police Department received a report for
destruction of property at 1940 9® Street, N.W., Washington, D.C. Ac officer was sent tothe

property was in the 2000 block of 9 Street, N.W. The poioe officer located an individual, late
‘identified as Ali Ahmod Mohammed, lying onthe ground, unconscious and not breathing on
sidewalk on 98 Street, just north of the intersection of and U Street, N.W. The officer
‘rendered CPR tothe victim until medics arrived. The medics also rendered CPR and took the
victim to Howard University Hospital. At approximately 3:15 am, Mr, Mobammed was
pronounced dead at Howard University Hospital
Police later interviewed two witnesses. One witness, refered to herein as “W-1,"
reported tha it was preset in the 2000 block of 9 Street, N.W., when it saw Ms. Mchammed
‘walked past t towards 1940 9 Street and carrying a brick in is band, Moments later, W-1
heard the sound of glass breaking and saw Mr. Mohammed running north on 9" Street with fi
‘males chasing him. Mr. Mobammed ran past W-1 pursued by the five males. W-1 saw
defendant Preller catch the victim and throw him tothe ground, W-1 then watched defendants,
(Carter, Zalogs, Spicer and Phillips kick and stomp the victim on the head and the body as
defendant Prelice held the vitim down... W-1 watched defendant Spieler kick Mr. Mohammed
several times, then stop when the police approached and attempt to flag down the police.
