Undoubtedly, the judiciary occupies an inimitable and distinctive position in any
democratic society. It is called upon to decide disputes that cannot or should not be left
to the political branches or private individuals. It upholds the law for all, safeguarding
the rights of individuals and minority groups against the excesses of abusers. It also
combats corruption, confronting the interests of the political branches or powerful
individuals.

An effective and efficient judiciary applies and enforces laws and regulations impartially,
predictably and efficiently. Economic growth and social development cannot be
sustained and promoted in countries where the justice system fails. It is very important
and necessary to assist governments to develop and implement judicial reform
programs to achieve sustainable economic growth and social development based on
empowerment, opportunity, and security for all citizens. By consistently enforcing clear
rules, an independent and impartial judicial system supports legal reform and promotes
economic and social development.

Over the last decade, most countries of the Central and Eastern European (CEE) region
have begun reforming their judicial sectors. In order to consolidate democratic regimes,
a series of reforms aimed to install independent courts boasting impartial judges using
fair adjudicative procedures. Work is ongoing, and must now be supplemented by
increased efficiency in court performance while maintaining accessibility for all.
