BILL TO BE ENTITLED
AN ACT

1 relating to certification and or verification by the Commissioner of Elections to place on the


2 ballot of candidates for president or vice-president of the United States.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF DELAWARE:
4 DEL CODE 15 CH 33 is amended by
5 amending § 3304 and adding Subsection (c) to read as
6 follows:
7 (c) Except as provided by Subsections,(a) and (b) the
8 Commissioner of Elections shall certify in writing for placement on the
9 general election ballot the names of the candidates for president
10 and vice-president who are entitled to have their names placed on
11 the ballot.
12 (d) The Commissioner of Elections shall not certify the name of a
13 candidate for president or vice-president unless the candidate has
14 presented the candidates original birth certificate indicating
15 that the person is a “natural-born United States citizen”.
16 SECTION 3304

This Act takes effect May 2, 2011.

Definition of a Natural Born


In accordance to Sec. 1992 of U.S. Revised Statutes Natural born United States Citizen is defined as
“every human being born within the jurisdiction of the United States of parents not owing allegiance to
any foreign sovereignty as is, in the language of the United States Constitution itself, a natural born
citizen.”

Definition of a Natural Born Citizen Rep. John A. Bingham commenting on Section 1992 said it means
“every human being born within the jurisdiction of the United States of parents not owing allegiance to any
foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.” (Cong. Globe,
39th, 1st Sess., 1291 (1866))
