As reasons therefore, Plaintiff states: Multiple letters written by friends and family members are not part of the record, nor should they have ever been placed within the file but should have been sent back to the sender. Massachusetts Supreme Judicial Court Rule 3:09: Code of Judicial Conduct "Ex parte communication" denotes a communication, which occurs without notice to or participation by all other parties or lawyers for all other parties to the proceeding, between a judge (or by court staff on behalf of a judge) and (i) a party or a party's lawyer or (ii) another person who is not a participant in the proceeding. See Sections 3B(7), 3B(7\(a), 3B(7)(@)G) and (ii) and 3B(7\¢e). Leisha Tringali requests any and all ex parte communications be stricken from the record immediately.
