Please be advised that the undersigned represents the City of Melrose, specifically
Chief of Police Michael Lyle.
You recently served Chief Lyle with a subpoena to compel his presence at the
Middlesex Probate and Family Court in Cambridge on December 10, 2010 at 9:00 a.m. Chief
Lyle will be unavailable that morning, due to circumstances which are confidential and which
involve a police investigation that cannot be revealed.
I have tried to call you at 603-893-9333, however, a recorded message states that
your mailbox is “full”
Please call me immediately upon your receipt of this letter to discuss this matter. If
your intention is to obtain copies of police reports, the City of Melrose can get these to you
ahead of time.
Ihave spoken with Attorney Kevin P. O'Malley who, according to the Probate Court's
Docket, represents the other side of your case. Attorney O'Malley has informed me that he
would not object to the police reports being offered into evidence, without live police
testimony, | am copying Attorney O'Malley on this letter, and if 1 misconstrued my
conversation with him, I would encourage him to call me right away.
