(06187) Supervisor Review Date/Time: 10/13/2010 16:06:37, Wednesday Contact: Reference: Assist Report On October 11, 2010, I responded to 1948 Duckweed Place to backup D/S S. Hills #25117 on a person calling for help call for service. I was the second deputy on scene. As I pulled up D/S Hills met me on the road next to a white male with injuries, The white male was being treated by public safety who had just arrived on scene. There were still possibly vietims in the residence which had not been cleared so D/S Hills and I approached the residence. As we approached I could see a lot of blood on the pathway leading to the steps. There was more blood on the steps, and on the front screen door. I yelled, "Sheriff's Office," and a female voice yelled, "help," from inside the residence. DiS Hills and I entered the residence. As I entered the residence | immediately noticed two people on the floor to my left. A white male who appeared to be dead, and a white female who had serious injuries but was able to communicate, D/S Hills and I continued to check the residence. The door to the right of the front door led to a bedroom. D/S Hills opened the door, and I looked inside, I was able to see a bed and a large dog on each side of the bed. I did not see any signs of anyone in the room, and because the injured white male on the side of the road told us the dogs would bite us we did not enter the room at the time, We continued our check of the residence by sweeping through the kitchen area and closet. The woman yelled for us to check on the baby. She said the baby was in the bedroom with the flower on the door. As we approached the door I noticed a small live bullet in front of the door on the floor. We entered the room and found a white female child in her crib awake, but untouched. We then checked the bedroom to the left of the child's room. No one was inside, As we came back into the front room where the two people were we noticed an additional white male between two couches who also appeared to be dead. After checking the residence we asked public safety to come inside. Public safety came inside and provided first aid to the white female. 1 walked out the front door and met with D/S D. Paniccia #6137, the officer in charge for the shift, who advised information had been obtained a possible suspect lived in a trailer at the back of the property. D/S Padgett #6996, D/S Paniccia, and I walked back to the trailer, a brown/tan single wide trailer in poor condition past the pole barn on the property. We checked the front and rear doors, but both doors were locked, We returned to the driveway. D/S Paniccia assigned me the task of conducting a neighborhood canvass. Teonducted a neighborhood canvass of the homes on Duckweed Place and Wood Duck Road. After completing the neighborhood canvass I turned my notes over to Sgt. W MeKinney #720. (06144) Supervisor Review Date Time: 10/11/2010 08:49:47, Monday Contact: Reference: Assisi Report On 10/11/2010, at 0403 hours, I responded to 5487 Wood Duck Ra. in reference to assisting D/S Hills concerning a call of homicide. Upon arrival I was met by Lt. Burke, D/S Paniccia, and D/S Saunders. Lt. Burke advised that several subjects had been shot within the residence and that the exterior perimeter needed to be checked for the possible suspect(s) and then secured in an attempt to preserve all pertinent evidence. At this time myself, D/S Paniccia, and D/S Saunders completed a perimeter check of the property which revealed no sign of the suspect(s) in the area. What appeared to be those of recent tire tracks were observed from the back of the residence which lead to a mobile home at 5510 Squaw Lane. The tire tracks were then observed exiting the property onto Squaw Lane toward Wood Duck Rd. After observations of the tracks were made we approached the residence at 5510 Squaw Lane in an attempt to contact the resident and confirm the suspect(s) was not inside The door of 5510 Squaw Lane was knocked on several times but an answer was not received. ‘The front and rear door were both found to be secured and entry was unable to be made, Another residence near the back of the property was also observed and later investigation revealed it to be that of 5516 Squaw Lane. After concluding our check of the property I relocated back to 5487 Wood Duck Rd. and began securing the perimeter of the crime scene, After the perimeter was secured I remained at the driveway leading into the residence and began a record of the personnel entering and exiting the area, Relief arrived on scene later in the morning and the record log. was assumed by D/S Calaway, with the Reserve's Unit "Quick Response Team". Assistance was then given to D/S Saunders and Sgt. Chalker to confirm perimeter security until being relieved of my duties by Lt. Burke. Personnel recorded by my record log, prior to transfer to D/S Calaway, are as follows: Clay County Fire and Rescue: Lt. Coleman (Engine 13), Lt. Jennings (Rescue 15), Lt. (06144) Supervisor Review Date/Time: 10/11/2010 10:19:09, Monday Contact: Reference: Assist Report ‘On 10-11-2010 I was dispatched to the area of Duckweed Place and Wood Duck Road in reference to a person calling for help. While en-route dispatched advised that several people had been shot, I arrived at 1948 Duckweed Place and heard a male voice yelling "Help" I then observed a white male, covered in blood, exiting from the bushes next to the rail box. The male was bleeding from his left arm and had a large cut to the back of his head. The mate said his son, Scott, had hit him with a machete and had shot his wife and other son in the house. As I was talking to the male 1 observed a small dark colored SUV leaving Squaw Lane at a high rate of speed. The male said that was his son, Scott, and he was armed with a shotgun, rifle, and a hand gun. The vehicle turned right onto Wood Duck Road from Squaw Lane. The vehicle then turned right onto Muscovy Road from Wood Duck Road. I advised dispatched of the information. I then took up a position behind a large tree where I had a view of the front of the house and the male subject at the road, Rescue arrived and administered first aid to the male at the road. Deputy J. Saunders arrived and we approached the house from the right side. As we approached the house T noticed a large amount of blood on the steps, and on the front screen door. Deputy Saunders yelled "Sheriff's Office" and a female voice yelled” "Help" from in the residence. We entered the residence into the living room. As we entered the residence I noticed two people on the floor to my left ‘The living room floor was covered in blood. The white male appeared to be dead, and a white female was covered in blood, but was talking. Deputy Saunders and I continued to check the residence, The door to the right of the front door led to a bedroom. I then opened the door, and I looked inside. I was able to see a bed and a large dog on each side of the bed. I did not see any signs of anyone in the room, and because the male at the road told us the dogs would bite us ‘we did not enter the room at the time. We continued our check of the residence by sweeping through the kitchen area and closet, As we were clearing the living room, I noticed several spent shell casings under the kitchen table and on the couch. ‘The woman yelled for us to check on the baby. She said the baby was in the bedroom with the flower on the door. As ‘we were making our way to the bedroom we passed the bathroom which was covered in blood. As we approached the door with the flower on it I noticed a small live bullet in front of the door on the floor. We entered the room and found 1 white female child in her crib awake, but uninjured. We then checked the bedroom to the left of the child's room. No one was inside. As we came back into the front living room where the two people were we noticed an additional white male between two couches who also appeared to be dead. After checking the residence we asked Rescue to come inside. Rescue came inside and provided first aid to the white female, As they were tending to her injuries I continued to watch the unsearched bedroom that contained the dogs. The female said she was sleeping and was awoken to shooting in the living room, When she entered the living room her "son" was going otazy. (061-44) Supervisor Review Date Time: 10/11/2010 15:41:24, Monday Contact Reference: Assist Report On 10/11/10 at 0549 hours, I responded to 1920 Duckweed Place in reference to a shooting incident. Upon my arrival I met with Sgt. Chalker to obtain my assignment. I was instructed to relieve the Deputy inside the scene and was escorted inside the scene by Lt. Burke, At the front porch, I entered the residence and walked through the living room, around the right side of the island in the kitchen, through the kitchen and into the hallway. I relieved Deputy Hills where he was standing in the hallway. This location was tactically sound in that I could observe one unsecure room off the living room and still observe the bedroom where a sleeping child was located ‘While inside the residence 1 moved several times between the hallway and the kitchen. On the kitchen table I observed several pieces of mail and one document that appeared to be a legal document. I unfolded the document which was an incomplete temporary custody order. I learned that the name of the child sleeping in the bedroom was Marissa and that her father was Ray Kilgore. Ray Kilgore was intending to seek custody of the child while living with a relative ‘After several hours, I was advised that the Department of Children and Family Services had arrived and intended to take custody of the child, Marissa. I was asked to gather some clothing for the child and attempt to locate a car seat. I searched a cabinet in the child's room but did not find any clothing or a diaper bag, I located a brown and pink diaper bag between a chair and the closet in the child's bedroom. I removed approximately 5 shirts and pants from the top drawer of a dresser inside the closet. 1 also removed approximately 5 pairs of white socks. I located a bag of diapers on the floor beside the child's crib. 1 placed the bag of diapers, the clothing and a stuffed animal from the child's erib inside the diaper bag. I used one of the diapers and two wipes to change the diaper of the child while she lay inside the crib, located a car seat in the kitchen. The car seat was sitting on top of a chair in back comer of the room, next to the back window. I took the car seat and the diaper bag out of the residence and handed them to a waiting evidence technician, Louanne Hearth, ID #7404. She in turn gave these items to Lt. E, Calloway, ID # 9508. Before reentering the residence, I used a green chair that was on the porch to prop open the front screen door. I reentered the residence, walking the same way through the living room and kitchen into the child's bedroom. I picked up the child from her crib and placed a blanket from her bed over her head and my shoulder. I exited the residence carrying the child following the same path that I used to enter the residence. I exited the property and carried the child to a protective investigator with the Department of Children and Family Services who was waiting just outside the ‘outer perimeter. ‘The car seat and diaper bag were retrieved from Lt. Calloway’s vehicle by Detective T. Barnes and tured over to the Department of Children and Family Services Protective Investigator I reentered the inner perimeter of the property but did not go back inside the residence. (00511) Supervisor Review Date / Time: 10/20/2010 09:59:58, Wednesday Contact: Reference: Evidence Collection On 10/11/10 at approximately 04:26 hours, I was dispatched to S487 Wood Duck Road, Middleburg to assist Robbery Homicide in a homicide investigation. Upon arrival I met with Sgt. W. McKenney and D/$ R. Monson (00511) who told me that four individuals had been shot inside of the residence, D/S Monson determined that I would be primary on this call and CST E, Thompson (06554) would be assisting me. ‘The residence is a single story residence located off a dirt road. A large portion of the property is enclosed by a fence and woods. The rear of the property contained a large metal open front shed. A path in the rear of the property led from the main residence to the back of the property where a brown single wide trailer was set up. Upon arrival I was informed that two victims had been transported to the hospital and two white males were dead inside of the residence. A scene walk through of the residence was on hold pending a search warrant. CST Thompson began to take overall photographs of the exterior of the residence, I observed a trail of blood leading from the front sereen door and down the front porch steps to the yard. The trail appeared to extend down the driveway and out to the mailbox. 1 was informed that the father had ran from the house and out to the street. On the right side of the residence I observed a black handle kitchen knife laying on the ground. In the back yard behind the main residence, I observed a pair of yellow gym shorts and a purple hair scrunchie laying on the ground. With assistance from CST Thompson, we proceeded to take measurements of the exterior property. Measurements will be included with an additional supplement. Following the issuance of the search warrant, a scene walk through was conducted inside of the residence. Entry was ‘made through the front door into the living room area. I observed a large amount of blood on the interior and exterior of the front door. Inside the living room area, I observed a large amount of blood on the tile floor and two white males laying on the floor. Victim #1, James Coody was laying on his left side on an area rug in front ofthe living room couch and a brown recliner, Victim #1 was wearing a red shirt and a pair of red,white and black stripped shorts Victim #2, Raymond Kilgore was laying on his stomach between the couch and a chair and ottoman with both arms tucked underneath him. Victim #2 was wearing a pair of dark colored shorts covered with skulls and a black and white muscle shirt, Victim #2 was secluded by the chair and ottoman at this time. A large amount of blood was observed on the floor in the hallway and in the entire bathroom area, The master ‘bedroom located on the right side of the living room contained two dogs and the door was shut. Two more bedrooms ‘were located fo the left of the living room. No blood was observed in either of these rooms. Following the scene walk through, D/S Monson proceeded to video tape the entire scene. | proceeded to photograph the interior of the residence. Tentered the residence through the back door due to the amount of blood at the front entrance. 1 photographed the kitchen area where I observed drops of blood on the kitchen floor that appeared to lead from the living room area to the back door. I observed two spent shell casings on the kitchen floor. 1 photographed the shell casings. I continued down the hallway where I photographed the hall, bathroom and two back bedrooms. I proceeded to photograph the living room area. The master bedroom was not photographed at this time due to the two dogs secured inside. Upon completion of taking photographs, I began to mark the crime scene with crime scene numbers and identifying evidence to be collected. Measurements will be included with an additional supplement. I proceeded to start collecting all evidence that was marked including biological samples. I observed possible blood located on and below the mailbox at the end of the driveway. I photographed this area with and without scale. I also observed what appeared to be a trail of possible blood leading from the road up the driveway toward the residence. Deputy Monson advised that the father of the subject had ran from the house to the mailbox. As I approached the residence, I observed possible blood leading from the front door, down the porch stairs and across the grass possibly leading to the driveway area where I had previously observed possible blood trail. I photographed these areas. As I continued, along the right side of the property line fence and approached the back of the residence, I observed & large shed with an open area toward the front of it.I also observed two vehicles, a dark blue truck near the side of the residence and a tan and gray colored truck near the back of the residence. I observed a black handled knife near the side of the residence and the dark blue truck, and a purple serunchie with a browa/red substance on it and yellow gym shorts near the back of the tan and gray truck, I took overall photographs of the two vehicles. Entry was made through the front door into the living room area. Upon entry, I observed a large amount of possible blood on the interior wall next to the front door, as well as the interior of the front door. I also observed a large amount of possible blood on the tile floor of the living room and hall area leading to two back bedrooms and @ bathroom. Two white male victims were found lying on the floor of the living room. One victim was ‘wearing a red shirt and a pair of white and black plaid shorts (Victim #1). He was lying on his left side on an area rug, next to a light brown reclining chair and in front of a dark brown couch. ‘The other victim (Victim #2) was located to the right side of a dark brown chair and ottoman and the left side of an end table that was sitting next to the couch in this comer of the living room. Victim #2 was found lying on his stomach with his head closest to the wall and his feet lying near the middle of the front of the couch. Victim#2 was wearing a black shirt and dark colored shorts. He had multiple visible tatoos on his arms and legs. The master bedroom was located to the right of the living room with the door shut due to two dogs being contained within the room. The kitchen was located in the area straight across from the front door on the opposite wall. I observed two shell casings lying underneath the kitchen table, as well as what appeared to be possible blood droplets leading to the back door from the hallway/living room area, Just outside the back door, on the back porch, I observed a small droplet of possible blood. CST Hearth collected these items for submission into evidence. Before entry into the residence, I tested the area on the back porch (evidence marker #17) for possible blood using phenolpthalein. The tested resulted in a positive for possible blood. This area was then swabbed for DNA. ‘Myself and CST Hearth then made entry into the residence through the back door due to the amount of blood at the front door. CST Hearth photographed the interior of the residence, except for the master bedroom due to the dogs being contained in this room, After photographing the interior, I assisted CST Hearth in placing evidence markers within the residence (**See CST Hearth’s report for the details regarding the evidence markers). I then assisted CST Hearth in taking measurements of the interior of the residence, as well as distances to evidence markers. (**Measurements will be listed on additional sheets) While examining the scene, we observed multiple shell casings in the living room area on the floor and on the couch. A projectile was located, as well as a possible hole from this projectile in the seam of the couch. Unspent rounds were also observed in the hallway and in the bathroom. Upon examination of the two bedrooms located down the hallway, there appeared to be no blood located in these rooms (baby's room and possibly Victim #2°s room). Upon examination of the bathroom, I observed that the interior of the bathroom and its fixtures liad large amounts of possible blood. I observed what appeared to be pellets from a shotgun shell on the floor of the bathroom, these items were marked and photographed. Three cell phones were located within the living room area, one on top of the ottoman, one beneath the ottoman, and the third underneath the couch. With the assistance of Deputy Monson, I rolled Victim#1 onto his back. It appeared that Victim#] had an injury to his upper right shoulder and to his left side, CST Hearth took additional photographs with and without scale, ‘The dark brown chair and ottoman were then moved in order to access the area in which Victim#2 was located. CST Hearth took photographs, and then I assisted her in taking measurements of the location of the victim. He appeared to have injuries to the upper right area of his back and the back of his legs. CST Hearth took photographs with and without scale, Deputy Monson then rolled Victim#2 onto his back, Injuries were then observed on the victim's stomach area and upper left torso. He also appeared to have a laceration of some type to his right forearm. CST Hearth photographed these areas with and without scale. After the dogs were removed from the master bedroom by Animal Control, Deputy Monson retrieved two cell phones from the room for submission into evidence. I took overall photographs of the bedroom. Upon entry into the bedroom, I observed possible blood on the floor immediately past the entryway, as well as underneath a side table. These areas of possible blood were in the forms of « dog's foot. I responded to 5487 Wood Duck Road and upon arrival I contacted Lt. Bucci and Sgt. McKinney who related what information that they had to me. Lt. Bucci stated, it appeared that a male suspect, Christopher Kilgore had possible shot his mother, father, brother and another unknown white male, I was told at this point we were having to standby for a search warrant, ‘When I had finished talking with Lt. Bucci and Sgt. McKinney, I contacted CST Antoniello, I.D. 7403, and had her responded to assist in the scene processing. He instructed me to obtain the directional information required for the search warrants, While enroute to the scene I pulled up the call notes and discovered that the original caller was Richard Scales and the original address was listed as 1920 Duckweed Pl.. 1 arrived at the scene (5487 Wood Duck Rd.) and met with Sergeant McKinney. Deputy Hills stated that Dauiphus Kilgore told him that his son, Scott (Christopher Scott Kilgore) had shot him. Deputy Hills also added that, D. Kilgore told him that a child and his wife were in the house and his wife had also been shot. Deputy Hills stated that Daulphus Kilgore was yelling his wife, a baby and other victims were still inside the residence (5487 Wood Duck Rd,). Deputy Hills stated that while speaking to Daulphus Kilgore he observed a vehicle pull out of Squaw Ln. and turn right (North) onto Wood Duck Rd. Deputy Hills then indicated that he observed the vehicle turn right (East) onto Muscovy Rd... While observing the vehicle Deputy Hills stated that Daulphus Kilgore indicated that the vehicle was his and that the suspect (Christopher Scott Kilgore) was driving it Deputy Hills indicated that when a backup deputy arrived they made a check of the residence. Deputy Hills and another deputy conducted a walk-through of the residence. Deputy Hills indicated that there were two white male victims deceased in the living room area of the residence. He indicated that the white female victim, Judy Griffin Kilgore, WF, 11-03-56, was removed from the residence via the front door. He informed us that Lieutenant Coleman of Clay County Fire Rescue #13 pronounced the two male victims dead at 04:34, While providing the information Deputy Hills also informed us that two dogs were secured in the bedroom at the south end! of the home, in what appeared to be the father's room. Deputy Hills indicated that at least one of the dogs was aggressive. Saunders #6562, searched the outside of the residence were Christopher Scott Kilgore was thought to reside (5510 Squaw Lane). The residence was secure so no entry was made. A child’s car seat was seen in the front yard near the front porch area that appeared out of place. Deputy M. Dangerfield #0363 was assigned to take care of the child that was unharmed but located inside the residence, The child was later released into the custody of Department of Children and Families case worker Kimberly Gowan, I was advised by Sergeant McK inney that Detective T. Cotchaleovitch #6698, was going to be the lead detective in this case and that I should assist him in obtaining the rest of the information for the search warrants. {coordinated with Detective T. Cotchaleovitch on the required information for the search warrant. Detective T. Barnes #6506 and I obtained the address of the suspect's residence at 5510 Squaw Ln. We also obtained the address of an additional residence which belonged to one of the victim's (Raymond Kilgore) 5516 Squaw Ln. This residence is currently rented to Mr. Roger Donald Hadaway, WM, 10-28-44, FI DI, #M300-724-44-3880. Detective Barnes and I provided that information to Detective Cotchaleovitch who then completed the search warrants. Detective T Cotchaleovitch then coordinated with the State Attorney's Office for the required signatures. Arriving deputies were placed in a perimeter around the property. The affected area was cordoned off with crime scene tape. The Clay County Sheriff's Office Crime Scene Units were on the scene processing the area. Crime Scene units processed the front yard and driveway at 5487 Wood Duck Rd, as search warrants were obtained for the residences. I was advised by Sergeant McKinney that I would be accompanying the Crime Scene Technicians as they did a walk-through of the crime scene, T accompanied Deputy R. Entry was made through the unlocked front door and each person entering was wearing protective clothing/booties/gloves as required. I observe the layout of the residence and the positioning of the victims as well as several spent bullet casings. These items, the victims and any of the other articles of evidence were not collected or disturbed during the walk-through process. I asked Adam McCumbers if he had been with Raymond Kilgore the previous night. Adam MeCumbers indicated that on October 10, 2010, at around 2200 Raymond Kilgore and a young white male came and picked him up at his residence, He stated that he is unsure of exactly what the younger males name was but is aware that he lived in the area of Old Carter Rd. or Bobby Padgett Ré, and County Road 218. He stated that the three of them drove around looking for girls and hanging out until he was brought home at around 0200 on October 11, 2010. ‘Adam MeCumbers stated that he now thinks the white male's name is James Coody but he is not sure. He informed me that Raymond Kilgore was driving his Chevrolet Pick Up truck. I made Sergeant McKinney aware of what Adam McCumbers had informed me of and the possibility that the second victim may be James Coody. I then was advised by Sergeant McKinney that he wanted me to meet with the family members of James Allen Coody. ‘This meeting was in regards to obtaining additional information that could aid in possibly identifying the unknown white male victim, I met with the aunt (Carol S, Brown, WF, 08-05-61) at her residence of 6139 Old Carter Rd, Jacksonville, Fl, 32234 and the father of James Coody (James Allen Coody Sr., WM, 09-23-62, 6084 Bobby Padgett Rd,). I obtained a new photograph and verified that James Coody had been hanging out with Raymond Kilgore over the last few days. This included the father and mother of the victim, I informed them of the process regarding the Medical Examiner and answered any questions that they had regarding the incident that could be answered at the time. ‘After the crime scene was processed by the Crime Scene Units and it was time to move the victims’ bodies Detective ‘T. Cotchaleovitch, Assistant State Attorneys Nelson and Boyle and I, along with Crime Scene Units Monson, Hearth and Thompson entered the residence. ‘The victim Raymond Kilgore was observed to have the following noticeable wounds: three bullet entry wounds to the abdomen, one to the right side upper torso near the right nipple area, several on the left leg. The victim James Allen Coody was observed to have two wounds, one on the upper right collar bone area and one on the lower left rib cage. These could be related due to the positioning with one being an entrance and one an exit. INVESTIGATOR’S NOTE: The exact number of wounds and the type of wounds could not be exactly determined due to the amount of blood and the victim’s clothing not being overly disturbed. The exact location and number of wounds will be determined by the Medical Examiner's Office during the autopsy of each individual. I asked her how she knew that and she indicated that she was at the home visiting Raymond last week when he (Raymond) and his dad (Daulphus) got into an argument over the guns. She stated that Raymond was yelling at his father about why he (Daulphus) let Scott get away with stealing the guns. She stated that the father (Daulphus) was yelling that if he called the cops on him (Scott) the mother (Judy) would be irate. While enroute, I was diverted to head to Shands Jacksonville to interview the two surviving victims. Upon my arrival at the Hospital I made contact in the Trauma Room and spoke to the staff. I then met with Det. West and began interviewing Daulphus Kilgore who had received a major wound to his left arm. Daulphus Kilgore advised that he had been asleep in his bedroom when he woke to several loud popping noises that he recognized as gunshots. Daulphus Kilgore advised he had been in his room alone and his wife was sleeping in another bedroom with their grandchild (Ray Kilgore’s child) He headed into the hallway and saw his wife confronting his son Christopher "Scott" Kilgore struggling with his wife in the bathroom doorway. He saw Chris shoot his wife with the shotgun as they struggled, his wife collapsed after fleeing toward the living room. He advised that he was surprised that Chris had shot his wife as she was the only person he was close to in the family. Daulphus Kilgore advised that initially Chris Kilgore was reloading the shotgun as he began struggling with him. Daulphus Kilgore advised he continued to struggle with his son and was struck several times with a "machete" type knife. Daulphus Kilgore advised that he was not aware he had been shot until he tried to use his hand and realized that his arm was useless and barely attached to his body. Daulphus advised he might have passed out for a second because he doesn’t know witen he got shot. Daulphus advised that he recognized that he was losing the fight and he decided to run out of the house to try to draw the suspect away from everyone else. Daulphus Kilgore advised that as he left the house he saw his wife covering Ray with her body. Daulphus advised that he began screaming for someone to call the police in the hope of drawing the suspect after him, Daulphus advised he began falling as he tried to run and he was sure that he was going to dic if his son found him and sure that he would bleed to death even if Chris Kilgore did not find him, Daulphus Kilgore stated he saw Chris Kilgore leave the house turn on his wife's trailblazer and then return to the house and he heard more shots, being fired, he then he saw Chris Kilgore walk through the lights of the vehi Daulphus Kilgore advised that he then saw his wife's vehicle drive to the trailer his son lives in and stop there. Daulphus Kilgore advised that he made it to road near his mailbox and he wrote "why Chris?" on the mailbox because he did not want to die without leaving a message for someone to tell who killed thom. Daulphus Kilgore advised that he hid in the ditch when he heard a vehicle coming up because he thought it was Chris driving around looking for him. Daulphus Kilgore advised that when the first deputy arrived he was contacted and he advised that the deputy initially treated him as a suspect. He advised that he told the deputy that his infant granddaughter was inside the residence still. The deputy stayed there with him and did not approach the house. While they were there he heard a vehicle go by which he thought sounded like the trailblazer. Daulphus Kilgore advised that he was transported away by rescue, Daulphus Kilgore was asked several times if he knew who the second white male that had been sleeping in the living room was and he advised he had no idea as the person must have come in after he went to bed. Daulphus Kilgore was asked for consent to search the residence and property for evidence related to the murder. Mr. Kilgore gave consent for the search, advising that it did not matter what was found in the residence because the shooting would finish his job at the base anyway. Daulphus Kilgore advised that the shotgun he saw Chris using was his that had been stolen earlier in the week and that it had been cut off, He advised he had never seen the machete before. He advised he did not see his other guns that had been taken but he recognized the shooting noise that had awoken him as being from his pistol. Dalphus Kilgore provided identifying information on the three guns that were missing which included where he had bought them. This information was forwarded to the detectives on scene at the Kilgore house, Mr. Kilgore advised he ‘was missing a 12 gauge pump shotgun, a rifle that fired 7.62 bullets and pistol that fires 7.62 bullets. The rifle and pistol were of foreign manufacture. Mr. Kilgore advised thatthe rifle and pistol both used an unusual make of ammunition, and that he had only had 10-12 rounds of 12 gauge ammunition of mixed size and brand. Daulphus Kilgore was taken to surgery where surgeons attempted to reattach his arm and repair the damage. We then made contact with Judy Kilgore who had been shot in the side; she was stable and was not expected to need immediate surgery. Judy Kilgore advised that she woke up to hearing shots being fired in the living room area. McKinney requested me to interview Mr. and Mrs. Kilgore upon arrival in an attempt to gain details of this incident. Upon my arrival atthe Hospital I made contact in the Trauma Room with the Medical Staff. They provided me with the location of Mr. Kilgore and advised his injuries were not life threatening, I observed Mr. Kilgore lying on a hospital bed talking with the Medical staff. I walked over to Mr. Kilgore and introduced myself. I then asked Mr. Kilgore if he felt like explaining what had happened this morning at his residence and he said "Yes". During this time I observed Mr. Kilgore had been shot in his left forearm. I could tell by the appearance of his injury that his forearm was broken and had a large amount of trauma. asked Mr. Kilgore what happened at his residence this morning and he provided the following account. Mr. Kilgore said he went to bed on the evening of 10/10/2010 around 2300 hours at which time his oldest son Christopher "Seott” Kilgore was watching television in the family room of the residence. He said he does not get along with "Scott" so he did not speak to him, He said he woke to sounds of fire crackers. He said he soon realized the noise he had heard was his pistol being fired. He said he owns a pistol that has a distinct sound when itis fired. He said he then grabbed Scott and began to struggle with him as he attempted to re-load the shotgun, He said he pushed Soott backwards causing him to fall backwards towards the bath tub, He said that’s when he was struck in the head with what he described as a machete, He said as he was being struck he attempted to grab Scott with his left hand but discovered his, arm would not move. The suspect in this robbery was identified as Christopher Scott Kilgore after reviewing the business CCTV. Scott was also identified by the blue Chevy Blazer he was driving during the robbery. The area of Yellow Water road was searched for Scott but he was not located. On 10/13/2010 the Kilgore's Chevy Blazer was recovered in the area of Normandy Blvd in Jacksonville, Florida near the area Scott Kilgore had been hiding. This location was also several miles from where the robbery took place. It was determined by a witness who confronted Scott Kilgore al the vehicle that the vehicle had run out of gas. The vehicle was recovered and towed to the Clay County Sheriff's Office for processing. For several days I was assigned to the area Scott Kilgore was last seen in an attempted to detain him in the area. On 10/15/2010 I responded to an Officer involved shoot in the area of Normandy Blvd and County Road 217. Upon arrival I spoke with Detective Stooky with the Jacksonville, Sheriff's Office Homicide Unit. He escorted Detective E. Twisdale and me into their scene. Detective E. McKinney #720 that two white male subjects were located inside of 5487 Wood Duck Road who were deceased from gunshot wounds. Two other subjects had been transported to Shands Hospital in Jacksonville with life threatening gunshot wounds. ‘The suspect was identified as Christopher Scott Kilgore, who resides in the trailer located behind the residence at 5487 Wood Duck Road. ‘The suspect was identified by the two surviving victims (Judy and Daulphus Kilgore) who are the suspect’s parents, The suspect fled the scene in a blue Chevy Blazer which belongs to Judy Kilgore and had not been located. I observed a metal chain length fence separating the residence from Wood Duck Road. An unpaved driveway led to the residence which has a gate that opens inward. The main residence was located to the north of the driveway. A metal mailbox on a wooden pole which was marked 5487 in black marker was on the north side of the driveway. I observed what appeared to be blood on the metal mailbox, as well as blood drops on the ‘ground around the mailbox. I observed the residence to have white siding with brown trim. A set of steps led to the front doorway, which faces Wood Duck Road. A small American flag hung from the front porch area, I then proceeded to Squaw Lane and traveled east on Squaw Lane from Wood Duck Road. T observed an unmarked driveway which led south from Squaw Lane to the residence of 5510 Squaw Lane. The main residence at this location is a brown single wide trailer with brown trim, The residence is not visible from the roadway. The residence is directly behind 5487 Wood Duck Road, and the driveway for 5487 Wood Duck Road connects to the driveway of 5510 Squaw Lane. Detective West #8409 and Detective Coyne #8404 responded to Shands and conducted interviews of Daulphus and Judy Kilgore. I made contact by phone with Det. West who advised both Daulphus and Judy Kilgore stated their son Christopher Kilgore was the suspect in this case. Judy Kilgore stated she was sleeping in the rear bedroom of the residence with her grand daughter Marrissa. Judy was awoke heating gunshots in the residence. On exiting the room Judy observed Christopher backing into the bathroom holding a shotgun. Judy began struggling with Christopher for the gun at which time Daulphus arrived to help her. Christopher then shot her at which time she ran into the living room before falling on the floor, Judy observed her son Raymond and the second vietim whom she knew only as James lying on the floor. Both Raymond and James appeared to be dead from gunshot wounds, Det, West also advised me of the information which Daulphus Kilgore provided. Daulphus stated he was sleeping in the master bedroom alone. He was awoken by gunshots inside the residence at which time he exited his room into the living room, Daulphus observed Judy confronting Christopher at the entrance to the bathroom. Christopher then shot Judy with the shotgun. Daulphus began fighting with Christopher as Christopher attempted to chamber a round in the shotgun, Christopher then struck Daulphus in the head multiple times with a machete. During the struggle Christopher shot Daulphus in the left arm with the shotgun. Daulphus ran from the residence to the end of the driveway on Wood Duck Road, Daulphus then observed Christopher enter Judy's blue Chevy Blazer and drive along the connected driveway to 5510 Sqauw Lane (Christopher's residence). Due to his belief that he would die from his injuries Daulphus attempted to write "why Chris?" on the mailbox in his blood so as to identify Christopher as the suspect. The arrest warrant was for two counts of murder and two counts of attempted murder. After knocking on both the front and rear doors of the residence and announcing "Sheriff's Office search warrant" numerous times forced entry was made through the front door of the residence. The residence was cleared at which time crime scene personnel responded to the residence and began processing the scene for usable evidence. remained on scene while the two residences were processed for usable evidence, 1 was advised of a hand written letter which was located in a garbage bag inside of $510 Squaw Lane. The letter was written on yellow paper with a black marker. The letter reads as follows: "Ray love you baby with all my heart, I miss you so much. Pm sorry this shit. happened. All I want you to do is please always be here for me. tl be home soon Hove you" At approximately 1400 hours I was contacted by Sgt. McKinney and advised that a female subject named Ashley Grancham, W/F 07-08-92, had contacted dispatch advising she was with the suspect earlier in the day. Ashley had no further information. I advised Ashley that a detective would contact hor in person later on, During the course of the investigation both of the deceased victims were identified. One was identified as Raymond Kilgore W/M 03-16-1981. Raymond was identified by his numerous tattoo’s and from information provided by Judy and Daulphus Kilgore. ‘The second deceased victim was identified as James Allen Coody Jr W/M 08-22-1989. James ‘was identified as his Florida Identification card was located in his pocket. The victim's families were notified of the victim's being deceased. ‘At 1935 hours I entered into the residence. I observed victim Coody lying on his stomach and left side in the center of the living room. I observed victim Kilgore lying on his stomach in between a chair and a table in the northwest corner of the living room, Both victims were still in their original positions on my entering the residence. The victims were then moved for a gross bodily examination prior to their being transported to the Medical Examiners Office. At 1954 hours David Johnson of North Florida Removal Service (body transport) arrived and removed the victim's bodies to the Medical Examiners Office. Jeff McKeown of Animal Control then entered the residence and removed the two dogs which had been contained in the master bedroom of the residence. [advised J. The two addresses were provided to the U.S. Marshal Service as possible locations that Christopher Kilgore may seek to travel to, 1400 hours: I responded to 4404 County Road 218, the business of We Store, and made contact with Billy Campbell, anager. The business has video surveillance which points to County Road 218. B. Campbell allowed me to view the surveillance footage for the morning of 10-11-10. I did not see the Blue Chevy Blazer which Christopher Kilgore was believed to be in on the footage. B. Campbell was unable to make a copy of the surveillance video at that time due to technical difficulties with the recorder. I left my contact information with B. Campbell and requested he contact me if he was able to make a copy of the footage. 1445 hours: I made contact by phone with Dustin Thomas, who reported that David Demay had seen the Blazer driving into Jennings State Forest, at 904-383-5945. Dustin refused to meet with me in person, Dustin stated he only heard that David Demay had seen the vehicle going into the woods while at a gathering the night before. Dustin would not say who he heard this information from, nor where the gathering was at. Dustin stated he had not spoken with David Demay and only wanted to pass on the information in the event that there was any validity to the claim. 1530 hours: I made contact with Amanda Marie Meltale (who claims to be Raymond Kilgore’s fiance) at 1102 Blanding Blvd. Amanda provided the below information. During that time Raymond would sleep at her apartment from time to time, Christopher and Raymond had a bad relationship per Amanda, Approximately one and a half tonths ago Christopher attempted to stab Raymond with a knife in her presence. Richard has gone to a spot in Jennings State Forest with Christopher in the past which Christopher considered his personal area in the forest. The directions to the area were to enter the forest through the end of Nolan Road then take the first right, continue until the road forked and turn left. The road would then come to a U bend at which time Christopher would park and walk approximately 200 yards to the creek, ‘The area has several cliffs and was a place ‘where Christopher had gone to hide in the past. The location described was relayed to Sgt. Gordon #703 who was coordinating the search of Jennings State Forest as an additional area to search, Richard stated he had not spoken with Raymond in quite some time, unknown exactly how long. Richard stated he last saw Christopher approximately 10-14 days prior in the area of Old Carter Road and Louie Carter Road. At that time Richard was riding with a male named Joe Howell. After a short period, less than one minute, Richard and Joe continued to drive away. Richard stated he did not recognize the other male in the Acura ot know where Joe Howell may be at this time. Richard stated Joe Howell used to live off of Blue Jay Drive, but believed he now resided off of Louie Carter Road. I conducted a computer search and located a Joseph Howell W/M 08-17-1988 who had a prior address listed of 2098 Hermitage Pl, which is off of Blue Jay Drive, Det. Barnes and I responded to that address where we made contact with ‘Joe Howell's brother James Howell. James provided me with Josephs phone number of 904-328-4605. James confirmed that Joseph was living off of Louie Carter Road, possibly on Westwood Road, though he did not know the address. J attempted to contact Joseph Howell by phone, however a male answered the phone, denied being Joseph, and hung up. James then offered to call Joseph from his cell phone. James was able to speak with Joseph at which time Joseph agreed to speak with me by phone about this case. Joseph refused to meet with me in person or provide his address. Joseph stated he did ride with Richard Paschen on Old Carter Road approximately one to two weeks prior, though he denied seeing Christopher Kilgore at that time, Joseph stated that he did know Christopher, however he had not seen ‘of spoken to him in a long time. Joseph stated he had no further information. Due to not having a good address for him, I was unable to contact Joseph Howell in person for further interview. 2048 hours: A BOLO was received from the Jacksonville Sheriff's Office in reference to an armed robbery that occurred at 14801 Normandy Blvd. ‘The BOLO stated the suspect in the robbery matched the description of Christopher Kilgore. The BOLO further stated the suspect carried a sawed off shotgun, and left in a blue Chevy Blazer. I responded to the scene of the robbery and made contact with JSO Detective Bearden and Detective Miley. Det. Bearden advised he was the lead detective on the robbery and provided the JSO case number of 2010-817080. entered the business with the JSO detectives and viewed the video surveillance of the robbery. The suspect entered the business at 2020 hours. I recognized the suspect to be Christopher Scott Kilgore. The suspect walked to the counter carrying a sawed off shotgun and proceeded to commit the robbery. ‘The suspect then left the business in the blue Chevy Blazer. Detective Bearden stated that no witnesses were able to obtain the tag number for the Blazer, or the direction in which the vehicle left. Det. Bearden stated the suspect asked for (5) cartons of Newport brand cigarettes, candy, and money. During the robbery a black male approached the suspect at which time the suspect stated "go to the bathroom and I won't kill you" to the male. At the end of the robbery the suspect requested the clerk to "turn con pump 2," however the suspect did not pump any gas prior to leaving the business, 1 contacted Set. JSO also had numerous Units respond to the area to begin searching for the suspect, 1 then met with Det, West #8409 and began checking gas stations in the area as the suspect may attempt another robbery, or need to purchase gas, We responded to the Kangaroo gas station at 10401 Normandy Blvd, On arriving outside the business I was contacted by Ralph Richardson (full information listed below) who stated he knew Christopher Kilgore and had seen him earlier in the day. On this date Ralph received a phone call from Jimmy Kilgore at approximately noon asking for help in fixing his father's truck. Jimmy asked Ralph {fo meet him at the Kangaroo gas station located atthe intersection of Yellow Water Road, and Normandy Blvd (which is 14801 Normandy Blvd). Ralph drove to that location where he met Jimmy Kilgore at a closed business across from the Kangaroo. The truck, a primer grey 1985 Ford F150, was at the closed business. Jimmy asked Ralph to replace the distributor cap on the truck, which Ralph did. Ralph stated that Christopher Kilgore was in the vehicle which Jimmy ‘was riding in, Ralph stated Christopher would not get out of the vehicle and did not say much. Ralph stated Christopher was wearing a Florida Gators shirt, and unknown further description as he was seated in the vehicle. Ralph spoke briefly to Christopher about the Florida Gators, though that was all. After completing the repair Ralph drove back to his residence. Ralph stated he did not have any knowledge of this case until seeing the newspaper just prior to contacting us, Ralph further stated that Jimmy Kilgore resides off of Yellow Water Road with his father. Ralph stated Jimmy Kilgore and Christopher Kilgore are not related, though they became friends due to the common last name. Ralph agreed to ride ‘with me to point out Jimmy Kilgore’s residence. On riding to Yellow Water Road Ralph observed the Police activity at the Kangaroo gas station where the robbery occurred at which time he began asking what happened there, Ralph claimed to have no knowledge that the robbery had occurted, or that Christopher Kilgore was the suspect in that case. I retumed to the area of the residence which Ralph stated was Jimmy Kilgore’s. A computer search was conducted which revealed that a James Kilgore did reside at 4906 Yellow Water Road, which was the residence that Ralph pointed out. Members of the OSS unit, U.S. Marshal Service, Det. West and I then attempted to contact Jimmy Kilgore at that residence with negative results, I was then flagged down by an unknown neighbor and advised that Jimmy Kilgore actually resided at 14908 Yellow Water Lane, We then responded to that location and made contact with Jimmy Kilgore whose information is listed below. Jimmy stated he does not know Christopher Kilgore, and had never met him, Jimmy stated he does know Ralph Richardson, but had not seen him today. Jimmy stated his father’s truck was not broken down during the day. A check of the area did not reveal any evidence that Christopher Kilgore had been present. 10-13-10 0702 hours: I was contacted by dispatch and advised the blue Chevy Blazer which Christopher Kilgore was driving had been located in Jacksonville, responded to 16610 Normandy Blvd and observed the Blazer, Florida license plate B401EQ in the unpaved driveway to the residence, On arrival there were numerous J.S.0. Officers on scene. I made contact with John Waters who provided the below listed information. Waters was awoken by his dogs barking, which is out of the ordinary. J. Waters did not go “outside at that time to check on the dogs, as he believed they may have been barking at animals. Approximately one hour later his wife, Kimberly Waters, left the residence in her vehicle. Kimberly immediately returned and informed John that a vehicle was blocking their driveway. John told Kimberly to call 911 as they were aware that Christopher Kilgore was inthe area the previous night, John took his 9mm pistol and went outside to check the vehicle, The driveway is not lit, and John could not see the vehicle to determine whether or not it was the blue Blazer. On approaching the vehicle John realized that it was in fact the Blazer, at which time he yelled for his wife to call 911 again to inform J.S.0. As John stood near the vehicle a male subject approached from the woods on the west side of the driveway, John could not see the males face or clothing due to the low light conditions. John could not tell ifthe ale was armed or not. John yelled to the male that he had a gun and had contacted the police, The male told John that he was out of gas and just needed help. John told the male to stay where he was until the police arrived, at which time the male turned and walked up the driveway to Normandy Blvd. As the male reached Normandy Blvd John observed the miale was carrying a sawed off shotgun at his right hand side. John continued to watch the male who ‘walked west on Normandy Blvd for approximately 100 yards and then entered the woods on the south side of ‘Normandy. John returned to his residence and waited for J.S.O. to arrive. I then made contact with Kimberly Waters whose information is listed below. Kimberly stated she did not see the male subject whom her husband encountered. I then contacted Det. C. C. Waters #7349 of the J.S.0. Robbery Unit, I requested the vehicle be towed to the Orange Park Substation for processing which Det. Waters agreed to. T contacted Det. Coyne #8404 and requested be respond to Shands Hospital to ask Daulphus and Judy Kilgore for consent to process the vehicle for usable evidence. Both Daulphus and Judy signed a Voluntary Consent to Search form authorizing the Clay County Sheriff's Office personne! CST Lynch #7403 responded to the scene and photographed the vehicle. ‘At 1007 hours I contacted dispatch and requested the departmental wrecker respond to tow the vehicle to the Orange Park Substation. 1 then made contact with J.S.0. K9 Officer D. B. Hall #5368 who requested a scent article be retrieved from the vehicle fo assist in the K9 track of the suspect. At 1118 hours due to the exigency of an armed homicide! robbery suspect being on foot in a residential area placing numerous persons in danger CST Lynch and J entered the vehicle and retrieved a black Columbia brand jacket which was provided to Officer Hall for use in obtaining a scent track. CST Lynch secured all ofthe doors and windows of the vehicle with evidence tape, At 1133 hours Dewey Purvis of Scott's Affordable Towing towed the vehicle from the scene, 1 followed the tow truck to the Orange Park Substation where it was placed in the secured back parking lot for processing. The vehicle was processed by CST Lynch forall usable evidence, for full details refer to her supplemental report ‘After the vehicle was processed I returned to the area of Normandy Blvd where the suspect was believed to be contained and assisted in the perimeter. On 10-15-10 I was contacted by Lt. Bucci by phone and advised that Christopher Kilgore was shot and killed by members of J.8.0, reference to J.S.0. case #2010-824381. I was advised that J.S.O. recovered a handgun, and shotgun, ‘anda rifle which were in the possession of Christopher Kilgore at the time of the shooting. For further details itis recommended that authorized personnel view the J.S.0. report documenting the incident. On 10-18-10 1 was contacted by the warrants section and advised that the warrant issued in this ease was removed from the system due to the death of the suspect. On 10-22-10 I made contact with Daulphus Kilgore at Shands Hospital in Jacksonville. Daulphus requested that any items which were collected as evidence that belong to either he or his wife Judy be released to Mike Straver once they ‘were available to be released. Cold Case Unit at $01 E Bay Street, J.8.0. headquarters. Det. Stooki released the guns which were in Christopher Kilgore’s possession at the time he was shot to me. I transported the guns to the Orange Park Substation where they were photographed by CST Antoniello prior to being submitted into evidence. Summary On the moming of 10-11-10 Christopher Scott Kilgore entered his parent's residence at $487 Wood Duck Road, Middleburg, FL 32068, which is within Clay County, while armed with at least a handgun, a shotgun, and a machete, Once inside the residence Christopher shot his brother Raymond Kilgore at least 11 times with a pistol killing Raymond. Christopher also shot James Coody one time with a pistol killing James, Christopher then shot his mother Judy Kilgore once with a shotgun. Judy was transported to Shands Hospital where she later recovered from the injury. Christopher then struck his father Daulphus Kilgore twice with a machete. Christopher further shot his father Daulphus once with @ shotgun. Daulphus was transported to Shands Hospital where his left arm was amputated just below the elbow as a result of the gunshot. Daulphus was able to recover from the injuries. Christopher removed several of the spent casings, including both spent shotgun shells, from the residence. ‘After the shootings, Christopher took his mother’s Chevy Blazer bearing Florida license B401EQ which was parked on the south side of the residence. Christopher drove to his residence of 5510 Squaw Lane via a shared driveway between the two residences. Christopher removed a child safety seat from the Blazer which was located near his residence. Christopher placed numerous pieces of his clothing and other supplies in the vehicle and then left fled the area. Despite an intensive search, Christopher remained hidden until the following night, 10-12-10, at which time he committed an armed robbery of the Kangaroo located at 14801 Normandy Blvd in Jacksonville, Christopher carried shotgun in that robbery, believed to be the same shotgun used in the homicide, Christopher fled the area and was not located that night. (On the morning of 10-13-10 the Chevy Blazer was located at 16610 Normandy Blvd. Christopher was seen by a citizen with a sawed off shotgun. The Chevy Blazer was recovered and a perimeter was established around the area ‘where Christopher was last seen, Christopher was not located until 10-15-10 at which time he was shot and killed by 1.8.0. None of the people shot were armed or threatened Christopher Kilgore’s life in such a matter as to cause the shootings to be justified. Probable cause for the arrest of Christopher Kilgore did exist as an arrest warrant was obtained for two counts of murder, and ‘two counts of attempted murder. Christopher Kilgore died prior to the warrant being served Due to the above listed facts this case is closed, cleared by death of the offender. Page 17
